I get it, but it’s also not hurting anyone. You can’t blame the RJ for taking it personal. Didn’t some of the criminal practitioners on this blog say he would get assessed at High Desert State Prison and then shipped off?

We predicted he would be shipped. He has been shipped. There are three reasons that the R/J keeps printing Telles stories. (1) Telles was a co-worker and friend to some staff at the R/J (not everyone at the R/J was friends with him as he was not the easiest guy to be friends with). They keep his memory alive by continuing on with the stories. (2) This was and remains a high profile case in Las Vegas. Less than 10 months ago he was sentenced. Public official murders journalist. It is still of interest. (3) The R/J gets column inches out of being able to regurgitate and reprint portions of previous articles. You have probably come to see how the RJ has a 12 paragraph story on Monday and then has a “new” 12 paragraph story on Tuesday but really only 2 of the paragraphs actually are changed between the two stories.

There is a possibility that the conviction can be overturned based upon errors made by Judge Leavitt. So still noteworthy.

So I need the group insight. We have a case in which we showed up for a motion and found out at the hearing that a Senior was sitting in. Senior heard and ruled on our motion. Now we have subsequent motion(s), and the Court is saying that it cannot set the further motions for hearing until they find out the Senior’s availability. I cant find any rule or authority that states that an entire case can be handed off to a senior judge without the parties’ approval. Anybody ever heard of such a thing in a case?

Our whole system of using senior judges thwarts the purpose of having elected judges. Many of them retired rather than face voters again to be potentially kicked off the gravy train.

Cannot tell you the number of times I have appeared in front of the elected judge only to hear them disclaim any responsibility or enforcement of orders entered by a senior who was sitting in for them. “Well that was not my order in this case….” Ummm its your department and in many cases your auto-signature once the Order gets entered. You are presiding over this case so it is your order for interpretation and enforcement purposes.

Is your current motion in any way related to your prior motion? I’ve had judges not want to rule on a motion for reconsideration on another judge’s ruling just as a matter of courtesy.

Except what is the department doing? Waiting until the Senior Judge just happens to be reassigned to the department? That seems crazy. Senior Judges are assigned for a day, not to take over all cases. Can you imagine that motions in a case would only be set if and when that particular senior judge might happen to be passing through a particular department.
