And Telles begins to unfold his master plan to secure his acquittal. Word is he’s told the DA the only deal he will take is manslaughter plea. That’s how confident he is in his plan.

In all seriousness, it looks like Telles’ plan is to (1) say he was framed; (2) deny that he had any motive; (3) suppress evidence for constitutional violations. It seems extremely unlikely to get traction, but crazier things have happened. If you’re looking at being in custody the rest of your life, you take your shot I guess.

I’ve said it all along, if that was premeditated first degree murder, planning was so incompetent that the only possible explanation is he was framed.

Telles’ best bet is to claim that it was self-defense. He had been doing yard work as a side gig in that area, and randomly ran into German. German started shouting and threatening Telles and approached Telles in a violent manner. Rob then simply defended himself against journalist who was ready to take not only Telles’ reputation, but also his life.

As a criminal defense attorney with 30 years’ of experience, I remain of the opinion that Telles’ best course of action is to make the trial about German. If you can demonize the victim, you have a chance. There will likely be at least a few jurors who already have a very low view of the media. Give them something to sink their teeth into by running German’s reputation into the ground, then hope for the best.

Good grief, that is dark. Would Draskovich be willing to do that? That’s not going to work. German is not just an abstraction, he is a martyr for the free press. In addition to being repugnant, this seems like an absolutely terrible strategy.

Bob would be willing to do that. Its a Kamikaze strategy that has very little chance of success and runs the risk of absolutely alienating the jury. There is no lane in which any juror is going to say murdering a journalist (or anyone else) is excusable because he said not nice things about you. Pick a horse: (1) I did not kill him or (2) I killed him because he was picking on me in the newspaper.

So under #2 you go into court and say the killing was justified because German wrote unflattering articles? Is this the attack? Or is the attack that JG was such a jerk that any number of people may have killed him? Doesn’t that conflict with the theory that the real estate company framed Telles? The “attack” isn’t very clear.

Well and “any number of people might have killed him” requires getting around who placed bloody clothes in Telles’s homes and injected German’s DNA under his fingernails.

Telles–We have not heard all of the State’s evidence. Isn’t there a grainy video which shows the struggle and the murder of German? Wasn’t Telles’s SUV seen and caught on camera in the area?

LD– Unless you intend to open a second thread, there was a comment that appeared completely non-political in assessing the United States Supreme Court arguments today in light of Article II, Article III and the 14th Amendment. More specifically it suggested that the Colorado attorney had a rough go of it with all nine justices. That was factual and not political. The comment appeared to be thwacked.

It is your blog. But it would seem that discussion of Supreme Court arguments that are not political but which substantively discuss the arguments and performance by the counsel would be fair fodder for a legal blog.

Thank you for your respectful response. I missed that post which is one of the disadvantages of a daily blog system which pushes down old topics and which does not allow a “pinned post”option. I have gotten lazy in just posting about today’s events today. My apologies. 3 of the 5 Defendants who remain in the juvenile justice system have pled guilty to the manslaughter charges. There is just such a wide chasm between manslaughter in the juvenile justice system and adult system.

My comment came off wrong. I was not meaning to suggest that there should not be disparate treatment of children than adults, merely to state that the difference between the Defendant who was 15.5 and the one who is 16 makes it an easy decision if you can get your client to settle in the juvenile justice system vs. those who were sent to adult court.

While the Dr. Jara reign appears to concluding as an abject disappointment, i have to think this is a really tough position to fill. Beyond the qualifications, it takes a certain type to have the appetite to deal with the political BS and the machinations of the school board and the dystopian hellscape that Board Meetings and public commentaries appear to be devolving into.
So while the public are going to have their eyeballs pop at the salary, there’s probably jobs in private academia/charter with very similar paychecks with much less responsibility and much less political rigmarole.

I’ve heard from teachers that the interim SI is even worse than Jara. And one of Jara’s demands as part of his termination was that the deputy SI would become the permanent SI, not just interim. Jara is trying to pull one over on Clark County. The dude already has a job lined up that he’s accepted still wants $1m termination package with all of his sick days paid out. He’s a con man and a grifter that’s moving on to the next district to plunder.

You can change the players, but the game doesn’t change for CCSD. It’s one of the worst run, least effective school districts in the country. Getting rid of Jara won’t do anything to change that. 1:15 PM also raises a serious issue. What qualified person, in their right mind, would take this job? It’s a guarantee that the tenure does not end well. Maybe if you’re in you’re late 50’s or early 60’s and you’re almost ready to retire, so the inevitable bad ending doesn’t matter. It pays like $400k right?

Yep, $400k. At this point, just break up the district into 4 separate districts and be done with it. The size of CCSD makes it so much more vulnerable to abuse and mismanagement.

Does anyone know a resource re: bar social and other events in one spot? Bench/bar meetings, section meetings, CLEs, Parties, etc? Is there an online resource that keeps a calendar of all these types of things?
