I have a Civ Pro question that i probably haven’t looked at since Law School. My client is an out of state corporation of course doing business here. Plaintiff happens to be from the same state as the client’s principal point of business.
Cause of action injury occurred here.
Plaintiff’s policy is from that home state.
I would presume that complete diversity does NOT exist anymore, and I was thinking of filing a forum non conveniens. I have filed them in Federal Court for some really specific issues, but has anyone done one in State Court in the last couple of years? In school it always felt like more of a curious intellectual idea but this is the first time in years seeing one that might actually apply in ‘real life.’
you didnt mention where the action is filed. i am presuming here. if here, the venue is proper. if where both parties are from, it can still continue, unless defendant argues venue should be in vegas since the underlying facts occurred in vegas.
You want to file a FNC to get the case transferred to where the company is based? Seems like a longshot to me. The evidence is in NV, and the court has personal jurisdiction over the defendant in NV (since it was doing business there and the claim arose from those contacts). Plus the plaintiff’s choice of forum is usually respected.
Have to beat the mid boss before you cant fight the last boss and JD currently is at 1-0 on Popes. I also wouldn’t be so quick to declare the Catholic Church, especially out of Chicago a force for good after their history covering up abuse of children.
There is no non-government institution in the world that does more good for humanity than the Catholic Church. It’s not even close. We can call for justice for victims, extend care and empathy to them AND celebrate the tremendous good the Catholic Church does. We don’t need to diminish the good people doing good things to combat the bad people doing bad things. Pope Leo XIV will be a force for good in the world. You can be a stick in the mud about that or you can add your voice, your kindness and your love to his.

I don’t care for Mr. Vance, but I don’t agree that he has anything but a favorable future. There’s a slim chance that he becomes President. A long shot, for sure. But Michele Fiore is a jurist. Anything is possible. There’s a greater chance that, after his time as VP, he spends the rest of his life in the conservative media universe making shit tons of money as a Fox News personality, “authoring” books (ghost writers), etc. He’ll make millions in this space doing a modern day version of Jefferson Davis romanticizing the “Lost Cause.” There’s nothing bad coming for JD Vance.
Karma is coming for JD and the rest of the cult. And a special circle in hell is reserved for all of them. I was wrong about “soon enough” though. It can’t come soon enough.
