Happy Festivus! (Technically, it is tomorrow, but we can’t wait so we’re going to start the festivities now!)  Gather your family, friends, co-workers, enemies, judges, opposing counsel, etc. because it’s time to kick off the holiday fun with a tradition that some of you do on the blog all year long, the Airing of Grievances

For some of you, this is what you were born to do–this is your moment to shine. Your gift of complaining is finally welcomed and wanted on this one occasion. This is your chance to civilly (meaning work appropriate and slander free) whine and complain about your salary, your job, your boss, billable hours, the courts, nepotism, sexism, the Board of Governors, bar counsel, UNLV Boyd Class of 2013, the annual boondoggle (which is in Maui next year), this blog, all the thwacking, and/or anything else that 2025 threw at you this year.  It’s also your chance to provide some feedback about the way things are done in the Las Vegas legal community. Believe it or not, there are a lot of people who read this blog and see your comments and suggestions (including administrators, judges, and other lawyers). If you want a refresher on what types of things you were disappointed in or complained about in years past, use the search box and enter “airing.”

Here’s my list:
*Email – email is putting me in an early grave. Email has trained people to expect an immediate response. Gone are the days when you receive something, have a chance to take it in, have some time to draft a response to the person within 24/48 hours.

*The American System of fees and costs – we need an overhaul of the policy against legal fees for prevailing parties. The frivolous suits are killing me and Plaintiffs know that a carrier will write a check to make a crappy case disappear.

*Political correctness – Example for this time of year – I hate that I hesitate to write “Merry Christmas” in an email -when I am a Christian and that is my holiday. Christmas is a Christian holiday. Yes, many non-Christians celebrate and appreciate the presents, santa and all the joy that comes with the holiday outside the birth of my lord and savior Jesus Christ – but fundamentally, Christmas is a Christian holiday and it should not be politically incorrect for a Christian to wish someone a Merry Christmas. I wish all of my Jewish friends and neighbors Happy Hanukkah without hesitation. And, I do say happy holidays because there are so many around this time of year. But lets stop with the Christmas shaming or offense if someone tells you “Merry Christmas.”

*Pronouns in emails – just stop it already. We all passed 2nd grade. That’s a massive red flag for most of us – you should be aware of that if you’re putting pronouns in your emails or bios (we all make fun of you and avoid you at all costs).

You cite “The American System of fees and costs”. I am not certain that I understand your comment. Of course that means each side bears their own fees and costs which can be circumvented by early and often offers of judgment which would give the mechanism to fees in the frivolous cases that you eschew.

I agree with 8:46. The comment was written in a confusing manner. A “loser pays” system will be far worse for Defendants than the American Rule.

I practice in an area of law in which fees are recoverable by the prevailing party. In practice, this means courts award fees to prevailing individual plaintiffs and deny fees to prevailing corporate defendants. Plaintiffs thus use fees to inflate their settlement demands, but don’t acknowledge having to pay fees as a risk to proceeding (because, in the overwhelming majority of cases, it’s not).

Here’s my list:

(1) Once again, I remain my own worst enemy. 80% of my problems are created entirely by me. I gotta lot of problems with myself, and now I’m gonna hear about it!

(2) The State Bar convention. I would actually like to be more involved and attend. But this is deliberately designed to keep thousands of attorneys out, and a couple hundred (at most) in. That said, this is never going to change and it’s not worth being angry over. Acceptance is the answer.

(3) The amount of time this takes away from my family. This morning, my son said, “When I own a business, I’m not making my employees work from December 22 on,” as I left the house. Oof.

(4) Dishonest lawyers.

(5) The traffic on the 215 through Summerlin. This used to be a breeze commute.

(6) The cops who give tickets on the 215 through Summerlin. You are gumming up an already bad situation and making things less safe.

(7) The absence of a decent restaurant in or around the RJC.

(8) Ingratitude of some clients. I’m EASY to manipulate. Give me just an ounce of gratitude and I’ll go bonkers on your behalf. It’s not hard. Or is it?

(9) People that interrupt or prevent nooners. One of the few pleasures of this job is sneaking home at lunch with my wife to make whoopee.

(10) Fellow so-called Christians who get their tit in a wringer over whether other people are saying and accepting “Merry Christmas”. Do we belong to the same faith? Because it feels like we do not.

(11) Entering my time.

(12) All the emails and texts which have to be responded to almost immediately.

I was involved in a case with a vexatious litigant who made a bar complaint against the lawyer. Bar Counsel’s investigator called me and so did the assistant b.c.. It was obvious they don’t understand the legal system and litigation. The attorney got sanctioned. Ridiculous.

At the beginning of his tenure, Ritchie was as good of a Family Court judge in experience, demeanor and practicality as I have ever experienced. However he has been nasty and bitter for far too long. Perhaps the experience soured him. Certainly I understand how it could have. But he is a decade too late is hanging it up.

Question for Law Dawg – if I try to access the blog from my phone it says my location is blocked by IP Location Block. I have never had a comment removed but it is okay if I am banned, I wanted to mention it from my desktop in case it was a glitch affecting others.

Anyone catch the RJ article on CERT court? It was sounding like a good thing til the last paragraph. Only two have been admitted into the program and both were removed. One for cutting off his ankle bracelet and the other for shooting someone in the face. I am shocked Bluth allowed this article to run. It started off well and made her look good but then turned into a hit piece. If these are the “kids” she’s trying to save, and not send to prison, God help us. No wonder Schwartz wasn’t in the photo op. “Kids are impulsive”. Really really bad choice of words and an even worse use of judicial resources. The “kid” that shot someone in the face should not have been in CeRT. he should have been in prison. This is on the judges hands.

They are simply trying to give the impression that they are sitting on a large war chest and not afraid to spend it in an attempt to scare off any potential challenger. In many cases it is either their last dollars they have saved, or it’s borrowed money. It is either coming from personal funds, or if they have run in a prior contested race it could be residual funds from that race. Remember, until they have an opponent they can’t do any fundraising (the Cherry rule)

1. The NJA lobby that every two years makes our community more unaffordable while rewarding themselves through PI-friendly legislation.

2. The ineffectual “ID Bar” that somehow can’t be bothered to cooperate and put up a reasonable opposition to #1.

3. Judges who don’t know the difference between a question of law and a question of fact.

4. Judges who do know the difference between questions of law and fact, but refuse to address questions of law anyway because they want to get re-elected and have sufficient funds in their campaign budget to do so.

5. Judges who don’t show up, don’t hold hearings, and issue vague and poorly worded minute orders through their clerks.

6. Notices of Entry of Order. What a monumental waste of time. You know what constitutes notice of a court’s order? Service of the order.

7. People who run for judge or JP three or four or five times and just don’t get the hint.

8. The RJ quoting legal filings and complaints verbatim without providing any context or understanding for what it means for laypeople, thereby needlessly confusing and enraging its readers.

9. The Law Blog making me think it doesn’t love me by blocking viewership from my cell phone IP address over the weekend.

Attorneys use #7 for name recognition and advertising, and ability to use donations to accomplish it. General public doesn’t think “hell, he’s run for judge so much but still lost, he must suck”

General public generally does not know who previously won and who lost. They pay attention at election time to (1) your position on the ballot; (2) your perceived gender relative to their preconceived notions of who would treat you nicer and (3) if they recognize your name.

Names are often more recognizable by people who run frequently and lose than people who run once and win. The difference is that the latter can put up signs using the title “Judge” while the former cannot.
