I have a feralegal emailing me on behalf of their client, an opposing party. The feralegal already screwed this case up. Who do I turn the feralegal into? Not the bar, right? Is there a specific person at the DA that handles feralegals and UPL?

Nope. Refer it to the SBN (they have a UPL Link where you can file your Complaint). They don't prosecute but they will investigate.

Why can't a paralegal email opposing counsel under the direction of the attorney? What specifically is the paralegal doing that is practicing law?

Winder's business seems to be built around hiring disbarred lawyers and employing them as paralegals while they work on getting their licenses back. I know a guy named Weinstock worked on things there. There were two other guys too. One was a former patent lawyer. The other would call and argue cases, and would be really coy about what his role was on cases, and even though emails would come from him, he would write Dan Winder in the signature line. It was absurd.

Weinstock is licensed as an attorney but must work under the tutelage of another attorney. Very strange but he was a well known lawyer. Don't know what happened. This is why it is so important that we have a real bar exam that scrutinizes these jokers that want to come here and hang out a shingle. If they make the exam easy for every failure in California, we will all be dealing with this problem times ten. Eventually character and fitness and bar counsel will be overwhelmed and completely unable to supervise and remove these jokers. There are so many "fly by night law schools" in California that have no admission standards. Some of these people are capable of passing the bar exam. There is an attack on the California Bar exam to make it way easier also. This will adversely affect us here in Nevada. I am sorry to say this but it has been my experience when you get failures who eventually pass you get problems. I can cite numerous examples but it seems that marginal personalities have problems with the bar exam. If you let those jokers in they become problems later.

Take it up with the judge in the case. If SBN won't do anything, the judge can, even if only in that one case, and it will make the issue look more serious to the DA if a judge does something about it. The judge might even refer it to the DA.

They pick one case every 3-5 years and do something with it. They like either (1) paralegal claims to be an attorney; (2) paralegal overruns attorneys' office and runs it as his own or (3) paralegal forges attorneys' name.
