There’s a separate 2nd Amendment challenge going on in fed court.

The Ballou case is wild. Nevada Supreme Court says defendant back to prison, and Ballou has effectively said no.

Yeah they didn’t mince words:

“The district court instead sought to do precisely what it lacked authority to do — reopen consideration of an issue specifically resolved by this court on appeal and seek new evidence, materially deviating from this court’s mandate…. The district court [Judge Ballou] manifestly abused its discretion by clearly erring in interpreting this court’s mandate, and it capriciously exercised its discretion by acting contrary to well established rules of law.”

I’m just a dumb franchisee chain GC but what happens when a judge refuses? Will police follow NSC? I’m confused.

No but the Nevada Supreme Court will ram judicial discipline proceedings through pretty quickly to remove the judge. And then LVPPA will contribute to all of their campaigns.

Having a judge who is too incompetent to run any civil cases is wild enough. Now, she simply refuses to apply the law in criminal cases running up taxpayer costs with appeals, judicial oversight, etc. I’m over her, boot her already.

Probably 80% of the posters here who have appeared in front of her have been rebuked at some point.

I got summoned from counsel table during trial to approach and be reprimanded once. Lesson learned.

She reminds me of a kindergarten teacher who has lost control of the classroom. If you feel like you have to be constantly reprimanding people, something isn’t working right.

The crazy thing is that I belive Kishner is really smart and generally understands the issues really well, but she repeatedly gets sidetracked on minor procedural issues. I was involved in a hearing where she wasted nearly 45 minutes grilling each attorney to see if and when they filed a Notice of Remote Appearance. The entire time she was complainting about how busy her calendar was and that she had a trial waiting to start. It was insanity.

She has wasted untold resources on this since the pandemic. On stuff like this, she comes off as a self-righteous bully, which is too bad because if you look past this, she is a great judge.

She doesn’t come across that way. That’s who she is. It’s time to take her off business court. She makes those cases more complicated than they already are by injecting her stupid procedural games into them.

I routinely attend the Business Court Bench/Bar and laugh each month at how Kishner is sort of off on her own. The other judges are collegial and friendly and she keeps up her stern schoolmarm demeanor.

Could someone answer this question, Joe Houston had multiple wives. I know he divorced his first wife to marry a younger woman. Where does Katharine (“Kelly”) fit in all of this? Was she the first wife or the third wife or another wife? Is she the mother of Dylan or a stepmother?
Thanks!!!

So she must be the second wife. When I met him in 1979 he was married and then divorced and married a younger woman. That must have been Katharine aka Kelly.

Ok this is weird. The child support case is with Karen Zorn for a child born during his current marriage to another woman with the same last name as his wife’s maiden name. To me, it looks like, he fathered a child with a relative of his wife, during his marriage. Wow!

As I look deeper into this, it looks like this is a child support order for his niece. He and Katherine Kelly (his wife) were the petitioners against Karen Zorn (possibly sister of wife) and Benjamin Elliot (father of niece who was also denying paternity).

This morning, April 20, 2024, the R-J is running a story about the info obtained from the Houston-Prince custody battle court file, which has been unsealed by Judge Bill Henderson. I’m sure there’s a lot of info in that file from the two plus year custody battle. My guess is that Dylan and Joe Houston will come across as jerks. I also think Judge Henderson will suffer as his decisions and demeanor in this nightmare case receive more scrutiny.

I know you have posters saying the types of emails Dylan sent Dennis and Ashley are normal but having practiced in family court for decades they were off the charts horrendous. I once told Hardcastle when he was on the bench a husband told his wife she looked like a beached whale and Hardcadtle told me never to repeat that mean quote again. How does one find Dylan’s texts par for the course ?

Respectfully disagree. 23+ years at family court and former clerk down there. Although exaggerating to say par for course it is not unusual. You cannot imagine the depths to which people sink.

Does this SCOTUS decision open the flood gates to sue the heck out of D.I.E. mandates? I might look into developing an employment discrimination practice.

Imagine writing your son a candid, heart felt letter, only to have it published, years later, on the front page of the R-J.

https://www.reviewjournal.com/crime/homicides/everyone-is-worried-about-you-mom-wrote-in-letter-to-son-dylan-houston-3037246/?utm_campaign=widget&utm_medium=topnews&utm_source=homepage&utm_term=%E2%80%98Everyone%20is%20worried%20about%20you%2C%E2%80%99%20mom%20wrote%20in%20letter%20to%20son%20Dylan%20Houston

I’m all for transparency, but there is an aura of “ick” with all this paraded out in public.
