No Clear Winner

Election day has come and gone and where does that leave us? Well, at the moment, a bit in limbo… Because every voter in Nevada received a mail-in ballot, the number of ballots remaining to be counted is an unknown. We still have results to discuss though. You can view what the State has for results here and what Clark County has for results here. Congrats to all the winners!

In the Nevada Supreme Court, Doug Herndon defeated Ozzie Fumo.  In the Court of Appeals, it looks as though Bonnie Bulla will retain her position on the bench.

In Clark County, it looks like two incumbents–Judge Richard Scotti and Judge Rob Bare–have lost their spot on the bench. It also looks like Judge Kephart will be retained. The races in Dept. 8, Dept. 21, Dept. M, Dept. U, and Dept. X seem to be the closest.

What are you seeing from these results? Are you really surprised? Did anything change? Is this election proof the system works or that it needs to change?

Don't forget about Chief Judge Chris Lee in NLV Justice Court. He always received high ratings in Judging the Judges. He started a Veteran's Court and was well liked. He lost by almost 20% to public defender Belinda Harris. Can anyone explain that?

I used to be on the fence about electing judges outright, vs. Missouri Plan retention elections. It always seemed to me that there was no correlation between election vs. appointment and whether someone turned out to be a good judge or not. These results have helped to change my mind. It is absurd to elect judges.

This isn't about "increased access to careers in the legal field." This is about elections where, by example, a female challenger to a male incumbent prevailed without even attempting to campaign. Or the fact that the split of judges now is overwhelmingly female in the district. I'm not sure it's the result of misandry, necessarily, but it sure is lopsided. I actually don't have a good idea as to why this is happening, though.

Take Erika Ballou versus Dan Gilliam for Dept 24. He raised over $155,000 in campaign. He received endorsements from law enforcement and the labor unions. He lists the names of numerous attorneys who have come out to endorse him. He even took the time to create a webpage. Ballou, on the other hand, raised $0 for her "campaign", according to the SOS website. She didn't even bother to create a campaign website. Only article I could find to learn anything about her is that she works a public defender and had to remove her BLM pin while in court before Judge Herdon. That's it! She has the right race and gender to walk into a job that without working a campaign to get elected. Judicial elections are a shame and they need to stop.

As you indicate, she advertised so little that but for me going and looking her up, I had no idea what her race was. Bafflingly unqualified but not because of her race.

If Nevada won't have full tallies until Thursday, as it has been reported, how can we call any judicial race that is separated by <5000 votes? Some of them are so close, and if there are still ballots being counted state-wide, I can't see how we can call any winners at this point.

(disclaimer: I am not a candidate and have no vested interest in this, just watching this show with amusement since we'll never have a clear indication of a winner in anything a this rate)

Agreed. Approximately 75,000 known returned ballots are yet to be counted in Clark County, and of all mail ballots still outstanding who knows how many people mailed ballots yesterday that will trickle in over the next several days

Ignore, for just a moment, the bizarre pandemic-related circumstances surrounding this particular year's election.

The popular arguments against traditional precinct-based in-person voting are that it results in voter suppression since some people can't get time off from work to go to their local polling place, the elderly can't leave their homes to vote, etc. Stated differently, vote-by-mail and early-voting theoretically provides wider access to the political process.

1. Is this really true?

2. Have the newer methods of voting created markedly greater participation?

3. Is this purportedly more-inclusive manner of election worth the very real delays, uncertainly, doubt, and illegitimacy it casts on the electoral process?

This is absurd. Scotti, Coffing, Aurbach and Bare all defeated? I'm in favor of diversity of every kind but this is ridiculous. These are all fine attorneys will many years of solid litigation experience that deserved to be on the bench(or remain there). The District Court bench is diminished with their defeat.

I believe in total they will balance out the previously DA-heavy bench that had no belief in leniency, resulting in an overall "reasonable" bench. Still skewed by the specific judge in a case but a big step in the right direction. Also you don't for sure, some of them may be tired of criminal law and actually want to learn/do something new.

I have a case in front of one of the departments in question. Very complex business litigation (albeit not business court). Receivership in place. And a brand new PD is going to "take the time to master commercial and personal injury law" while overseeing this $17M receivership. Brilliant!

White male, over 25 years practice. It seems true some women won based on gender. So the pendulum swings. The real issue for all of us should be qualifications. It seems several well qualified candidates lost to less qualified candidates. In those departments, we all lost. Scotti was smart and fair. Bare was nice, hard working. The bar should be committed to improve the quality of judicial candidates.
I don't know many of the probable winners. I am hopeful they are up to the task, not merely gender correct.
