There was an attorney who appeared remotely in front of Judge Barisich this morning who needs to either (A) clean his bedroom; (B) learn how to blur his background; or (C) learn how to use a virtual background.

10:59 AM here. The subject attorney is not a Boyd grad. I thought counsel might actually be an eccentric pro se, so I ran the name through the bar directory. Confirmed attorney status. Didn’t go to Boyd.

it’s crazy that 3-4 years into the onset of remote appearances some people are still confused by how to professionally appear for one. I’m convinced that each firm would be behooved by having a ‘hearing room’ that is set up audio/visually for appearances to try to try to mimic what should be the austerity of a court appearance.

I did a 6th Circuit mandatory mediation two weeks ago, while waiting to board a plane at 630am at McCarran. This level of convenience is a blessing to the practice of law and knuckleheads that cant get their shit together to at least appear like they are trying are going to fuck it up for the rest of us.

I did a divorce settlement conference that, for some reason, the settlement judge set for remote via Bluejeans, this summer. The other attorney did the damn thing IN HIS CAR parked at the beach, on vacation with his family. You could see people walking through the parking lot with their surfboards. I was a bit jealous he was on vacation and I was at the office, but jeez – at least go back to the hotel. I had the exact same reaction – he needs to get his shit together or the judges are going to use examples such as his to explain why we need to go back to in-person.

So had a hearing in front of Judge Jessica Peterson yesterday. While I was in the Peanut Gallery, she ripped into counsel on a preceding matter for being on BlueJeans and said that the EJDC is going back to mandatory in-person appearances for substantive motions (which motions are substantive was not defined). Anyone hear anything about this?

I haven’t heard that, but I started doing exactly that about a year ago anyway.
