The state eviction moratorium is currently set to end March 31, 2021, correct? What are landlord attorneys experiencing currently with eviction efforts? Thanks.
About half of my practice is consumer bankruptcy cases. We've had clients recently who were evicted for non-payment of rent. They filed the Legal Aid's Declaration (from: https://www.lacsn.org/declaration) but paragraph 2 requires them to declare that they had a "substantial loss of household income, loss of compensable hours of work or wages, lay-offs, or extraordinary out-of-pocket medical expenses, caused by the COVID-10 pandemic." Landlords/Agents/Eviction attorneys are filing motions to challenge the declaration and for the court to order the tenant to provide evidence supporting that declaration; including bank statements, termination notices, paystubs from their job for the past year, etc, to confirm whether they actually had a loss of household income/hours or terminated. If the tenant does not or cannot produce that, then the JP grants the eviction due to them not meeting the requirements of Nevada's eviction moratorium.
10:57 here. Thank you for the information. I sincerely appreciate it. This blog can be a very positive and productive use of time when we make it so. On the other hand, I do miss reports of BK Hottie and hope to learn her name someday.
I represent Landlords and Tenants. Candidly moratorium be damned to Hearing Master David Brown. If you are a Landlord, you could get evictions pretty easily even during the moratorium. If tenants appealed you knew you would lose on appeal 80% of the time when they were going to Scotti and Chuck Thompson/ 40% of the time once Crystal Eller took them over.
1:53–that's quite harsh in that you state it as an across-the-board remedy.
Allowing that you intended the remark with some degree of levity, there is still no blinking at the fact that "throw the bums out" should apply in many cases, and is well-deserved in such cases.
I have clients, as well as acquaintances, who truly were in need of the moratorium in that their income did in fact depreciate substantially during covid.
But for each of those meritorious cases, there were two cases where people exploited the moratorium even though their income had not depreciated to any meaningful degree.
Kind of the same concept in operation with the greatly enhanced unemployment benefits, stimulus checks, etc. Compensating someone in a generally proportionate manner to what they had previously been earning is quite understandable.
What is not understandable is all the people who were compensated at a far greater amount than they ever earned. That is unprecedented from a historical basis and, more importantly, who has the incentive to return to some shitty job when they, in certain cases, can be compensated in a far greater amount to merely stay home.
I feel bad saying all this as I am one of a dying bred-a liberal democrat, and that will certainly attract disdain form many readers of this blog.
But the far more important point is that I am far from alone and have heard so many other fellow liberal democrats bemoaning that we are busting are asses so able-bodied leeches can stay home and be handsomely compensate for not working.
A lot of these are healthy young people half my age, and their entitled, pampered attitude, as well as the government catering to and enabling such attitude, can be vomit-inducing.
End of rant. Thanks much for reading(or for skimming).
To 3:30. Conservatives have long recognized everything you said. Welcome to reality. Liberals live in a dream world. Sorry you were duped by liberal ideals for as long as you were. As 3:40 said, change your party affiliation. It certainly doesn't need to be R. But it shouldn't be D.
I understand what you're saying. Consider the issue from a logistics point of view, though. Carpet bombing an area with aid may result in some folks getting aid that didn't actually need it. But the alternative was believed to be much worse: taking so much time to precisely plan and carry out the surgical aid strike that the ones who needed it most couldn't benefit from it.
Compassion and long-term concern for national well-being prevailed over austerity. Time will tell whether that ended up being not enough or too much.
He's been disbarred. Jail time was perhaps a little heavy-handed given that he'd admitted fault and made restitution. How much actual jail time did he get? Is it real jail time or jail time suspended?
He was suspended in Nevada. However the suspension and terms of getting his license reinstated (e.g., take/pass bar exam, pass criminal background and character fitness) make it pretty unlikely that he would be able to practice in NV again.

Iron law of policing: if the cops are discouraged to do their jobs, they won't do their jobs. It is far easier to pull over a fat real estate broker in his SUV in Summerlin than chasing down drug addled, muscular felons. The ones who will suffer the most from an absence of policing are….yes, the poor, including the angelic minorities everyone claims to care about but not really.
If I was a cop, I would dial it down so much that I'd be useless. There is no upside to bravery or caring about your community. One video out of context, and you are torched for life. Heaven forbid you have the wrong skin color, then you are double torched. The AG is not your friend, he's your enemy. The AG doesn't care about reducing crime, he wants to criminalize policing.
I thank the fine officers of Metro for their excellent service to the community. Truly, you are heroes.
Who said "deference" in this thread? The issue is whether cops get due process and fair treatment. AG wants to make it a crime to do your job, so why bother?
LOLZ "very clearly implied" i.e., you read your own shit into it. I will take a guess: you practice family law?

Fire all cops who simply won't do the job, and also fire all the ones who don't do their jobs properly. Police are more than adequately compensated, and taxpayers (their employers) have every right to expect better.
Hey 208, If you can prove that a cop has killed a black man for target shooting, would you not want said cop to be charged and convicted for MURDER? I guess a black life just does not matter that much to you.

About Real Water: I heard they had moved their operation from Las Vegas to Mesa, Arizona. Address: Buckhorn Shopping Center, 6018 E Main St, Mesa, AZ 85268. The owner is Brent Jones.
The state eviction moratorium is currently set to end March 31, 2021, correct? What are landlord attorneys experiencing currently with eviction efforts? Thanks.
I did one eviction during the pandemic without issue. The individuals didn't fight it. Didn't send a declaration or anything.

Good. Throw the bums out.

3:30, when you are done vomiting take a few moments and change your party affiliation.
I will be one of the first to welcome you to the team.

Nelson Cohen was sentenced to jail today.
For what?
For stealing money from clients while employed at Bremer Whyte and for stealing money from another attorney in town.
And yet he has not been disbarred?!?
He's been disbarred. Jail time was perhaps a little heavy-handed given that he'd admitted fault and made restitution. How much actual jail time did he get? Is it real jail time or jail time suspended?
Only suspended for 5 years. Would have to retake the bar and MPRE.
90 days in CCDC starting today.
California did disbar him. The difference is that disbarment in California isn't permanent but in Nevada it is.
Right but he has not been disbarred in Nevada. He is only suspended in Nevada.
90 days for felony forgery and theft charges? Must have got one hell of a plea deal.
He was suspended in Nevada. However the suspension and terms of getting his license reinstated (e.g., take/pass bar exam, pass criminal background and character fitness) make it pretty unlikely that he would be able to practice in NV again.

"Give the police extreme deference or we won't be safe."
Hard pass.
Agree with 11:25. Police policy should be to go where crimes are being committed. Anything less is stupid.
Who said "deference" in this thread? The issue is whether cops get due process and fair treatment. AG wants to make it a crime to do your job, so why bother?
1159? You can read but you cant comprehend? The supposed deference is very clearly implied.
Conduct your life, to your best ability, to keep the police out of your life.
Fire all cops who like to kill black men for target shooting.
Hey 208, If you can prove that a cop has killed a black man for target shooting, would you not want said cop to be charged and convicted for MURDER? I guess a black life just does not matter that much to you.

Should the Nevada Bar take action against Brent Jones for his non-legal business practices?
Paola, why did you take down comments about Elisa Cafferata and DETR? Who defends DETR?
