This exists for some attorneys do to favors for clients and other attorneys to run a mill to make money. The part that sucks the most about it is that poor people with limited or no resources end up paying full freight for traffic tickets while middle and upper class folks don't. Years ago, I ended up showing up early and saw the session of poor unrepresented people taking care of traffic tickets. Some had bench warrants because they couldn't get work off to come in. Others needed a payment play (I think $20 a month?) for a $400 ticket. It was really sad and pathetic (not the poor people, but our system).

The way we do tickets needs to change.

The law has just changed and traffic citations will no longer be criminalized. Bench Warrants wont be problem in the future. Hopefully, this is the change to which you are referring.

The way we do tickets may need to change, but that's not really what 11:33 was talking about. A law firm is saying "bring us your sports event ticket and we will represent you for free on a traffic ticket."

For the only jurisdiction that has this burning desire to regulate attorney commercial speech, this seems a bit icky. It's as if legal representation is or should be equated to getting a free Whopper with your game ticket. If the SBN would just drop the whole pre-screening of advertisements, etc. I wouldn't care. Instead, they've doubled down and tried to close loopholes and safe harbor provisions.

Slightly off topic, De-criminalized tickets
No bench warrants – but there must be a method to enforce collection of fines. I haven't seen anything that explains how, for example, the City of Las Vegas, will collect fines and the actions to be taken if unpaid or the ticket and fine is ignored.

I've got family members and clients in the medical field and, in addition to the actual expert advise coming from health officials, they can confirm that COVID is an actual, real thing. COVID deniers are just idiots. Frankly, I'd love it if y'all got together and just gave each other COVID until the virus had run its course and handled the matter; however, that's not how viruses work and the rest of us have to exist in the same world. I suppose the least you can do is stay home. Don't go to the doctor, don't come outside, don't go around other people. Just stay home. Since you think it's a fake virus, you shouldn't have a problem with that. Be free! …at home.

I am pretty sure that no one on this thread claimed that CV19 wasn't a real thing. Its just not the killer that they say it is. Its a flu (which killed nearly ZERO people last year) with a very scary name.

BTW, I too have doctors as clients and family members and its funny that they say the exact opposite of your family and clients. You'd think that the videos of various state, national and world leaders "faking it" for the cameras and repeatedly getting caught violating their own protocols and mandates would be enough for you to QUESTION!

The covid-19 danger is exaggerated. It isn't the mass killer claimed. Anyone testing positive, including false positives, within 30 days of death was listed as a covid death. So the death number is highly suspect.. The 40 cycle pcr test was/is worthless and the CDC just dropped the cycles to 28 for those who are vaccinated and are suspected of having covid. I guess the CDC wants to avoid the false positive problem for the vaccine push. Don't want "safe and effective" to be tarnished.

Exactly. Try researching the PCR test and its ability to detect viruses. They cranked it up to 40 cycles. Way beyond its "cycle threshold" effectiveness and causing huge numbers of false positives. In fact, your beloved WHO admitted a few months ago the problems with it and the CDC fixed it, causing VIOLA, a dramatic decrease in positive cases.

I appreciate all the invectives being thrown around here. This is what I know, Ken Long died two days ago from COVID, John Duffy died from COVID late last year. There are a number of people who have suffered heart attacks who were young in the past year, one of my close friends died recently from a heart attack, I suspect it might be from undiagnosed COVID. Additionally I know of three attorneys in my field who were hospitalized from COVID who were given less than a 50% chance of living, thank god they pulled through. I was diagnosed with COVID, my wife was diagnosed with COVID, her ex husband was diagnosed with COVID, both of my daughters were diagnosed with COVID. My immediate family and my wife's ex husband, good dude, had minor symptoms and we were lucky. It appears that this disease can ruin people, we were lucky that it didn't affect us beyond the quarantine, but to say it is no stronger than the flu seems anecdotally incorrect. If it hasn't affected you, good for you, but there are quite a few members of our community who can't say the same. We should be sensitive to those folks because they represent a true loss to our community as a whole. Minimizing COVID minimizes the lives of those who were lost and that is a shitty thing to do.

False positives from the PCR Test. That's how the numbers get exaggerated. Research the inventor of the PCR test and the inventor's opinion on using it for Virus Detection.

I sympathize and lost friends as well and Covid caused medical conditions that almost killed my father. My 30 yr old daughter caught it and recovered after a few days. So I don't dispute that Covid is real. But, that said, false positives, caused by 40 cycles for PCR testing, are blowing it out of proportion.

Add to that the substantial govt funding for hospitals that diagnose CV19 and said diagnoses are called into question at best. Some counties are reversing causes of death for these false positives. Research it.

Point is, the whole "pandemic" is manufactured to scare us, control us and redirect our money to the medical industry. CV19 is 99.9x% survivable for nearly every age group.

Stop cowering in fear, go to in-person court hearings without grousing and dont believe everything that they tell you, especially through the MSM.

You were taught to think critically. Try it on. It feels great.

Wow this is certainly getting heated. Last year it started with no one knowing anyone with COVID. Then it got to where we knew people who tested positive but with minor symptoms. Now I am certain that most people know of people who have actually died, like Ken Long and John Duffy. Maybe the numbers reported of deaths are not accurate. But we certainly cannot deny that this is a very serious virus. I think the problem for the American people is the way the media is reporting it and how politicized things have become. I would recommend the Dark Horse podcast with Bret Weinstein. It is very informative about the pandemic. You didn't see him inject bleach, ingest hydrocholroquine (sp?) or expose his blood to UV rays, but some people did it to themsleves anyways, cuz he said it would work. The kneejerk "anti-any!-andALL!-Democrat positions" is crazy when you apply it to science and medicine. Just crazy. I bet if a Democrat were in office when COVID hit all we'd hear about is how many deaths there were and how horrible the reaponse was (see e.g. states run by Dems). David is a stand up guy. He can occasionally, be a little lazy, but he is a good dude and you can believe him when he speaks and take him at his word. I have tried cases against him.

The BK thing was years ago (I was there, hanging out with the BK Hottie) and wasn't exactly as you think. That whole thing stemmed from again, a little laziness, upon which he doubled down and got hammered.

Holy cow. I remember this case. Markell was a stickler and HATED shoddy work. He slammed Winterton with a two ton shovel for slacking off and half assing it some. Other than this, Winterton is clean and ultimately as said by @1259, a pretty good person, whom you can rely on to tell the truth. As I recall, Markell didn't like Winterton much and ripped him verbally on occasion.

I looked up the case and immediately questioned it when I saw Markell was on it. I never practiced bankruptcy, but Markell's benchslaps always seemed like he was going for media coverage (which he got). He essentially destroyed the career of an unprepared associate when the benchslap went viral. He struck me as the kind of person who had no appreciation for the difficulties of practicing law, a bit of a misanthrope and a bitter person. Which sort of makes sense because didn't he end up being a law professor?

The 9th did affirm sanctions but reduced them by 90%. "We affirm the bankruptcy court’s decision to impose sanctions but reduce the sanction award to $11,000." I will say that I was also around when 12:59 was and can say that the case was not as clear cut. Winterton was told by the his client and shown documentation that the individuals authorizing the Petition had corporate authority and control when it was a 50/50 situation.

Never had a problem with Nakagawa. Landis' problem is that he wastes insane amounts of time. I have seen him read his findings from the bench (which he insists on doing for some reason) for hours. Literally. As in more than one. Even simple motions will receive what must be a written out oration on the courts findings and conclusions. I don't know how he does it.

Markell was one of the finest judges to grace any bench in Nevada. Brilliant. Fair. Hard working. Willing to buck the prevailing trends to achieve justice. He was a $1k+/hr. big firm partner who got bored and decided to make bankruptcy practice better for everyone. I do not disagree with @817p. Markell was a pleasure to be in front of. I garnered his respect by carrying my BK Code book with me. So that when he asked me a question "What about that point in light of Section XXX?) I would pause, look it up and answer. He never, ever called me out for that. He just smirked and nodded. I noticed and never failed to have my codebook with me after that.

I always respected him, even when he called out other lawyers for shoddy or careless work. It was kind of his way of letting us know that he KNEW Bk law and wanted us to know it too.

The interesting thing about Judge Jones was he that he was so laid back 99% of the time in U.S. Bankruptcy Court – and then when he got appointed and confirmed to U.S. District Court, he turned into a whole different person.

From what I remember, he was widely respected in bankruptcy court, but as a district court judge, he was overturned many times by the 9th Circuit, and those opinions were not that nice to him and a few were kind of demeaning.

Not many times, as I recall. His ONE major (by major, I mean LOTS of press) 9th Cir overturn was Nevada's Constitutional Amendment banning gay marriage. Which, if you read his opinion was not religious, it was state's rights and Constitution based.

He was a good judge and well respected. The media vilified him for that decision.

Clive is a good man and was a great jurist. We are worse off for having lost him.

He had other reversals from the Ninth Circuit I would also characterize as major, such as reversals where he was also booted from the case. There was more than one.

There was a criminal case where at least three writs were granted and he was booted off on the last one.
