Friday Open Thread – Vacations!

Happy Friday, everyone!  Forgive me for not posting more this week, but I’ve been extremely busy catching savage rays and trying to get rid of my embarrassing tan lines.  And speaking of holidays, where’s everyone else traveling to, if anywhere, this summer?  How long can you get away?  Does your boss make you feel guilty for leaving?  How often do you check your email?  Do you bring work?  Does your significant other allow you to work while you’re on vacation?

What else is going on out there?

The key to my vacations: whether or not this is true, I indicate that I am off to a remote part of a western state that has "limited cell phone service." It is hard, but then I put away the smartphone.

Going to Wisconsin for two weeks! I will be completely out of contact with the world of work. As I have 225 vacation hours in the bank, I am in a use it or lose it situation (again) this year. The office will continue to survive without me. Isn't that what summer law clerks are for?

I saw that article. I can't imagine the justice court administration or clerk's office could get any worse but apparently we should be preparing for the courtpocalypse. (that's a word, right?) They've been taking five to seven calendar days to process e-filings for the past three weeks.

My friend who does landlord tenant work said it was a huge problem in her office because in eviction cases once you get an eviction order from the constable posted on your door, you only have twenty-four hours (usually a lot less) to file a Motion to Stay. But since the court takes five business days to even register the Motion to Stay as filed, people are getting locked out our their houses even though they've filed a valid Motion to Stay. It's ridiculous.

The Justice Court Clerk's Office is an absolute NIGHTMARE. We had an issue recently where the JC Clerk's Office refused to file an Answer because they do not understand the difference between the date that a pleading is signed and the date that a pleading is served. We asked to speak with a Supervisor (thinking that certainly this was just an untrained desk clerk). No the Supervisor agreed, saying that the date that a pleading is signed is the same as the date it is served for Justice Court purposes.

I don't think they have the authority to reject a pleading for that reason. I think there's a court case, Lippis vs. Something, that basically states that the clerk's job is to shut up and accept the pleadings and it's up to the judge whether it gets rejected.

Heard Levinson was ordered to pay about 90K in BK Court and lost his appeal on a sanction issue … anyone hear anything

@2:04– You are 100% correct that Clerks perform ministerial functions and are not supposed to do anything other than stamp and file pleadings. However this has been an endemic (if not systemic)problem with the Las Vegas Justice Court Clerk's office. And the sad thing in the LL/Tenant area is that most of the Tenants dont know the law and that they are being denied due process.

I figured the big regional firms and the old guard firms would come up first.

While I respect MAC, I would not go to work there for the following reason: the people. I can honestly say of the "major commercial law firms" (which was the criteria) they are not a practice that has members that makes me go "Wow! I think it would be great to practice with ______". The lunches are nice but I would prefer to practice law with people around me who I like.

anyone know what firm is the "Rapidly growing boutique law firm" looking for HOA general counsel associate.

Why don't they just put their firm name on the post. I'm sure many people don't send resumes because it is a blind ad.

Rule of thumb when it comes to Craiglist. If they don't identify themselves, flag 'em. If they don't give you a salary range, flag 'em. If they don't provide contact information, flag 'em. If they tell you to send them your resume and salary requirements without providing any information, flag 'em.

These are fake job listings. Which, incidentally, violate CL's Terms of Use. Flag 'em and get them off CL. Or send your resume and salary requirements to some punk researching the market.

Just to set the record straight – MAC does have a few respectable shareholders & a handful of bright associates. The rest are egomaniacs & tools, in no particular order.

The chef is legit & the kegarator is handy – BUT- the pay is most certainly NOT commensurate with comparable firms, nor with what they expect from their associates. The bonus is also quite difficult to crack into, with the way it's structured. I write from experience.

Wow, I must be really out of it. When did MAC become a top tier firm in Nevada?

I have always thought of them as second or third rate. I know that they have a fancy building, but so does Alverson Taylor.

Even if such an ad is legitimate, which it might very well be, a potential attorney candidate is entrusting the confidentiality of his or her search to a phantom. In a legal community that is essentially a very small town, that's not always a wise choice. Especially since many of those ads may be initially screened by a non-attorney who may not feel the same obligation to keep such information sub rosa, so to speak.

This is one reason why many commercial law firms will not bother with an advertisement since they're for the most part aware of the poor results due to the understandable reluctance of good candidates to respond to them.

I saw all of these opinions that first offense DUIs will get no disciplines (other than the public humiliation of the Orders listing all of your traffic offenses with the DUI).

Alverson Taylor has quite a reputation for having a revolving door–and that includes its associates.
