Feats of Strength

  • Law

  • As many of you have already observed, more information has been coming out about Lionel Sawyer & Collins and Fennemore Craig. A press release yesterday indicates less than half of the attorneys currently at LSC are making the jump to FC. Among those not going to FC are LSC’s current managing partner and most of LSC’s associates. No word yet on where Paul Hejmanowski and the 30+ other attorneys not going to FC will land. [Vegas Inc.]
  • Compelling Discovery blogger Michael P. Lowry and Kenneth R. Lund are moving up the ladder at Thorndal. [Press Release]
  • Now the Regents will get to decide how to respond to the NSHE plagiarism. [RJ]
  • Next year’s Nevada legislative session is already shaping up to be an interesting one with such topics as “bringing your dog to the bar” on the agenda. [RGJ]
  • Despite being ousted as Assembly majority leader and taxation chairwoman, Michele Fiore is still making headlines. [RJ]
  • Anyone know what is going on with replacing Bill Kephart in the Justice Court. Applications were due a couple of days ago, but we have yet to see anything on who applied….

Paul Hejmanowski is a LIAR!

Since my attorney just informed me I will not be going to FC with her, I don't feel the need to sit on this information any longer. The following was circulated amongst us secretaries shortly after the meeting on the 10th. In addition, all the temp employees are being let go today. Merry Christmas and Happy New Year!

I have noticed a trend amongst firms here in town, a trend I shall refer to as the "Surprise Screw." The concept of notice to employees is viewed as a weakness, yet they count on those same employees to give proper notice should they leave. They want the loyalty and give none back. This surprise screw is intended to benefit the top of the food chain, without a damn given for their employees and their holidays. Everyone one of those transfers made a list of enemies. Happy Holidays!

One can easily infer that the firm was deeply in debt. Looks like some creditors will also get hosed. The knuckleheads over at Bar Counsel will never be able to figure this one out.

@ 12:28 is half right — partners taking record breaking bonuses 2008 – 2013, while simultaneously refinancing even larger debt obligations to a date after the firm's intended dissolution. It wouldn't be hard for Bar Counsel to figure it out, as the information is plainly contained in LS&C business records. Roger Goodell did everything in his power to avoid seeing the Ray Rice videotape delivered to his office. My guess is Bar Counsel will do what it can to avoid seeing the criminal acts at LS&C.

As a former LSC employee I am sorry to hear what is going on over there and all I can say to whoever posted this is that I hope you land on your feet somewhere much better. This is a sucky thing that happened to you and everyone over there, because I know how hard you all work and how many of you were loyal long term employees, who deserved better.

I guess I'm not sure what the complaint is here? That they had the bad taste to go out of business during the holiday season? I have to think that at least SOME of the secretarial staff at LSC has been redundant for some time….if you're not going to FC it's either because they're already overloaded on secretarial staff, or LSC has more secretaries than they need to cover the ones that are moving. If the former, it's not their fault how many secretaries FC has, and if the latter, it sounds like they've kept people on when they had no need for them at a time they were hemorrhaging money. How are either of those evil?

Yeah, okay, they ran a law firm into the ground, but they're the last local firm not to adapt to the new market, not the first. Who's left that isn't PI? Alverson? Marquis? Is anything left of HKJ?

Yeah, it sucks. But I bet you despite all the bullshit positivism in their press releases that the managers of LSC are sick to their stomachs. Failure sucks.

Preach @ 4:55… I'm sorry @11:22 feels so wronged but I don't see anything new in this information she feels she couldn't sit on any longer. Anyone who reads this blog has known something bad has been going down at LSC for at least the past few months. Since there is only one female attorney transitioning to FC from Las Vegas, @11:22 don't seem to care much about her anonymity…

As an outsider, it seems like it is an awful time for everyone at LSC, support staff and attorneys. I don't think anyone would have wanted this to happen, especially around the holidays. The post says that LSC told support staff things were bad right after their shareholder meeting… What am I missing? Do the LSC people have so much pull at FC, where less than half the attorneys are going, to demand bringing their support staff with them? It just seems like a really hard situation all the way around and I'm hoping everyone at LSC can find something as soon as possible.

I thought I was the only one not seeing any earth shattering new news in the the post. Does it say anywhere that they necessarily did vote to file bankruptcy? Or is it just that it was being put on the table to keep options open? I would imagine most businesses shutting their doors for financial reasons would view BK as an option. Does anyone know if there's truth to the remark about record-breaking bonuses being paid 2008-2013? I wouldn't be surprised if, up until Bob Faiss' passing, many of those in power there were in denial that the firm was in a death spiral.

Does the landlord get to keep the furniture? It sounds like BK, so doesn't that mean that everything they actually own and is paid for, plus their A/R goes into a pot and the creditors (including the landlord) get to argue about it in BK court? (Not a lawyer.)

@ 5:23 I would not make any assumptions about who posted this agenda, there was no firm announcement at LSC about who was going to FC and who was not. This may have been posted by someone who assumed their attorney was going to FC and taking them and now their attorney is not going to FC or taking them. LSC's employees found out who was going to FC when the FC press release came out and not before. I know how it looks, but knowing the players I can say the obvious assumption is not the correct one. I think we should really know our facts before we start pointing fingers at who did things.

Why didn't Hemo keep his mouth shut after the Dec 10th LS&C vote to close the firm and terminate employees? Instead, he tells the press on 12/12 a final decision has not been made:

"[M]anaging partner Paul Hejmanowski said Lionel Sawyer is in a “state of transition". He said a number of attorneys will be working for different companies, but they will continue to serve their clients at Lionel Sawyer. Hejmanowski continued by saying a final decision in regards to the future of the law firm have not been made."

12:02 here. It must be going right over 4:59's head that Hemo's statements, on their face, are in contravention of applicable bar rules. He deceived the public regarding the firm's status asserting some sort of ongoing entity, despite his personal knowledge of the shareholder vote dissolving the firm and each and terminating all support staff and many associate positions. We could have a fun game identifying each violation of professional rules, civil and criminal violations. My money is on a grand total of 77. Maybe our blog's administrator can take a poll,

Are the remarks attributed to Hemanowski purportedly verbatim quotes? Or it it the reporter's interpretation of what he said? Either way, the statements attributed to him are rather vague, and as someone else remarked, it's possible those not going to FC could carry on in some form. I think it's too soon and there isn't enough information to conclude anyone violated bar rules and committed crimes. Whatever else you may think about Hemanowski, he's certainly not a stupid guy. I would calm down with potentially defamatory rhetoric until more facts are known.

Support staff have an overconfident esteem about their abilities. Any of the support staff are easily replaceable with younger, more willing paralegals/secretaries in a heartbeat. I prefer a young secretary/paralegal over a disgruntled one who won't listen to instructions because they have been doing it "this way" for 20 years.

That said, I do appreciate the competent paralegals and legal secretaries I've worked with in the past. Too bad those professionals are few and far between. The rest of you are bat shit crazy ticking time bombs.

Merry Christmas.

As a straight female who has no interest in sleeping with young paralegals, if my choice was between a paralegal with years of experience who was crotchety, know it all, often argumentative when asked to do work, and always blamed others for his/her own mistakes, I would choose an inexperienced person who is at least reasonably pleasant to be around, willing to learn, follows instructions, and admits mistakes without blaming others. Not saying all experienced paralegals are that way, and I have worked with some absolutely wonderful experienced paralegals . Just saying consider that there are other factors in choice of support staff besides opportunities for sex.

No doubt the situation sucks. However, I can't help but wonder, didn't employees see the writing on the wall? Couldn't they start looking for jobs sooner and be out by now? LSC has been having problems for a long time, and the whole legal community has been talking about those problems for at least a year. We all knew it was coming. So I just wonder, for those who stayed – why? Why didn't you start looking a year ago but waited for the ship to sink so you can sink with it? There were many signs (other than gossip) that this was going to happen. Large accounts receivables, non-paying clients, low billing rates, dead weight, and a top heavy structure, to name a few.

December 25, 2014 12:25 am

12:51 I worked there several years ago. I am not a particularly brilliant person but it was obvious to me even then where the firm was headed eventually because there was no one to fill the shoes of people like Sam, Bob Faiss, Sen. Bryan etc. They made people partner just because they did their time and they let people stick around who were not earning their keep (and I'm referring to partners, associates, and support staff). They also let at least one partner behave in a manner for many, many years that drove away promising associates (although on that one, most firms probably have the same issue). It seemed like the powers that be were in denial that it could happen to them. My self-preservation instincts are stronger than my loyalty.
