I am wondering if she got hit with fees and costs and THATS her damages. Garin is right- if she would have lost anyway, the malp on the underlying claim is worthless. However a couple of theories might have legs (a) “There was a legit claim there but Gilbert and Chattah used my dad as a pawn to skip the legit claim and to push their bogus claim” or (b) Gilbert and Chattah pushed a case that was so specious that it resulted in sanctions against the client.
Yeah, convincing her claims they knew to be false were real and filling her with rage seems like an NIED/IIED claim. Maybe some equitable remedies could be available as well like unjust enrichment, reliance, etc. depending on circumstances.

OBC should go after both Chattah and Gilbert. Multiple RPC violations, a lot of low hanging fruit. DH, do your thing.

I feel so bad for the daughter in the wrongful death case but major props to her for highlighting what predatory lawyering can do.
Motions to dismiss are pending. It is an interesting theory of liability.
