Well the suit against Dawson has now been filed by Randall Jones. If there truly is a history of ignored complaints about these boys, I would think this is the end of the school, yes? Prior ignored complaints and visceral anger the jury will feel mean punitives are guaranteed. The jury will likely want to push them out of business. The fact that the principal was a chaperone on the trip is so bad as well. And the victim had asked for protection from a chaperone on the trip pre-incident and they did nothing. I have to think verdict of over 9 figures is very very possible.
It is entirely possible, even common, to be a “good person” and be a really crappy parent. I suspect that is what is going on with most of the people who’s kids were involved in this. I have seen the type a hundred times. Think they are good people, very successful, send their kids to a fancy private school, only to discover that their kids are shitty people and they have no idea why. After all, they did everything “right.” Turns out they did very little right. I have clients like this. Come in for a structure and some estate planning. Excited to involved their kids, then I meet the kids…
All kids, not just rich, entitled kids (I know I’m painting with a broad brush) should learn that actions have consequences. With respect to this, sometimes life altering consequences. It is likely the parents will bear some civil responsibility for this.
Can’t sue the kids under cafe moda it will cause issues against the school, not to mention liability is limited against the kids. When you say kids, I am assuming you mean the parents since you can’t really sue kids.
You can sue the parents – and if the allegations in the complaint are true, you sue them for everything that was already done in the U.S., with what happened in CR as “context” for how harmful the other bullying acts were. Kemp Jones knows how to rile up a jury.
