Happy Eighth Birthday!

Over the weekend, this little blog turned eight! The photo below is from when we celebrated the blog’s first birthday. This post is number 1,687 and we’ve racked up over 4.2 million page views, a fact made all the more impressive if you believe there are only the same 5 people commenting on each post. When you look back at that first birthday post, you can see not much has changed. We’re still talking about the ridiculousness of the Legal Elite list, judges are still in trouble, the HOA scandal is still popping up every now and then, and the Shark Pimp still comments from time to time. We still don’t have much to blog about (in case you haven’t noticed), but we still do our best to cover the relevant Las Vegas legal news, rumors, gossip, etc., as it happens.  Thanks, everyone, for reading, commenting, providing tips, and also for the occasional words of encouragement!

First being first. The story about traffic offenses and being jailed for such offenses. Are we sure that people are being jailed for just committing traffic offenses? Or is there more to the story? Perhaps we are dealing with individuals who are chronic traffic violators and who have active warrants and/or have a history of not appearing for court when given a citation by an officer.

I regularly practice in Las Vegas Municipal Court. People are routinely jailed for traffic offenses (multiple offenses, prior or existing warrants or other factors from the stop) including warrants for failure to appear. In my experience, people post the bond (including per case bond fees between $50 and $75 dollars each) in order to get out of custody. People then face additional and escalating bench warrant fees. It is an endless cycle which seems to impact people who have the least amount of resources. While I applaud the fact some of the charged fees go to programs, like specialty courts, that benefit the community I do not in any way support the criminalization of traffic offenses.

Not exactly correct and almost BS. Jail in most cases is avoidable. The most common situation is that there are already multiple bench warrants for ignored multiple prior offenses when the offender is stopped or interviewed. Bench warrants also issue when a defendant pleas or stipulates and later violates the terms of a stip and stay. Payment plans are liberally granted with a minimum payment of $100/mo, but can go much lower based on financial assessment. If there is a missed payment (remember the defendant has already plead and may have entered into a stip) a BW will issue, but all a defendant has to do to avoid the BW and associated fee is to appear and ask for more time or an adjustment in their payment plan (for gosh sakes its easy – they can put themselves on calendar when they get to the RJC)

Lets not forget the 100's, if not 1000's of bench warrants issued by the child support court for failure to pay child support.

Scam Alert

Got a call out of the blue on business line about some company wanting to work with my office (on a rush job) about "holding" 3.5 million USD in escrow for some company that was to "loan" this money to an entertainment figure, in 1.1 million USD disbursements (not sure how that adds up?).

Asked for them to send email with more info; no email was sent.

This sounds like one of these scams where they have you deposit some type of funds and then immediately send off some of that "money" to a 3rd party, only to have the "funds" document turn out to be a fraudulent one.

I get a phishing scam about once every 2 days. I used to be bored enough that I enjoyed splashing around with them a little bit and seeing how far they would go, getting the fraudulent check and then having the real bank flag it for fraud. But I do not have time for that any longer.

The Bar has no jurisdiction over paralegals. So it's criminal charges or injunctive relief.
