Yes, prison sentences always come with the possibility of death. That’s always been the case, and always will be.

Prison officials cannot protect a prisoner 24/7 outside of putting them in solitary. Why is this shocking news to you?

Why should I? There are already numerous prison reform groups that have a wealth of expertise in prison reform and all the associate problems with our prison system. The better question would be, why do you accept death as a likely outcome for going to prison, regardless of the crime? And why haven’t we as a society implemented changes to our prison system? And why did private prison stocks just go up?

I’m 10:08 and I second 10:38. And why do I have to volunteer in that particular arena in order to have an opinion? Do you volunteer with victim rights groups? If not, then how are you entitled to your opinion? That’s such a dumb position. I can recognize that something is not right and something is contrary to our laws without being a subject matter expert. I can also recognize that there are people and organizations who are much better equipped to participate in actual reform and rule making than I am.

Folks–criminal defense attorney and former prosecutor here. Prisons are run by the inmates. The prison guards are vastly outnumbered and unarmed. They can only run the prisons with the help of the prisoners. Their own safety is in jeopardy. Prisons are awful and dangerous places. At any given time the inmates can take over the prison. This is a simple fact of life. Nevada’s prisons are known for being notoriously bad. No one is safe ever.

Same bio as you. The state has a duty to protect those which the state compels into its care. If this was a completely unprovoked, unforeseeable murder and the DoC acted as quickly as they could to stop the homicide, then perhaps in this case there is no liability or culpability. Prisons are awful places but we cannot shrug our shoulders at people dying in our care.

Because people being stabbed to death or murdered anywhere is newsworthy. We do expect a greater deal of security in prison where people are supposed to be under supervision.

I’m sympathetic to people getting stabbed in prison. As a lawyer , I legitimately simply forgot to pay a ticket, went to warrant, officer hated lawyers it seemed, went to holding tank for many hours n set besides a drug dealer and someone who said – maybe lied idk – just arrested for double murder. I would like to think no one thought I should be stabbed to death.

If you wanted to avoid the risk of death, you should have been more responsible and paid your ticket. It was entirely within your control. Had you died in the tank, you would be undeserving of any sympathy, you brought it on yourself.

This Matt Gaetz nomination is very worrying. How do you see this playing out?

Here is my prediction: Leader Thune reluctantly allows the recess appointment, neutering the Senate. Gaetz is largely ineffective, but does succeed in launching some prosecutions against some Trump political opponents. When called out on this, there will be a lot of whataboutism. “We didn’t start lawfare, we’re just trying to clean it up.”

Sounds plausible to me. I think he gets in. I’m really more curious about how this plays out throughout the US and with the DOJ. I assume our US Atty gets removed, and a ton more in other states as well. Who replaces our Nevada US Atty? Does criminal justice policy totally change going forward? Is Elon going to try to cut DOJ’s budget? Asking for my friends who are criminal defense attorneys, do they need to start to look for other work?

Article II, Section 3 permits the president to put one house of congress into recess if the other one goes into recess.

So he would just need the house to go into recess (h/t Mike Johnson) and then he can declare the Senate is in recess, and then do recess appointments.

“…he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper;”

I find it impossible to believe that the Senate will not fall in line behind Gaetz, whatever their reservations may be about him. Gaetz is the person selected to be the instrument of Trump’s retribution for all of the prosecution he has faced over the past several years. I literally cannot think of a scenario where dissenting would trigger a more forceful response from the first Republican president to unite the working class in a generation, whose unofficial right hand controls one of the largest social media platforms on earth and who literally has more money than anyone else – i.e., enough to primary any dissenter into oblivion.

At best, Thune will negotiate for a few dissenting votes within the party for Senators defending the most vulnerable seats up for reelection in 2026. With a 3-seat majority assuming McCormack survives the PA recount, my guess would be Ernst, Collins, and Thillis.

I’m struggling to understand the outrage over the Gaetz pick from anyone on the conservative side, as well as the seemingly “firm” belief that the Senate will vote its “conscience” on this nominee. We got Access Hollywood before the 2016 election and E. Jean Carroll before 2024. These pieces of evidence did not change the outcome of either election or the essentially unified support DJT received from Republican members of the upper chamber.

Why should DJT believe that the same leaders who supported him through these scandals will defect from him now under the belief that Gaetz is “unfit”? Who can seriously believe these people will suddenly decide vote their “conscience” now after overlooking as much as they already have? DJT just brought the richest man in the world in front of half of Congress and publicly humiliated him while he stood there and said nothing. And everyone in that audience laughed nervously, the same way all of us lawyers do when we are in Court and the judge cracks a weak joke.

He resigned because there is apparently a scathing House Ethics Report coming out tomorrow. By resigning, the House Ethics Report is moot and dies on the vine because he is not a member of the House any longer to be investigated.

I’ve heard theories that he’s being put up as a sacrificial lamb to detract from the rank incompetence of the rest of the nominees. Probably some truth to that. And the investigation results haven’t been released so that definitely could be playing a role in his resignation. Who knows.

I hope that the House Ethics report re: Gaetz’s alleged activities with a high school girl is released to the public…or at the very least to the Senators who will be voting on his confirmation. He can’t serve as AG with any semblance of legitimacy or honor with that cloud of suspicion hanging over his head. Then again, that & baseline competence may not ultimately matter to the powers that be.

Rumor is that she was being investigated by the commission on judicial discipline and decided she was done and opted to retire rather than go through that. I appeared in front of her when she had a CPS caseload and can completely understand why she was being investigated. She does not have a judicial temperament. To her credit, she didn’t focus her behavior on one particular group (Unlike some cUrrent jUdges on the family coUrt bench), but rather she just hated everyone.

Biden did not do that, but nothing I or anyone says will change the cult’s mind so…moving on. I take what I think of as a Bill Cosby approach. If there’s one claim with tenuous connections, maybe a nothing burger. If there are multiple claims in multiple jurisdictions, it starts looking like there’s something there. Considering the Dime Store Dictator, even the Georgia GOP has acknowledged that he tried to force them to commit election fraud and “find” 11k votes. His charities have been proven fraudulent. The list goes on. I think it is all irrelevant though. His cult has made clear that his claim that he could stand in the middle of 5th Avenue and shoot someone and get away with it is pretty much true as far as they’re concerned. They don’t care.

I disagree with 8:45. I realize that most lawyers in town scoff at family court, but they do very real damage down there. It isn’t something that you can just get out of either. Abusers can take their ex back to court over and over and over again, draining them of time, money, and sanity. It is a local problem involving judges and lawyers and it is worthy of discussion. Reform does not just happen overnight. And yes, I know, an anonymous blog is not going to create reform. But it does get the word out and creates awareness. Ignoring the problem does nothing at all. We can’t be surprised there are children in the community being harmed when we’ve got judges giving tier 3 sex offenders unsupervised access to small children. Please keep the conversation going and remember, you have no idea when you’ll find you and yours in family court. We need reform.
