I'm not going to pay the Evil Adelson Empire to read its propaganda online. But re: Graham. When this scandal first came to light, didn't the LDS church say that it would return the donations it had received from Graham that was, in reality, money he had stolen from clients? Did the LDS Church ever return that money?
The article lists $156k as being returned by the LDS Church and included in the assets listed in court filings, so I presume the Trustee got that money.
My T&E attorney friends have indicated there are other Grahams out there exploiting the elderly and no one gives a damn. Regrettable. Glad I don't practice in that field.
The reason Graham got caught is because he ran out of cash and the house of cards collapsed. If there were funds out there somewhere, he would have used it to keep his ponzi scheme going. It's fine that they are doing due diligence to find funds, but it is extremely unlikely to bear fruit. Didn't Graham also donate money to Colorado State University? Why aren't they returning funds like the Mormon Church did?
I heard Graham speak at a CLE and he was knowledgeable. He advertised heavily and I thought that he had a strong practice. I always thought there was more to the story, a sub-story if you will, that explained the reason for the crimes.
Graham had a failed restaurant in St. George during the Great Recession. It's my understanding that was where the snowball started. He dipped into client funds, always hoping to catch up and it just got away from him, to say the least.
Yeah…a sub-story…he was a criminal who stole a whole lot of money from people who depended on him. He didn't just do it to get by. He had a huge house and made generous donations to causes near and dear to him. He was a terrible person and the people he ripped off will never recover from the damage he inflicted.
If I'm not mistaken, Graham had been stealing client funds for 16 years before he was caught. I believe (an educated guess) that Graham may have invested heavily in real estate, possibly in Utah, before the housing bubble burst and he lost a fortune. Not going to say why I believe this but it could explain how he got into such a massive hole from which he couldn't dig his way out. I thought it was also strange that he lived in Fort Collins and would commute to Las Vegas nearly every week. It didn't sound like a sound business model.
Why does the State Bar or the Courts or whoever not audit these trustees? If there is supposed to be X dollars on hand but only Y is on hand, there's a problem. One might be tempted to think this is a part of the system, with everyone covering everyone else's tushies. Taking advantage of the frail, mentally challenged, and elderly is a moral wrong, no?
I never hire based on religion, but I do require all new hires to show me their lucky pajamas before they start. This is no time to mess around with bad juju.

I hear rumors that attorneys are getting vaccinated right now claiming to be under the "public safety/law enforcement" category. I have pre-existing conditions, and I guess I could try this too, but it feels wrong to me. I will wait my turn, especially where most older folks still haven't been vaccinated.
Tried different websites, you cannot get shit until the end of February. How are we in the dark about this? Some attorneys got there shots already, what about the rest of us?
Since I got covid for real, I'm just going to go ahead and skip the vaccine for now. According to the CDC, there have been 278k doses shipped to Nevada, and 116k doses administered. That puts us dead fucking last among the states for per-capita administration. At least we're beating out Guam and Micronesia.
The bar survey has no point that I can see. You need to make your own appointment. But lawyers are eligible in Clark County to be vaccinated right now if you can get in.
The Bar Survey was so it would look like the SBN was advocating for its members. It was successful in Arizona to get attorneys to jump the line so our BoG thought that this would be a good PR move It failed.
Collective bargaining in the midst of this crisis? Ask any labor lawyer what that means for Nevada. This state is dead-set on becoming a poorer version of California.
Off Topic – Petition for Judicial Review
Does anyone have insight into which judge(s) is/are being assigned petitions for judicial review regarding the County Recorder's actions? Is there an intermediate step or level that might resolve a filing rejection and avoid the DC filing?

Every time we telephone someone in Audit at the Recorder's office we get a different answer. We comply with the information received and the recording is again rejected. Telephone audit again, rinse and repeat. This has happened on more than one file.

I agree with the above poster, hire on merits and experience. Not on religion.
That depends. LDS and Jewish fraudsters are so common it's a stereotype. A solid Baptist or Muslim trustee would be a safer bet, all things equal.

SBN sent a survey out for member attorney's and staff to sign up for vax. I completed the survey but have not heard anything from SBN or SNHD since.
I know numerous attorneys that have received a vaccination. Attorneys qualify under the Frontline Community Support category.
