10:13/10:22 AM here. Rob won’t try to physically attack anyone when the conviction is read. He will wail, Old Testament style, may yell, may cry out. It will be a more dramatic version of what we saw when bail was denied.

There is absolutely no way Rob will admit to this murder, he will instead endlessly appeal his innocence for the next 10 – 15 years until SCOTUS finally denies his federal habeas cert petition. (of course then he’ll find “new evidence” and start again)

German in September 2022 wore a mask when outside his house in public. We saw that on the Roberto’s surveillance footage. Telles was interviewed by German many times. It’s not a stretch to infer that Telles suspected or knew German worked from home.

I’m sorry, it’s September 2, 2022, sunny and mostly clear, and between 10 a.m. and 2 p.m. in the daytime it was 96F to 104F. What was he wearing near his house, he claims? Not a lot of locals are out for a leisurely walk that late in the morning or midday just because.

He’s already made out of court statements in media interviews that could support defamation or business disparagement theories, but what’s the point? The house is encumbered, will go to banks or the wife alone (assuming they don’t stay married), and then reach equity beyond the homestead exemption. If he’s not judgment proof yet, he will be soon. That if Compass Realty wanted to stop Telles’ investigation, and was willing to kill someone to do that, why not just kill Telles instead of killing German to frame Telles for German’s murder.

The answer was epic (and I paraphrase) “Because I am so important that if they killed me someone else would have taken up my cause. This way I have lost credibility and no further investigation in Compass can or will happen.”

Civil guy here, can one of you crim guys explain how the communications between telles and his wife not be subject to spousal privilege? How does it get admitted into evidence?

There is no privilege protecting your texts with your wife so long as they are secured with a valid warrant. The spousal privilege just states that the state can’t force your wife to testify against. She can refuse a valid trial subpoena and refuse to appear at trial. Which is probably what happened here. The detective notes indicate she told them she didn’t know where her husband was when the murder happened. She did not confirm his story that he was on a walk.

I want to post at 7:59 that it will be a mistrial. On a lawyer blog we all know he is guilty. But I’ve been watching the trial with friends at night and a good third, non lawyers, don’t think he did it saying “there’s too many unanswered questions especially why not a lot of blood on shoes and hat”

I disagree that there is any chance of acquittal. ALL of the jury questions have been unfavorable for Rob.

True! I agree that it is likely most of us lawyers believe Telles is guilty. I socialized with non-lawyers this weekend who streamed the trial this week and they agree with the notion that, “there’s too many unanswered questions especially why not a lot of blood on shoes and hat.” Cross section of locals including hotel workers, realtors, teachers, therapists, and retirees. It only takes one to hang the jury.
