Thanks Daniel. But even a quick look shows that your conclusion misrepresents the report. Also, there seem to have been many, many comments about the OBC and not from one person. No dog in this fight but do not like to see such trolling.
Also, this puff-piece does not address disproportionate discipline, does not use proper statistical analysis (re relevance), and does not address the literally dozens of elements that are not tracked and not seen e.g., how many times does a potential grievant call the OBC for pure information to be pushed into making a grievance versus when it happens to a larger firm, how many of the favored sons/friends of the OBC are diverted from complaints, etc. It goes on and on, but who cares, not many appearently.
Why would anyone with the capacity for critical thinking accept OBC's analysis of disciplinary statistics? Anyone who reads this blog and doesn't think OBC is a problem is sadly mistaken. Rob Bare is turning away clients because OBC is keeping him so busy. And Rob is not cheap! OBC is bankrupting attorneys in this weird quest of theirs. The BOG's insane civility code has empowered them to come after attorneys for protected speech and opened the flood gates for disgruntled attorneys to bankrupt opposing counsel with a bar complaint. Other states outright refuse to even investigate civility complaints for this exact reason. OBC is also prosecuting attorneys for in-court actions. What happened to judges being in charge of their own courtroom? It's out of control and the time for the Supreme Court to put a stop to it has long since passed.
What is with all the complaining about OBC actually doing its job? No one can point to any cases where "25 cent accounting errors" are being litigated. Not one of the cases I have read seems like over reach. In fact, I would argue that OBC is letting way too many violations go unadressed.
This article shows OBC not only lacks legal acumen but statistical acumen. Solos/small firm practictioners are disproportionately taken to Complaint and are more harshly disciplined.

The answer is that the OBC for years has deferred to courts to handle matters that occur right in front of them. District Court judges are increasingly reversing that trend and referring attorneys to OBC for discipline. When OBC gets these complaints from a court, they have little choice but to think that they are doing the court's bidding.

I'm conflicted on this issue. I have no tolerance for obnoxious, dishonest, un-necessarily obstructive attorneys, and there needs to be far more accountability. And when we rely on the judge of the case to adequately control and sanction the offender, that is often next to worthless.
On the other hand, having the State Bar sanction in-civility is a real slippery
slope. There is almost total subjectivity involved, and the matter would be even far more rife with politics, cronyism and influence than the current Bar could ever presently be accused of
