Their clients were absolutely on board with their every step. However they may not have been told that they could get hit with CCSD fees and costs. People have this presumption that they can take a free shot at government agencies. That is not how it works.
Pretty sure that the fees and costs part is what 11:11 meant by "on board".
Unless Chattah and Gilbert made a deal in advance that they would cover the fees and costs (or their clients are the type of people for whom that kind of money isn't a big deal), those clients are likely not too happy right now.
I serve as a mediator. I can't tell you how many times that parties are unaware that if they lose their case they have to pay the fees and costs to the opposing side. And this includes insurance adjusters who are more experienced with the legal system. That being said it does seem unfair and harsh to impose fees and costs upon parents who are seeking to challenge a mask mandate. How ridiculous is it to make kids wear masks in school. While I don't agree with the judge's decision, I hope the Judge will have some common sense and not stick it to the parents. I have never heard of fees and costs being imposed to the losing party in an environmental lawsuit challenging government action. This is not a lawsuit involving money damages but questioning the wisdom of a mask mandate. It just shows how ridiculous the tax payer funded school district is in seeking attorney's fees and costs against parents who are captive in the public education system.
4:43 you just said matter-of-factly this is how the system works and implied people should know the risks of losing, then you go on to say how "harsh" and "unfair" those risks are in this case seemingly just because you agree with the losing side. Whether they were seeking money or not, the losers cost the school district a bunch of money in attorneys' fees with their losing argument.
Agree with 4:43 and have to ask 6:36 AM and 10:33 AM–let's think like lawyers. What is the legal basis for attorneys fees to the CCSD in that federal case- is it Rule 11? What are the legal standards? My goodness, we have to start thinking like lawyers and appplying the law. In state court for money damages the basis for fees is NRCP 68. No OJ in school district case.
11:25 your condescension is misplaced. 4:43 said nothing about the procedural or substantive basis or lack thereof for any attorneys fee award. Rather, 4:43 said that a fee award in this case would be unfair and harsh for reasons such as that the lawsuit was not seeking money and because 4:43 happened to agree with the losing side. Let's start thinking like lawyers, shall we?

It couldn't possibly be because she succeeded on the merits. Or maybe that the AG handling the case didn't do a good job. You seem to need to get a grip on reality if you think the Ninth circuit is pro Trump.
Anyone point me towards a case where a party successfully mounted an objection to a petition to set aside an estate? I would like to review the docket. Thank you.
We just did one and had to show value of the assets to be over the Set Aside limit. If you run a LEXIS search you can see the Decision in which Sturman denied the motion and pretty much said she was letting the Petitioner determine what the Petitioner thought it was worth.

Rant. I hate Family Law. Your wife cheats – it's my fault. Judge sets trial out 5 months – it's my fault. There's a Filing Fee – it's my fault. I have a thousand stories – after a Judge said meth or your children, one client said "I can't have my children that's my choice." A PREGNANT litigant once tested positive for LSD – motherf***ing LSD – and it was my fault Pomrenze gave her supervised. I could go on but I hate Family Law – I promise I'm getting out. Also, I f***ing hate probably 25% of the FL Bar who are money-grubbing MFers who don't give a shit about their clients. F*** em all.
I was forced to dabble in FL early in my career, for the firm that I worked for. Miserable. Other than the joint petitions, every case sucked. People screwing over their kids, people spending thousands of dollars on appraisals so they could save a few hundred bucks on the division of property. Attorneys straight-up lying to the court. I hated every bit of it and will not touch it with a ten-foot pole now.
11:45 back. Thank you for allowing me to vent. I can't do this to my family anymore. I've turned into a person I hardly recognize. I'm angry and sad and filled with dread. If I was my family, I couldn't stand me. I remind myself of that Harrison Ford movie where he was nasty before he got shot then turned nice with his daughter. I promise I am getting out and returning to be the husband and father I know I can be. I wish you all well today.
I did one trial in family court on behalf of a client who I represented in other matters. I was amazed at how poorly the other side did. I came with a mountain of easily obtainable evidence that his client had failed to disclose multiple properties which he owned. I found this by just doing an county assessor search wasn't hard to find. He was shocked. Judge directed him to file another financial disclosure, he once again did not disclose the properties…
Hey @11:45 am – I get the venting but do indeed pivot and if you need help doing that, well, say so and we'll figure out some way through Law Dawg how to connect. I'm in my mid-50s, with a practice I actually like, and it's stressful as hell. DON'T continue doing this in a practice you hate. You can pivot and it gets better. And skills are transferable.
