Some interesting things going on on Twitter, a reporter called out an article by a daughter of a prominent Vegas legal figure about her marijuana use and now they are going back and forth about it. Search @DanaGentryLV and scroll through the last day or so.
Wow! I'm kind of on the side of Dana Gentry on this one. It's illegal to smoke MJ at hotels; it's illegal to transport MJ across state lines; and it's illegal to smoke in public. Why wouldn't this be a case to prosecute using her statements she made against her interest in public?
This is a dumb controversy.
Dana Gentry is a hack who does not even investigate stories very well. She published the story about the "kidnapping" of that woman earlier this year allegedly by the Christian radio host that turned out was a fake kidnapping by the woman's husband. Dana bought hook line and sinker. She is one of the main reasons why the Current could have been a balanced source of news and instead is a rag.
I don't know. The daughter posts on social media about her father a TON, including a post about her father winning re-election that was in incredibly bad taste, at the same time that she advocates and demonstrates public consumption of marijuana in California, which is absolutely illegal. According to Instagram, she is a self-professed public figure. Her father certainly is a public figure. I have been waiting for a long time for somebody to connect these dots. This seems like news.

ive always thought the wolfson daughters were a lil too much into themselves. not sure why they act like their shiz dont stink. being kids to two of vegas's bigger legal names is cool and all, but doesnt mean youre THAT cool…

To be fair, she did break a ton of anti-public consumption laws. And states that she has smoked in front of her parents. It's not like Steve has been at the forefront of any movement to commute or expunge possession convictions.

after quickly perusing the article, it seems like a lot of her day revolves around weed. if i were her parents i would be a little disappointed, that despire all the success and support the family can provide, she chose a life of smoking an designing memes…what a fulfilling life. and her smiles look like shes struggling to stay awake. i wonder if she had a rough upbringing compared to her sister who is an attorney in town. why does one smoke so much while the other doesnt?

I've seen a number of her social media posts and was wondering how long it would take to result in backlash for her parents. I don't care who smokes weed or how much, but I haven't found it all that funny in terms of being her "brand." Get over yourself and go get a real job at some point. That said, I don't hold parents responsible for the behavior of a 30(ish) year-old grownup.

Re stealing from trust accounts: the Bar's previous actions in so many cases, of outright – yes, I'll say it, lying in these matters undermines the impact when there are legitimate cases. DID this attorney steal? I have no idea but I cannot trust the Bar to tell me. I know someone who works there and if even 1/4 of what I am told is true, it paints a disturbing picture.
The OBC on these cases is a sham. The problem is that they treat an IOLTA account out of balance the same as they treat an attorney disappearing with $600,000. They treat attorneys who commit picayeune violations with no victims worse than they treat attorneys who steal money. But this is the Hardesty world that we live in.

I really don't get the constant complaining about this on this board. In the other state in which I have practiced, an IOLTA discrepancy is automatic disbarment. Period. As far as I understand this is how most state bars work, and Nevada is one of the most lenient with trust account issues.
I have never worked directly with an IOLTA account. Are there scenarios where an IOLTA account could be out of balance of innocent or innocuous things? If discovered and fixed, I don't know that I agree disbarment is appropriate, especially if nobody is harmed. But yeah, when an attorney knowingly converts client funds, that's game over IMO.
Describe "discrepancy." If I've just opened an IOLTA account, have no client funds in there, but against my specific directions the bank takes money out to pay for a book of checks (thus putting it in the red), is that an automatic disbarment in one of your other states? If I learn immediately after the fact that my office manager has stolen a check, forged my signature, and cooked the trust account books, am I disbarred if I self-report and repay the funds from my own pocket?

I am a member of the Bar in 5 states. In exactly ZERO of them is an IOLTA discrepancy an automatic disbarment. ZERO. 11:37 is out of his or her mind. Nevada is actually one of the most draconian when it comes to accounting cases because they compensate for lack of speed (or understanding of accounting) with harshness. It truly is as if we don't know what we are doing so we are going to do it doubly hard.

Sacramento County Courthouse Strike
Due to wage disputes, the Sacramento County Court Clerks are currently on strike. Per the courts this strike may take a few days to resolve.
The following courts are being affected:
Sacramento Gordon D Schaber Courthouse (Downtown), is currently open but may close early.
Sacramento Hall of Justice (Departments 53 & 54) is closed but they are taking all filings as drop box.
Sacramento Unlawful Detainer Courthouse (301 Bicentennial) is closed but they are taking filings as drop box.
Sacramento Family Law & Probate Courthouse (3341 Power Inn Rd.) Is still open but very short staffed. The clerks there have stated that they may have delays of over 8 hours and may not get to any filing brought over the window today.
Updates will be provided as we learn more.

As to the Court Of Appeals vacancy, I agree with those who say Judge Jerry Wiese would be an excellent choice.
Also, although this will be an unpopular opinion among attorneys who do not practice Family Law, the two Family Court judges who applied should be considered viable as a huge percentage of the cases heard by our COA are in the Family Law arena. First off, a huge percentage of the appeals are Family Law cases, and a huge percentage of these are "pushed down" to the COA. Thus the COA handles even more Family Law appeals than the NSC.
As for Commissioner Bulla, some posters suggest she would be a disaster, and their main basis for this positon is that she has a less than sterling demeanor(yes, that's admittedly a dramatic understatement). However, I don't think there is much doubt that she possesses the legal acumen for the position in question. Also, demeanor concerns, if she ascends to the COA, are at lot less important than they are down in the trenches where she currently serves.
As for John Hunt, some view him as an incessant self-promoter, while others firmly believe in his legal and intellectual acumen.
Concerning the rest of the list, some of them may be sufficiently knowledgeable and sufficiently capable to be appointed, but bluntly, they seem to lack the juice, or the name recognition or reputation, to merit serious consideration. At least that's how it seems to me.
