Yes, innocent until proven guilty. Sick of sensationalized journalism and political soundbites to evoke emotions until the investigation process is thoroughly completed. The evidence at the scene did not conclusively show him as "high." Later a "trace" was found. No one goes 75 mph on the highway. There should have been a car behind them to warn approaching vehicles of bicycles present on the highway. Isn't it safer to cycle in the emergency lane? Plus, it was very windy. High or not high, they assumed some risk and posed some risk to all motorists under the conditions.

1:09 – as the person above said – you are an insensitive prick and I'll add – entirely wrong about your facts. As 1:14 stated – there was a safety and gear car with the group. Those riders killed were experts and at the top of their game in their field. They were also in the emergency lane. The van hit the cyclists as well as the SAG car – totaling the SAG car. These are 5 locals who were killed – meaning – many of us knew them, or may know them or their families so to come onto this blog and attempt to spout information about the details which you clearly have incorrect – is ridiculous. Talk about the law and due process if you will. This driver will have his day in court. But to suggest fault or blame on these Class A humans – doing what they loved as safely as they can (a ride completed each year for over 15 years by the way) – is incorrect, insensitive and down right gross.

It's absolutely egregious that they released results of a drug test, which are plagued by problems and false positives, on someone who was not intoxicated enough for any of the officers at the scene to notice. If he was reckless than he should be punished, but going for blood because he got high a day or two earlier is absurd, and it isn't going to bring anyone back. Everyone would be better off if he remained free and able to pay restitution/civil judgments to the living victims and the families of the deceased.

FWIW, the article stated the blood test results showed the driver was nine times over the legal limit for meth. He probably fell asleep at the wheel in the middle of the day because he was coming down hard from all that meth in his system…there's a commercial policy in play here as well so the driver's ability to pay is not paramount…

Tom has had many problems over the years (such as the time that another lawyer had to step in at a criminal calendar call to announce that he checked himself into treatment). Story sounds like he threw the paralegal under the bus that the paralegal unilaterally forged a Judgment (which is not merely a RPC violation but has criminal elements to it also). Facts and testimony will come out but cannot believe he would not know that there was never a real judgment entered.

Almost all states ban bicycling on the highway because it is too dangerous. Nevada and Utah are exceptions. The safety risk is overwhelming due to the high speed of vehicles, presence of semitrailers and other heavy cargos on trucks, wind, weather, and the fact that highways are not designed for cyclist or pedestrian use. The preventative message here for others is don’t cycle where it is too risky to yourselves and to other motorists. In bike races there is a lead car and a follow car which contains the cyclists and warns other motorists of the hazard. Usually the escort vehicles have rotating flashing beacons too. How did these cyclists warn oncoming traffic that they were there, traveling slowly at least 50 mph under the posted speed limit? It was reported that they chose to travel behind their vehicle, to protect themselves from wind. They should have cycled in front of their escort vehicle so anyone approaching at a high speed could see the hazard and have reasonable time to react.

State lawmakers attended the memorial and spoke to the beauty that is Nevada and that markets to athletes who love outdoor sports and the need for more safety. Perhaps this is why it's not illegal to cycle where they were killed? These cyclists were not novices, they were skilled in their sport and they were doing what they loved when they were killed tragically- I would add, they were being healthy and not pounding drinks or gambling- in a city that boasts outdoor beauty and sports. People live in Nevada and Utah to take advantage of nature – we don't all live here to gamble. Go piss on someone else's grave.

While 2:31 may be posting in jest, the same people who believe Q'Anon or that Trump actually won the election might take the post as truth or a call to action. I've seen a number of posts on social media quoting the first paragraph of the Declaration of Independence inferring that the current government should be removed by force by people who clearly don't understand that our country has enacted a Constitution and system of laws since 1776. Our public education system has failed.

4:00–apologize for being picky, but it is the Declaration of Independence, not the Constitution, that was enacted in 1776.

The Constitution was drafted in 1787, ratified in 1788, and took effect in 1789. The Bill Of Rights(first ten Amendments)followed in 1791.

That(admittedly picky, micromanaging) correction being understood, that in no way is relevant in detracting from your excellent post.

But the same people who automatically believe and endlessly and aggressively repeat whatever extreme right-wing, or extreme left-wing, pap they are fed by their selected media outlet, are the first ones to answer a resounding "No" to survey questions such as "Are your beliefs influenced by what you see and read in the media?"

And after they answer a categorical "No", when they are asked how they then formulate their opinions, they answer something like "my own independent research." And the follow up will be something like "What does that research consist of" and they will answer "television and internet news coverage" or something like that.

Well, did it ever occur to them that they have just admitted that their beliefs are totally formed by the media, right after telling us the media has no effect on their beliefs? Apparently not.

Many people seem programmed, when asked if their beliefs are influenced by the media, to assume that to admit so would make them seem moronic and unduly pliable, naive and impressionable. They take great offense and the very notion, and usually add to their answer something like "I make up my own mind. No one tells me what to think"–which is quite defensive and ignorant. The most ignorant people, whose beliefs are totally dictated by some shrill and offensive media figure, are the ones who are the most offended when asked if the media influences their beliefs, and they are also the ones who readily profess how much they hate and distrust the media.

There was a survey testing how much people understood basic American legal concepts. People were asked if they heard the phrase "Innocent till proven Guilty." Everyone(or virtually had heard it, albeit probably from lame cop shows and law shows.

The next question was something like "To what extent do you understand it(Innocent Till Proven Guilty)" and 87% of respondents selected the "Extremely Well" category, which represented the highest degree of understanding of the choices presented(e.g. choices included "Understand it somewhat" all the way up to "understand it extremely well")

After the question abut how well people understand "Innocent till proven Guilty"(which apparently 87% of the thousands of those surveyed understood it "Extremely Well"), guess what the very next question was?

It was "Answer True or False. In a criminal trial in the United States, it is the responsibility of the accused to prove that they are not guilty of the offense they are charged with."

64% agreed with this statement. So, all one need do is to take the "Innocent Till Proven Guilty" concept and invert it slightly, and change the phraseology a bit, and it exposes that people understand next to nothing about the system.

But we already knew that when we see surveys that conclude that 96% of respondents answer that no form or plea bargaining, or any negotiated settlements, should ever occur in criminal cases."

Consider however that in 1775 (the start of the Revolutionary War) the British Crown had similar laws, treason was a hanging offense. The Declaration of Independence asserted, when speaking to he rights of people "[t]hat whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government".
Americans, and lawyers in particular, should not be afraid to speak out about wrongs and injustices.

I don't want to wade into the ongoing blog debate concerning the performance of Gov.Sisolak but…wait, I need to correct myself. It is not a "debate" as only one side is weighing in. He has been universally condemned, attacked and ridiculed on this blog, but no one has posted anything in his defense, as far as I can tell.

When Trump is attacked on this blog, or the election results are discussed on this blog, it generates numerous and very impassioned posts offered from both sides.

But no one has apparently come to Sisolak's defense despite the fact that a lot of democrats read, and weigh in on, this blog.

Does this mean that he has lost enormous support from his own party and those who voted for him? Or does it merely mean that the people who voted for him may still vote for him, but they will be tepid at best in their enthusiasm to do so, and were tepid when they first did so?

Could it be that he was primarily elected simply because he was the democratic nominee and it was a huge democrat turn out in Nevada in 2018?

Sometimes that is the dynamic in operation. A candidate has no particular appeal, and does not generate much enthusiasm, but they are the nominee of their party and such party votes in far greater numbers than the other party in a given election. After all, a lot of voters vote straight party line.

Nevada Governor is normally a pretty easy gig. The Legislature meets for 4 months every two years. Outside the these 8 months, most Nevada Governors have been able to kiss babies, attend ribbon cuttings and promote Nevada for the remaining 40 months of their 4 year term. Governor Sisolak has had to take on more than any other Nevada governor that I know of, which is having a negative impact on his popularity. He's likely more popular than Governor Gibbons was, and he didn't have to deal with a pandemic.

While that I believe that he’s made some missteps, our tourism based economy was going to take it on the chin no matter what Governor Sisolak did. I wish that he’d do more to open public schools. I would have left churches alone. Having worked with both of them at some level, I feel confident in saying that I’m, by orders of magnitude, more comfortable with Governor Sisolak in charge than Adam Laxalt.

Mark Hutchison does not want any part of this mess. And unfortunately the GOP bench is incredibly thin unless you draw someone out of industry. Cegavske is your lone GOP state officeholder. Amodei is not coming back to Nevada to run and could not garner enough support in the south to pose any real challenge. Furthermore (as you see below) those individuals are viewed as RINOs that would not get party support. You are left with Michelle Fiore and Adam Laxalt as your party standard bearers which will get you killed in 2 years.

For those of you, like me, who are geeky enough not to be bored beyond tears concerning a discussion of Nevada political history, here are our last several governors. What opinions do any of you have about their performance?

Sisolak(2019- ); Sandoval(2011-2018); Jim Gibbons(2007-2010); Kenny Guinn(1999-2006); Bob Miller(1989-1998); Richard Bryan(1983-1989); Bob List(1979-1982); Mike O'Callaghan(1971-1978); Paul Laxalt(1967-1970); Grant Sawyer(1959-1966).

Actually, that's more than "several" and most of us will have no memories of those ones more remote in time.

Richard Bryan was the very popular governor when I moved here, and presided over the state during a time of enormous(and mostly positive) growth,so I tend to have a fairly decent opinion of him and his tenure. He was a moderate democrat who worked well on both sides of the aisle.

The one who I was the least enthused by is the one whose tenure was dominated by his personal drama.

I'm too young to remember List or anyone before him, but the run from Bryan to Miller to Guinn was a good run. All three were fully-functioning adults.

Interesting that everyone talks about how only recently the state is getting californicated and going to hell in a handbasket. But it was three moderate democrat governors elected from 82 to 06. That's a long run of democrats.

Does the NV GOP's tendency to put up unelectable hardliners go back farther than I realize?

I lived and worked there from 1992-1998, so all Robert Miller's time. I do not have any particularized memories of him or his actions. As an attorney, I worked for the Supreme Court for part of that time, and private practice for the remainder. I do recall (and was peripherally involved) in the Supreme Court drama involving Judge Whitehead.

I mostly recall the incompetency of AG Frankie Sue Del Papa at the time, and some crappy work from many of the DAs, AGs and PDs. I particularly recall a case (you can find it if you try) where the PD filed an Anders/Sanchez brief (when an attorney does not believe there is merit to the appeal, but the criminal defendant has a right to appeal and a right to counsel, so the attorney has an ethical duty to his client to try, but also an ethical duty of honesty to the court to admit that em thinks em's arguments are unfounded,)

The appellant, in pro per, filed a brief citing a case (never mentioned by the PD) that demonstrated that under NV law (at the time) that he had been wrongfully convicted of two crimes, when one necessarily included the lesser crime, when that double dip is not allowed.

Winner to the jailhouse lawyer, right? Got one of the convictions knocked out, sentence reduced! So sorry,though. You are correct under the case you cite (which the PD missed), but that case was wrongly decided and it is overturned. Published opinion.

Mike O'Callaghan was beloved. I sat next to him on a plane decades after he retired and he recalled giving my brother a sports award when my brother was in high school. Amazing man

I was lucky enough as a young man to work for Mike O'Callaghan, long after his time as Governor. He was indeed a great man and a wonderful mentor. Intimidating as Hell, but a terrific human being.

"Boomer" could boom. Sometimes even in the wee hours. But he was the proverbial Irishman, tough exterior and heart of gold. The stories about him are legion and legendary. Nevada, indeed this nation, desperately needs a Mike O'Callaghan right now. But I don't think we will ever see anyone like him again. We were lucky to be alive at the same time he was on the planet.

The obsession with Sisolak is bizarre to me. Why aren't people acknowledging the complete failure of the federal govt to respond in any meaningful way? I see GOPers claiming victory for Operation Warpspeed with the Pfizer vaccine, but Pfizer didn't accept money from the US govt. The feds did nothing. trump has allowed hundreds of thousands of Americans to die, he has politicized basic public health matters that could have saved lives. The GOP controlled senate is so obsessed with doling out money to corporations and not working Americans, they refuse to pass a bill that isn't a welfare give away to their billionaire friends on K street. How is Sisolak supposed to handle this all on his own? We don't have individual fiefdoms in this country so idiots from South Dakota with its 60% infection rate can come into Nevada and there's nothing Sisolak can do about it. He's in an impossible situation. And if you think a republican would have done better, check out the death/infection rates in South Dakota and Florida. They're dropping like flies and they're so stupid they continue to deny basic science. Finally, this town runs on tourism. A pandemic was going to hit us hard no matter what. Sisolak could walk on water and we'd still take a hit under these conditions.

You're wrong. First – people from South Dakota don't come to Vegas. Trust me. Second – operation warpspeed is a complete success and if you could set aside your bias you'd see the facts. Trump removed the red tape so that Pfizer and others could get the job done. It's not about "accept money from the US gov." it was about allowing experts to do their damn job without the US gov getting in the way – which under Democratic leadership always happens. Democrats = government control and red tape.
Republicans = de-regulate the bullshit and let the people get their shit done.

Grow up. Give credit where credit is due. And Sisolak is a dip shit. He ruined this economy. It was his choice – not the feds. And it is NOT the White house in control of state assistance – it is congress so direct your vitriol to the House and Senate. Pelosi admitted – yes ADMITTED – she held up aid just becahse Trump was president and will now negotiate becuase there is a new president. You can pretend this isn't accurate or dance around it all day long – but the truth is – Congress is in control of the money, not the Prez. The Prez put together the best team of private and public sector individuals and cut the shit to let them get their job done. If Obama was still in office – or god forbid Hillary – we'd be another 2 years from a vaccine.
