During oral arguments on a case in district court yesterday, I heard an attorney use the phrase "a momentary lapse of reason".
If this was a reference to the Pink Floyd album, well played good sir. I love it.
I have quoted Rush (most oft) and Pink Floyd, Led Zeppelin, Eminem and Rage Against the Machine in Oral Argument and written briefs. Been gaining personal amusement with it for over 20 years. Almost never caught and actually had a couple judges shoot me subtle props from the bench a few times. Its a little bit of fun in an otherwise grind of a profession.
It's all about the context. I love the Beatles' music, but do not readily draw upon their lyrics philosophically. Rush, Zepp, Floyd, the Doors, Eminem, Dr. Dre, all have made statements (lyrically speaking) relevant to the argument of the day.
You don't have to love Eminem (I really dont) to gain something from his words.

We have a Settlement Conference scheduled in a matter. We reached out to the settlement judge and were told "Ignore the Administrative Order. We are doing it in person." Rules are made to be broken sayeth this judge.

Same. Let's all get COVID for potential settlement! Makes perfect sense.
Hard for me to accept Hardesty's ever changing rules when even the judges show outright contempt and ignore the Court's rules.
