Why are prison stabbings considered newsworthy events? This just in, water is wet.
What are we supposed to do with that information?
So a prison sentence now means death? Or you can’t complain if there is death?
Do prison officials not have some duty to protect these people?
Yes, prison sentences always come with the possibility of death. That’s always been the case, and always will be.
Prison officials cannot protect a prisoner 24/7 outside of putting them in solitary. Why is this shocking news to you?
This is a law blog. I assume that means you took Con Law. Please go read the 8th amendment again.
Will do, and let me know when you cook up the secret formula to stop prison stabbings in a national prison population of 1.2 million people.
Why should I? There are already numerous prison reform groups that have a wealth of expertise in prison reform and all the associate problems with our prison system. The better question would be, why do you accept death as a likely outcome for going to prison, regardless of the crime? And why haven’t we as a society implemented changes to our prison system? And why did private prison stocks just go up?
Never said it should be accepted as a “likely outcome.” I’m sorry I don’t share your bleeding-heart empathy. We’ve seen the absolute failure of bail reform and the like. Your idealistic platitudes don’t hold much water in reality.
Protecting inmates from murder is an “idealistic platitude”? Interesting.
Do you participate in prison reform groups? Do you volunteer in any capacity to practice what you preach? If not, you’re just yapping for the sake of yapping.
You’re interacting with more than one person here. I am 10:38 and only 10:38 PM. I do not have to participate in reform groups to note the absurdity of your position.
I’m 10:08 and I second 10:38. And why do I have to volunteer in that particular arena in order to have an opinion? Do you volunteer with victim rights groups? If not, then how are you entitled to your opinion? That’s such a dumb position. I can recognize that something is not right and something is contrary to our laws without being a subject matter expert. I can also recognize that there are people and organizations who are much better equipped to participate in actual reform and rule making than I am.
Private prison stock went up because of the expected Trump internment camps
Folks–criminal defense attorney and former prosecutor here. Prisons are run by the inmates. The prison guards are vastly outnumbered and unarmed. They can only run the prisons with the help of the prisoners. Their own safety is in jeopardy. Prisons are awful and dangerous places. At any given time the inmates can take over the prison. This is a simple fact of life. Nevada’s prisons are known for being notoriously bad. No one is safe ever.
Same bio as you. The state has a duty to protect those which the state compels into its care. If this was a completely unprovoked, unforeseeable murder and the DoC acted as quickly as they could to stop the homicide, then perhaps in this case there is no liability or culpability. Prisons are awful places but we cannot shrug our shoulders at people dying in our care.
Get rid of pepple with your Jerry Jones lets just blow up the stadium attitude towards reform.
@9:32 and similar
The only question here is what are you going to do about? Belly aching is easy.
No solution, then stop cluttering up the blog.
Because people being stabbed to death or murdered anywhere is newsworthy. We do expect a greater deal of security in prison where people are supposed to be under supervision.
Alex, re today’s title, “What will OBC ignore in recommending a long suspension, if you’re not part of the cabal?”
I’m sympathetic to people getting stabbed in prison. As a lawyer , I legitimately simply forgot to pay a ticket, went to warrant, officer hated lawyers it seemed, went to holding tank for many hours n set besides a drug dealer and someone who said – maybe lied idk – just arrested for double murder. I would like to think no one thought I should be stabbed to death.
Are you really comparing a state prison to a drunk tank at a local jail?
Yes the analogy is perfect
Murderer was lying. Those guys are 100% segregated from the gen pop “tank”.
Op back, also I thought a real “murderer “ would keep it to themselves
If you wanted to avoid the risk of death, you should have been more responsible and paid your ticket. It was entirely within your control. Had you died in the tank, you would be undeserving of any sympathy, you brought it on yourself.
I would love it if a troll like 11:28 had the testicular fortitude to say something like that in person…especially in a crowded bar. It would be cool to see a real life glassing up close and personal. And then we could all shake our heads and agree that if you brought it on yourself and you were undeserving of sympathy. Anyways, have a good day PAB troll.
I’m pretty sure 11:28 was being sarcastic
Not a hint of sarcasm in that post. 100% internet beer muscles
11:28 AM here. It was 100% sarcastic, meant to point out the absurdity of blaming the victim.
This Matt Gaetz nomination is very worrying. How do you see this playing out?
Here is my prediction: Leader Thune reluctantly allows the recess appointment, neutering the Senate. Gaetz is largely ineffective, but does succeed in launching some prosecutions against some Trump political opponents. When called out on this, there will be a lot of whataboutism. “We didn’t start lawfare, we’re just trying to clean it up.”
Sounds plausible to me. I think he gets in. I’m really more curious about how this plays out throughout the US and with the DOJ. I assume our US Atty gets removed, and a ton more in other states as well. Who replaces our Nevada US Atty? Does criminal justice policy totally change going forward? Is Elon going to try to cut DOJ’s budget? Asking for my friends who are criminal defense attorneys, do they need to start to look for other work?
LOL he was running for his life re: the House investigation and report
“I assume our US Atty gets removed, and a ton more in other states as well. Who replaces our Nevada US Atty?” There is only one plausible answer: Michelle Fiore
What recess appointment? When do you anticipate the Senate going out of session? It hasn’t been out of session for 20 years.
Trump constitutionally calls a recess over the objections. . . .
Please identify where in the Constitution it gives the President the authority to direct Congress to the restroom, much less the ability to call them in and out of session.
Article II, Section 3 permits the president to put one house of congress into recess if the other one goes into recess.
So he would just need the house to go into recess (h/t Mike Johnson) and then he can declare the Senate is in recess, and then do recess appointments.
“…he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper;”
Damn dude that was a real mic drop response. Props to my man for keeping it 100.
Good answer- one question – how long would the recess appointments last? Until the end of the session, so two years or lesser?
Yep, about 2 years.
You got owned.
Trump’s Political Opponents = People who illegally targeted Trump and others and broke the law in doing so.
This is the downward spiral I worry we will not be able to pull out of.
I think there is a 0.1% chance that he gets confirmed or even goes to confirmation.
Its a long shot. . . to be sure. And this is from one that really likes Gaetz.
I find it impossible to believe that the Senate will not fall in line behind Gaetz, whatever their reservations may be about him. Gaetz is the person selected to be the instrument of Trump’s retribution for all of the prosecution he has faced over the past several years. I literally cannot think of a scenario where dissenting would trigger a more forceful response from the first Republican president to unite the working class in a generation, whose unofficial right hand controls one of the largest social media platforms on earth and who literally has more money than anyone else – i.e., enough to primary any dissenter into oblivion.
At best, Thune will negotiate for a few dissenting votes within the party for Senators defending the most vulnerable seats up for reelection in 2026. With a 3-seat majority assuming McCormack survives the PA recount, my guess would be Ernst, Collins, and Thillis.
Well, at least our democracy is functioning well.
Collins and Murkowski are never voting for Gaetz. Tillis and Ernst are never voting for Gaetz.
I’m struggling to understand the outrage over the Gaetz pick from anyone on the conservative side, as well as the seemingly “firm” belief that the Senate will vote its “conscience” on this nominee. We got Access Hollywood before the 2016 election and E. Jean Carroll before 2024. These pieces of evidence did not change the outcome of either election or the essentially unified support DJT received from Republican members of the upper chamber.
Why should DJT believe that the same leaders who supported him through these scandals will defect from him now under the belief that Gaetz is “unfit”? Who can seriously believe these people will suddenly decide vote their “conscience” now after overlooking as much as they already have? DJT just brought the richest man in the world in front of half of Congress and publicly humiliated him while he stood there and said nothing. And everyone in that audience laughed nervously, the same way all of us lawyers do when we are in Court and the judge cracks a weak joke.
There is a greater than 50% chance Gaetz will be AT LEAST acting AG.
Ouch I’m going with 75% he actually is confirmed. He is astute politically and wouldn’t have resigned without inside info on confirmation.
He resigned because there is apparently a scathing House Ethics Report coming out tomorrow. By resigning, the House Ethics Report is moot and dies on the vine because he is not a member of the House any longer to be investigated.
If there was such a report. It will be leaked. Or would have been already.
There are House Republicans referencing the report. There is a report. Whether it ever gets released is a different question.
Glad he’s out of the house. Repubs in his caucus cheered when he resigned. Senate might not confirm him.
I’ve heard theories that he’s being put up as a sacrificial lamb to detract from the rank incompetence of the rest of the nominees. Probably some truth to that. And the investigation results haven’t been released so that definitely could be playing a role in his resignation. Who knows.
This makes A LOT of sense.
I hope that the House Ethics report re: Gaetz’s alleged activities with a high school girl is released to the public…or at the very least to the Senators who will be voting on his confirmation. He can’t serve as AG with any semblance of legitimacy or honor with that cloud of suspicion hanging over his head. Then again, that & baseline competence may not ultimately matter to the powers that be.
But Garland did? Mwhaaaaahahahah
Did what?
In an alternate universe, Garland would’ve made a fine Supreme Court Justice. Unlike AG’s, SCOTUS has the luxury of taking their time in making most decisions.
Honor ship sailed and sank back on election day.
Your worry is understandable.
I was worried to death that Kamala might be elected with all of her qualifications.
Anyone know why she is retiring?
Rumor is that she was being investigated by the commission on judicial discipline and decided she was done and opted to retire rather than go through that. I appeared in front of her when she had a CPS caseload and can completely understand why she was being investigated. She does not have a judicial temperament. To her credit, she didn’t focus her behavior on one particular group (Unlike some cUrrent jUdges on the family coUrt bench), but rather she just hated everyone.
As a heavy metal fan, this is funny re Trump n Cabinet: https://babylonbee.com/news/weird-but-ok-trump-picks-dave-mustaine-for-secretary-of-housing-and-urban-development
People throw around the phrases “end of democracy” etc but if EITHER side engages in lawfare it is the definition of a third world country. I think Biden did it but I hope Trump does not – Geatz sp is not a good look. Full disclosure voted for Trump.
What is the difference between lawfare and enforcing laws against people who break them?
What “no reasonable prosecutor” would do apparently.
What’s the old saying? Every person commits 10 felonies a day. It goes to reasonable prosecution, comparing to others, etc.
3 Felonies a Day.
A book by the esteemed
Harvey Silverglate
Eye opening read.
Ooh I know this one, false equivalence!
You ever intentionally retain classified documents after the DOJ asked for them back?
Ever get people to sign fake documents to submit to the government?
Ever conspire to overturn a lawful election?
These aren’t the “everyone does it” felonies.
Uggh. Your conclusory repetition is pointless and exhausting and assumes multiple facts not in evidence.
You might as well be directly channeling Rachel Maddow.
Biden did not do that, but nothing I or anyone says will change the cult’s mind so…moving on. I take what I think of as a Bill Cosby approach. If there’s one claim with tenuous connections, maybe a nothing burger. If there are multiple claims in multiple jurisdictions, it starts looking like there’s something there. Considering the Dime Store Dictator, even the Georgia GOP has acknowledged that he tried to force them to commit election fraud and “find” 11k votes. His charities have been proven fraudulent. The list goes on. I think it is all irrelevant though. His cult has made clear that his claim that he could stand in the middle of 5th Avenue and shoot someone and get away with it is pretty much true as far as they’re concerned. They don’t care.
Nonsense.
Debunked.
Fake news.
My prediction is that only those that actually broke the law will be prosecuted. Because that can now be a thing with some DOJ reform.
RFK Jr nominated for HHS Secretary? With a worm in his brain?
He’s got subject matter expertise now!
This nominations keep alternating between amusement and fear.
Municipal court chief judge is retiring. Spot will soon open up for appointment.
Looks like a bad shoot

I don’t know about everybody else, but personally, I’m getting (and have been) tired of all the political comments. Let me know with the votes whether you think I should bring the Thwack back for politics so we can keep this discussion more on topic.
Bring it back. Keyboard warriors love to be mean. It is a sad aspect of society that has grown with the internet and the ability to be anonymous (says the anonymous person).
Political responses are often on topic. When they are not, THWACK EM
While we are at it can we get a thwack for any mention of ‘the cabal’
Nothing could be more on topic than a systematic hurting of children for money. I will grant you that we need more evidence and less name calling but it’s very difficult as if a name is mentioned it’s thwacked even in light of the fact it’s virtually impossible to get past anti slapp.
I disagree with 8:45. I realize that most lawyers in town scoff at family court, but they do very real damage down there. It isn’t something that you can just get out of either. Abusers can take their ex back to court over and over and over again, draining them of time, money, and sanity. It is a local problem involving judges and lawyers and it is worthy of discussion. Reform does not just happen overnight. And yes, I know, an anonymous blog is not going to create reform. But it does get the word out and creates awareness. Ignoring the problem does nothing at all. We can’t be surprised there are children in the community being harmed when we’ve got judges giving tier 3 sex offenders unsupervised access to small children. Please keep the conversation going and remember, you have no idea when you’ll find you and yours in family court. We need reform.
#FightTheCabal
I’d like to see actual discussions about how the political appointments are impacting the law. The conversations seem to devolve no matter how much commenters try to stay on topic so maybe thwacking is your only option. It’s your blog. Thwack away. I’ll probably complain, but that’s not news.
We all know it’s same angry cat ladies posting over and over instead of doing their actual jobs. They need to go touch some grass. Enough already, everyone knows you’re pissed. You can find your echo chamber with Maddow but it’s tiring to see you here all day.
