I like the RJ’s headline: “Real Water to pay $3B in lawsuit…” This will never happen – but hopefully the plaintiffs get something. I haven’t followed this much, but how has Real Water not filed for bankruptcy?
REAL WATER, INC. filed a 7 chapter bankruptcy in the District of Nevada bankruptcy court on August 19, 2021. This is a voluntary filing; it was assigned the bankruptcy case number #21-14101. The bankruptcy petition for REAL WATER, INC. showed assets in the range of $1MM – $10MM with liabilities in the range of $1MM – $10MM.

Totally defunct. Little to no insurance left. They are getting judgments to lean on the other defendants to set bellweathers for higher numbers
As to the size of the verdict, good. Companies that poison their consumers when providing a substance essential for human life should receive a corporate death penalty. The Department of Justice apparently did little more than ban the executives from being in the business of water sales going forward, so I very much hope that local prosecutors are considering pressing charges against the executives at the helm of this enterprise and confiscate the assets those executives surely hoarded from this scheme through a civil forfeiture proceeding. No one should care how “sorry” any of these people claim to be after they were caught selling water which ended up containing the equivalent of rocket fuel.
Downstream, Real Water was sold largely at Whole Foods and Costco. Even though Real Water has fled into bankruptcy to avoid a judgement, anyone have an opinion on whether these deeper-pocketed entities can be liable as well? There has been some traction on this front in opioid litigation vis a vis pill distributors like Walgreen’s and CVS, and I understand some chemical-testing companies have already been sued alongside real water. I wonder how transferable those judgements would be to the seller of the product.
Seems like there would be at the least a breach of implied warranty claim against any retailer. Possible they reached confidential settlements early on.
I don’t do products liability but I thought you could sue any link in the distribution chain?
All these places paid millions. The last case Costco paid and before that Terribles. Real water only has $10 million in coverage, but other defendants paid way more than that. Nevada has strong product liability laws.
There is a huge difference between pharmacies that made huge money by ignoring concerning consumer patterns and retailers who just carried a product for a bit.
I believe one of the other target defendants has also filed recently. Real Water probably didn’t have much but a $1m or so policy to begin with, so they pursued the companies that made the testing/monitoring equipment. Lots of issues on appeal I am assuming.
So-called “Real Water” was sold all over town a decade ago. It wasn’t just Costco and Walgreens. They were in every gas station and grocery store. I don’t think I ever purchased a bottle, but I probably did drink one or two free ones. I met Brent Jones, the CEO, a couple of times at social events. Odd guy. I even attended a couple of fundraisers at his home (not for him). You may recall that he was a member of the Assembly for a little while (2 or 4 years?). The whole thing, from start to finish, is another footnote in the book of Only-In-Vegas-Spectacles.
speaking of deep pockets, did you guys hear about Adrian Karimi’s class action settlement against Audi? We got notices of the settlement from the TPA few months ago, didn’t know Adrian was behind it.

Steve Hill seems like a fairly smart guy, but he sure hung himself and the Aces with his public statements about the sponsorship deal. All these years of being able to dump truckloads of public money to sports teams must have made him think he could do and say whatever he wants, with impunity. He screwed the pooch big time here, though, and served up the evidence to the WNBA on a silver platter with his arrogance. He deserves to be fired.
