A few random thoughts after yesterday's comments about the LSC situation:

1. Best wishes to all involved, but especially to the staff and attorneys who didn't find a soft landing with FC. Here's wishing there are great opportunities out there for all of you very soon.

2. For those of us on solid ground with good firms, perhaps a little gratitude is warranted. A lot of complaining goes on here on this site about work conditions. But being a lawyer really isn't a bad way to earn a living. And for those of us lucky enough to be a part of a good organization, it's important to stop and reflect on our good fortune.

3. Perhaps some will lament that the decision makers at LSC got away with something. That may be true; but for those who were harmed by the process, the better path is to move on, work hard, and succeed elsewhere. Sitting around hating the bad actors helps no one.

4. It is likely that no one intended this to happen. But, as is human nature, those who had the opportunity to protect themselves did so. Forgiving selfishness is difficult, especially if one has been harmed by that selfishness. But forgiveness benefits its giver; while self-pity and resentment are counter-productive.

10:40 AM here – I am so not Hejmanowski. Not even close. Just a rat in a mid-sized firm wheel; albeit a firm that's run well, has a defined partnership track, and treats its staff employees with some respect.

If you're getting pink slipped at LSC, you're understandably upset and you may not like to hear it but 10:40 is right. I'm not saying it's impossible, but I would be shocked if its found there was any truly improper/illegal conduct. I'm sure LSC is using every available legal/procedural advantage, but there are some very knowledgable business lawyers among that group who spent decades working with exactly that sort of thing, and that's exactly what I would expect from a business that's folding for financial reasons.

No former employee of LSC is going to win a lawsuit against the firm.

That leaves two options: (1) sit on your ass, bitch about being a victim, and wish things were different, OR (2) turn the page and move on with your life.

Is there an issue with the LS&C closing that would invoke the legal requirements of 29 U.S.C. § 2101 et seq.? Have the LS&C layoffs been staggered sufficiently that there will be no 30-day time period when 50 or more employees have lost their jobs? (Shareholders would count as employees.) If the WARN Act is triggered, and LS&C failed to give 60 days warning of the "mass layoff" or "plant closing," as those terms are defined at 29 U.S.C. § 2101(a), then there COULD be a small amount of additional wages due to the laid off and terminated employees. I don't have enough information to know the answer to this question.

5:38 – I hope you're right since I wish the best for all of them, but how is that possible? There aren't that many jobs out there, so I would expect that many of them are going to be out of a job for a while or will have to try going out on their own. The word "all" is a very strong word to use. I suspect that there will be a lot of attorneys in some short-term trouble. But, again, I hope you are totally right here.

Following is the only email we have received from the "Great One". The email was sent to all of us, but was really meant for those attorneys that want staff to put gas in their car, get their car washed, run personal errands, etc.
"As we approach the termination of active business operations, please remember that our very hardworking staff members are very involved in taking care of Lionel Sawyer & Collins business. They simply do not have the time to help with personal issues. I know it seems like a small thing to say I only need a few minutes of his or her time, but when you multiply that seemingly minor inquiry by the number of personnel, it becomes overwhelming. Because there is so much to be done for LS&C, I have asked staff to politely decline requests that are not LS&C duties. Thank you for your understanding.

So very sorry you'll have to walk 50 feet down the hallway to pick up your own lunch from now on!

I was going to write a long blog about how much the staff and non-shareholders at LSC were wronged, how hurt and angry we are that our loyalty was misplaced, that we were out and out lied to, but then someone said to me, "Maybe just don’t say anything at all. Everyone knows we’re getting screwed. Maybe we should just start an LSC Support Group. Have the Jones Vargas people join." Made me laugh and realize that this is just a JOB! I'm going to be ok. As a "support staff" person myself, I find it very unprofessional for all the very negative comments being posted, such as the one above. I realize that it is very emotional for everyone at LS&C, and I do sympathize their situation. However, that is no excuse for all the comments being posted which have been distributed to employees by management. One must realize, after all, that they are still employed and as such, should be bound by their professionalism and confidentiality in which they owe to an employer. In addition, I find it interesting that these posts are being posted during working hours so those employees must have a lot of idle time. Interesting. I certainly don’t have time to post comments while I am working during the day. Oh, BTW, I am off of work today for the Holidays!

1.) Shut up. 2.) You're not support staff. You're not fooling anybody. 3.) Loyalty is a two-way street. You can't demand it from your staff when you don't show it to them yourself. What you're advocating for isn't loyalty, it's a form of suppression where you keep the people you consider beneath you in line by whining that their complaints that they've been screwed is sooooo rude and unclassy, while ignoring the greater wrongs committed by the people actually running the show. By shifting the attention the behavior of the complainers rather than the wrongdoers, you prevent the people responsible from ever being held accountable. and 4.) Shut up.

1.) Actually, I am a support staff individual–legal secretary. 2.) I am also a prior LS&C employee. 3.) I think you need to channel your anger into something more positive. 4.) I also think you are probably lucky LS&C has not terminated you already. 5.) You really give support staff a bad name–Shame on you. 6.) On a more positive note, I hope you have a Happy New Year, and I wish good things for you in your future endeavors.
