The Nice List 2021

It’s not lost on us that there are few positive mentions of lawyers in the press. There are a lot of lawyers and firms out there who have done, and will continue to do, good things without getting any recognition for their efforts. Today’s post is dedicated to calling out people in our profession that are doing good things, or for pointing out what is working or even just to wax poetic about the things you like about being a lawyer in Las Vegas. Who made your nice list this year?

Bob Eglet's $25m to his law school is a nice place to start. That's real money, even for Eglet.

My thank you goes out to stand up friends of mine who are attorneys. You are a rarity. To name a few: Dave Squires, Eric Freeman, and Jason frierson. Good friends and good people. Thank you for being true friends to me through the years.

I am not discounting the people who are truly struggling through this year. With that said, this has been the best year that our firm has ever had. Revenues up. Clients up. Cannot find sufficient qualified staff. Things are really really good for us. Not a brag. Just gratitude.

I want to commend the nice people of the profession who I have encountered over the years. David Stephens is one of the nicest people that I have met in the law and a true gentleman. I am also thanking the people who have taken time to mentor me and other lawyers but am doing that in person. Be the type of lawyer who litigates hard but fair and who mentors those coming up behind you.

I will second your comments about David Stephens; I've been against him in several matters, and have always found him to be a good lawyer with a good demeanor. I wish more lawyers in the valley were like him.

Can I just ask a favor today? If someone is given a compliment here, please don't trash them. I am so tired of the cynicism and pessimism that I see in real life when a compliment is paid to someone not present and some dickhead interjects with a, "Well, actually…" or a "Really? He/she is an asshole…"

One of my worst fears is being referenced on this blog, even in a positive light for this reason. When my cases end up in the paper, I pray the article doesn't get posted here (it usually does) because of this. Nobody is impressed by constant negativity and cynicism.

For this reason, I am not going to name names, but let me tell you about the kinds of attorneys I appreciate.

I appreciate opposing counsel who are gracious with scheduling to accommodate my family's needs. I appreciate opposing counsel who can speak candidly and realistically about strengths and weaknesses so that we can work towards resolution, whether it be by settlement or trial. I appreciate the judges who work hard and read the briefs, who exercise control of their courtrooms without humiliating people and who show respect to both litigants and counsel. I appreciate attorneys who can socialize or have lunch and have interesting conversations with me about things other than law and law war stories. I appreciate my staff for helping me in a jam. I appreciate opposing counsel's staff for being friendly and helpful when coordinating things. I appreciate my runners for helping me out of jams when I'm filing and serving something in or near the 11th hour. I appreciate my clients who pay their bills in full and on time. I appreciate clients who express gratitude for me going the extra mile, it just motivates me even more.

So if you are one of these people, I wish I could name you by name, but you know who you are. Thanks for making this very unpleasant profession much more tolerable.

And I agree, Nick is a good guy, and a good lawyer.

The amazing thing about Nick (for me) is that when I first met and practiced against him he was with 2 attorneys who I consider(ed) 2 of the least professional, most difficult counsel against whom to practice.

There are comments above about mentoring young lawyers. Nick is a good example of someone who was mentored to be a great litigator while not picking up bad habits.

I'm grateful to every pro bono attorney that volunteers their time, giving a voice to tenants, children, victims of domestic violence, and consumers throughout Las Vegas. Too many to list here, but all heroes in the community!

A shout out to a bankruptcy trustee and its staff who helped out a non filing ex spouse from hurting him/herself by: (1) taking the time to talk to that person at length; (2) helping resolve such bankruptcy issue; and (3) helping that person get the mental health and other legal services they needed.

Shoutout to OC and their staff (and everyone else) who realizes that we're all just people trying to get through and treating everyone nicely, accomodating requests, etc. It makes the job a LOT better.

A special thank you to you bosses out there who have the emotional maturity to appreciate the challenges that life throws your employees. My firm went through a lot this year on the personal front between covid, family issues, etc. Our managing partner did a great job of recognizing that we are people with families and that sometimes that is the priority.

Despite all the things I've read on this blog, I've found Judge Peterson competent, fair, prepared, and willing to make tough decisions.

I also had a couple of cases with Joe Troiano this year and every time we spoke he was down to earth and realistic. No posturing, no insulting me or my client, nothing but competent advocacy maintained on reasonable grounds. Realistic appraisals of his cases and willing to concede things that need to be conceded and to work together to make sure the action goes forward in the right way against the proper parties.

Please tell the people you appreciate that you appreciate them! I've been trying to do more of that this year.

On one case I observed on virtual court before my own hearing, I saw an attorney go to bat for a pro bono client eloquently where others may have phoned it in. I emailed him to tell him the faith it gave me in the profession and it was a nice moment of connection even while we are all remote.
