I don't have a subscription to the LVRJ, so I haven't read the entire article. Right before it cuts off into paid subscription territory, the article says Gould "berated" a regent. I watched the video. I would in no way describe his conduct as berating. Berating, to me, implies the woman was weak and helpless. Given her conduct in speaking out and up for herself, she was anything but. Journalism today needs to feed sensationalism.

If I recall correctly, there is a clause in the Monorail agreement, that the monorail would have to pay for demolition of the track if it ever goes belly up. This agreement effectively gets them out of that obligation.

Anyone have any insight on why an LA big law firm attorney is necessary to investigate the Regents thing? Other than just providing extremely expensive cover for whatever the Board wants to do anyway. Seems like the facts are pretty clear and in public and the Board just needs to make a decision one way or the other.

This was surprising to me as well. The Board of Regents must not have any faith in Boyd graduates. There are plenty of decent employment attorneys in Nevada, including several Boyd graduates. Pretty stupid for a public entity to pay LA attorney rates at the same time that they are claiming poverty and drawing on emergency funds.

The attorney retained by the BOR, Apalla Chopra, is not licensed in Nevada. NSHE, are you stating that there are no Nevada licensed attorneys qualified to conduct the investigation? Heck, I am licensed in Nevada for 20+ years (which means I have paid a lot of fees to the State Bar and contributed to the local economy), do not reside in Nevada, and sight unseen will conduct your investigation for half of Chopra's hourly rate plus expenses. P.S. I am a cheap date. You probably wont get a steak dinner out of me every time I am in town, but then again, I will not bill you for a steak dinner every time I am in town either. Hit me up.

Totally unrelated. There are two pending formal complaints filed against judges Early and Potter with The State Commission on Judicial Discipline. Read the complaints! It is amazing how judges can act, if the allegations are true, knowing that a state commission is always watching and has the power to end your judicial career. WOW!

11:04 here. http://judicial.nv.gov/Discipline/Pending_Charges/SOC/. These cases typically take about a year with the filing of the complaint, answer, and contested hearing. If it is appealed, it will be longer. Yes it is code that I do not want to live next to judges.

I envision judicial discipline as addressing corruption and the like. These complaints and the others that have been made public lately are decorum, not corruption, issues. Is this an appropriate use of these state resources–essentially HR issues? It would be useful for folks to weigh in on these issues I think.

HR issues at best, and rather trivial – could have easily been handled in-house. I'm all for checks and balances but this is unnecessary overreach by the commission due to the administration's lack of internal leadership. Who's going to fix that?

I read the Early Complaint – that is real world failure to state a claim. I am certain most of the bar has worked for worse. She swore at law clerk – and it was so hostile that he had to stay in a state court clerkship for the period of 2015-18? You failed the goddamn bar and she kept you on and this is how you repay her? If swears hurt your feelings, please avoid all law firms in Las Vegas. I have even heard swears in the hallways of Hutchison & Steffen – the most righteous of all our firms. Sure no one should be subject to a hostile work environment – but this is low level shit that should have been addressed in house.

There is certainly corruption in our bar, there are folks prone to physical violence, and all the shit Steve Jones was up to.

Now for my disclaimer idiots won't believe: I am not judge Eerly and I don't know Judge Early I have had one case in front of Judge Early. She ruled against me on an issue that kind of screwed my client's leverage and hurt a settlement – but it was within the standard deviation and she at least understood the issue. She is certainly an above average judge on our bench. What the fuck have we become?

I don’t think it’s asking too much of a judge to keep a civil tongue in her head and to not act like a three year-old. But I’m not sure it’s a matter for judicial discipline. Common decency is not enforceable unfortunately.
