Not only is the legislature not subject to public records laws, they now won’t post exhibits to pending bills because one or two had a copyrighted mark on them? Too bad they can’t even read their own “findings and declaration” from NRS 239.001
The Legislature hereby finds and declares that:
1.  The purpose of this chapter is to foster democratic principles by providing members of the public with prompt access to inspect, copy or receive a copy of public books and records to the extent permitted by law;

4.  The use of private entities in the provision of public services must not deprive members of the public access to inspect, copy or receive a copy of books and records relating to the provision of those services; and
5.  If a public book or record is declared by law to be open to the public, such a declaration does not imply, and must not be construed to mean, that a public book or record is confidential if it is not declared by law to be open to the public and is not otherwise declared by law to be confidential.

I’ve never been a big fan of Judge Israel, but this seems pretty thin. A video that some apparently estranged relative posted on Youtube is a basis for disqualification? I don’t think so.

Yes but this changes once you factor in the possibility that Metro is investigating him and he probably does not want to piss them off which could lead him to rule in favor of the State and Metro.

Anyone can post a video on YouTube saying just about anything. Absent some indication of an actual investigation taking place, which I know is one of those “we can neither confirm nor deny” deals, this just seems way too thin.

All in all, the invocation of the potential for a conflict gets Israel to recuse. Its that simple. He will have a chat with the CJ and he quickly taps out.

You heard it here first.

My child went to the same school as Sara, the daughter of Ron Israel. I remember her as a darling little girl, with Israel rushing to drop her off or to pick her up. I am sorry things fell apart for the family.

Civil Bench Bar Meeting ReportMarch 11, 2025

Introduction

The Civil Bench Bar Meeting was held on March 11, 2025, both in person in Courtroom 10D and via Zoom. The meeting included various updates and discussions related to pro bono programs, procedural changes in probate, updates from the State Bar of Nevada, and recent appellate court decisions.

Pro Bono Program Updates

Senior Law Project

The project is actively seeking attorneys to take on pro bono cases, particularly those interested in gaining trial experience.

A specific case involving a senior in need of legal assistance was highlighted as an excellent opportunity for attorneys to participate.

Attorneys were encouraged to sign up by providing their name and bar number in the chat.

Legal Aid Center of Southern Nevada

There is an increasing need for attorneys to represent children in court.

Opportunities exist for appeals and minor guardianship cases, including oral arguments.

Additional probate-focused Ask-a-Lawyer programs are being developed.

Attorneys who participate in pro bono work receive CLE credit, malpractice insurance, and mentorship.

The State Bar’s challenge for pro bono participation is ongoing.

Nevada Legal Services

Volunteers are needed for telephonic and Zoom-based Ask-a-Lawyer programs in family law, estate planning, record sealing, and bankruptcy.

Advanced Directives CLE is scheduled for April 10, presented by Probate Commissioner Joe Gorman.

An in-person POA (Power of Attorney) clinic is scheduled for May 1 in Pahrump to assist elderly and low-income individuals.

Mileage reimbursement is available for volunteers traveling to rural areas.

Clark County Bar Association – Law Day at Creech Air Force Base

Scheduled for May 1, 2025, from 9:30 AM to 12:30 PM.

Focused on assisting military personnel and their families in various legal matters, including family law, immigration, landlord-tenant disputes, and consumer protection.

No need for specialization in all areas; attorneys are encouraged to contribute their expertise where possible.

State Bar of Nevada Updates

President Richard Drietzer on the New Bar Exam

The Multi-State Bar Exam will be phased out by 2028.

Nevada has opted out of the NextGen Bar Exam and is instead developing the Nevada Plan.

The new bar exam will emphasize practical skills, performance-based assessments, and supervised practice experience.

Nevada’s new approach has attracted national attention, with potential for other states to adopt similar models.

Concerns were raised regarding the potential exclusion of probate law in the new exam format, which remains under discussion.

Emeritus Attorney Pro Bono Program

Supreme Court Rule 49.15 was amended to allow retired attorneys to provide pro bono services without CLE requirements.

Attorneys participating in pro bono work will receive necessary training and malpractice insurance coverage.

The State Bar received a $300,000 grant to support these initiatives.

Probate Department Changes

New Probate Commissioner

Commissioner Russel J. Geist has been appointed as the first commissioner in Department PC-2.

The Probate Department has relocated to the 11th floor of the Phoenix Building.

Key procedural updates:

Email submissions for probate matters should be directed to the appropriate inbox (probateinbox [AT] clarkcountycourts.us for PC-1 and probate2inbox [AT] clarkcountycourts.us for PC-2).

Hearings will take place on Wednesdays for PC-2 and Fridays for PC-1.

Efforts are being made to address case assignment visibility in the Odyssey system.

Orders should only be submitted post-hearing unless ex parte.

Duplicate orders should not be submitted, and processing may take up to two weeks.

Some cases have been scheduled incorrectly, requiring rescheduling.

Updated forms, including the Probate Procedure Checklist and Synopsis of Nevada Probate Law, are now available online.

Recent Appellate Court Decisions

Clark County School District v. District Court (Angalia B.), 141 Nev. Adv. Op. 11

The case centered on whether emails stored in CCSD’s Google Vault database but not placed in a student’s permanent file qualified as “education records” under FERPA.

The Supreme Court ruled that records stored in Google Vault are “maintained” by CCSD and must be reviewed for their relevance to the student before disclosure.

The district court was instructed to conduct an in-camera review of the emails to determine whether they are “directly related” to the student.

Golden Gates/S.E.T. Retail v. Modern Welding Co., 141 Nev. Adv. Op. 12

The case involved a breach of the implied warranty of merchantability claim related to a commercial gasoline storage tank.

The Supreme Court ruled that the discovery rule does not apply to UCC claims for breach of implied warranty.

The Court upheld the district court’s decision to grant summary judgment and an award of attorney fees based on an offer of judgment, reinforcing that such offers apply to all claims in an action unless specified otherwise.

Q&A Session Highlights

Reciprocity with Neighboring States: Discussion about whether Nevada should consider reciprocity with adjacent states. The issue remains a topic of debate.

Bar Conference Location: Concerns were raised about the annual State Bar conference being held out of state, making it difficult for some attorneys to attend.

Cost of the New Bar Exam: The Bar confirmed that a $300,000 grant was received to assist in developing the Nevada Plan, aiming to minimize costs to members.

Timing of Attorney Fees Under NRCP 68: Clarification was provided that an offer of judgment applies to all claims in an action unless explicitly stated otherwise.

Pro Bono CLE Exemption for Retired Attorneys: Explanation that retired attorneys providing pro bono work through recognized programs are now exempt from CLE requirements.

Upcoming Events

March 13: 40-Year Club Luncheon at Panevino Italian Grill.

March 20: CLE on Abraham Lincoln’s trial experience.

March 27: CLE on neurodiversity in the juvenile justice system.

March 29: Charity Walk for Children’s Heart Foundation.

April 8: Next Civil Bench Bar Meeting.

April 11-12: 26th Annual Moot Court Competition at Boyd School of Law.

May 1: Law Day at Creech AFB.

Conclusion

The March 11, 2025, Civil Bench Bar Meeting covered important updates regarding pro bono opportunities, procedural changes in the probate department, and significant appellate decisions. The State Bar’s new approach to the bar exam was a major topic of discussion. Participants were encouraged to remain involved in pro bono efforts and to keep up with ongoing procedural changes. The Q&A session also provided clarifications on key issues affecting the legal community.

why is Hooge taking any position regarding the development of Red Rock. He is not an elected official, or a government officer?

Hooge isn’t taking a position on the real estate development. He’s taking a position on the deleted texts relative to the RPC.

Such a secret and illicit scheme that it is the very issue he ran on. Disbarment?! This is govt ethics (which declined to accept the complaint) at most. Conservatives love to yell that Dems prosecute political opponents but Hooge (like Trump) prove the opposite true.

“Great American”=someone who agrees with my right wing ideology.

I remember when being a “great American” meant *doing* great things, often *for America*. Now it’s just a partisan circle jerk.

Judge Israel disqualification: I read the article in the RJ today. I have one comment. I have known Judge Israel since he was in private practice as plaintiff’s personal injury lawyer. He was a ethical and upstanding lawyer. As a Judge he is beyond reproach. Judge Israel is equal in integrity as Judge Denton or any of the good Judges. I am not Judge Israel nor am I a friend. I am just saying as an attorney that had cases with him and appeared before him. Judge Israel is an ethical judge. The Motion to Disqualify is clutching at straws.

I appreciate your opinion but would like to offer a different one. I have known Judge Israel since he was in private practice as plaintiff’s personal injury lawyer. Your assertion that he is beyond reproach is simply inaccurate and not the experience that many of us who practice against him and now practice in front of him experience(d). His judicial acumen, his favortism of parties, his failure to read pleadings or understand issues and inability to refusal to put in the work is found repeatedly all over this Blog.

Did he pull a gun on his daughter and cause her trauma? I have no idea and will not weigh in on something about which I have no personal information; you might consider the same. But the statements regarding what an ethical and quality jurist he is could not be further from the truth.

Never met the man. So I have no input other than one question. My question is who actually uses the term beyond reproach?
