I'm not Miley fan, but Bruce Gale is pathetic. "Oh man, a new boyfriend emasculated me. I need a restraining order so I can continue to use court process to defame an opposing party!" Miley should be voted out and Gale should just turn in his bar card. Good job all!

Bruce is a hack or a pussy or both. He leveraged a bad family situation into news coverage. Now, he's making more news with Spears. This is the epitome of #fakenews #douche

Darcy Spears is a total hack. This "news story" is a classic example. How is Bruce Gale running into Judge Miley at LifeTime news except that Spears has worked it up into a ratings-driving melodrama? She doesn't make any effort to push back against Bruce Gale for (1) the obvious personal bias he has in taking action against Judge Miley; or (2) that this is obviously an exaggerated incident in which nobody was under any realistic threat of bodily harm.

Darcy Spears is in the business of selling cheap, contrived, easy stories designed to manufacture outrage or contempt or anger or moral indignation. Stories that get ratings. The best stories have a hero and a villain. That's why she loves beating up on small, family owned restaurants in Dirty Dining. By cribbing the Health Departments reports, and showing up at the restaurant with a cameraman, she gets a quick story and she gets to be the hero.

Miley's conduct is embarrassing, but an "abuse of power"? Really? Spears had her narrative charted out from the beginning and she wasn't going to ask any questions of Bruce Gale (or anyone else) to depart from it.

Total garbage.

Miley could simply have avoided Gale. What does she have to gain by introducing Gale to her boyfriend and telling her boyfriend that Gale represented Ed in the divorce? And what does her boyfriend have to gain by telling the gym employee "get him out of here before I kick his ass"?

Perhaps Miley and the boyfriend weren't trying to intimidate Gale; but at the very least, it was a demonstration of Miley's poor judgment. And, unfortunately for her, she has a well-documented history of exercising poor judgment in public.

"get him out of here before I kick his ass" is what some cultures would simply consider an aggressive greeting.

She should be voted out of office. She is not fit to be a judge based on her conduct. She was not a good family court judge and not much better downtown. I am no fan of her dog killing ex husband either.

The problem for Miley is this: she has no career path other than to try and stay on the bench. She was a failed lawyer who managed to somehow ascend the family court bench and make it over to District Court. She's photogenic and her party likes her. She's been a C- judge in a county loaded with C- judges. Having a job from which she cannot be fired is perfect for her. But if she were to step down, she'd have no career options and a big monthly nut. She needs the salary, the benefits, and the generous retirement. And so, do not expect her to step down.

She must know that none of the attorneys who appear in her courtroom respect her. She must feel some embarrassment that her zany private life is repeatedly being exposed in the local media. But her options are limited and; therefore, she'll run again. And she'll probably win.

If what Gale says happened actually happened, he's within his rights.

How is any of this good for the Miley children? Ed should want the mother of his children to have a decent career, with a decent income, and not to be ridiculed in public. Stefany should not be stirring shit up by encouraging her boyfriend to get involved. Gale is a joke. Odds are high that he went to her gym, at the same time she was working out, to get a reaction from her. All involved need to grow the fuck up and give those kids a shot at a decent childhood.

I think the oldest two are around 18, but I believe there is a younger son who is under 10 years old. Even 18 year olds should have reasonable parents.

It's true there is highly troubling behavior. First, about ten years ago, when the parties first filed for divorce, she accused her husband of alcohol-fuelled violent conduct. And around the same time she had the altercation with another mom at a kid's soccer game. The parties then reconciled.

But then over the last year they again commenced divorce proceedings, and there is the incident where she allegedly slapped around her 18-year-old son when he was sassing back at her after she reprimanded him about his apparent careless driving.(An aside: for those of us who have had teenagers who drive dangerously and imperil themselves and others, this can really push a parent to the limit. Not excusing the alleged conduct, but…).

So, yes there are serious issues, and it seems she has not learned to adequately control her conduct and keep it out of the court and the media.

But I am not prepared to say it is by any remote stretch all her fault. Without the necessity of going into too much detail, it is my considered opinion that her husband has had some real challenges of his own. Perhaps they would have been much better served by completing the divorce ten years ago, rather than reconciling and apparently having yet another child.

Plus, it seems like a gross over-reaction, and designed to inflame matters, for the husband's attorney to seek a restraining order to protect such attorney from the judge.

Even if we accept the version of husband's attorney, it is an over-reaction, IMO. Attorney's version: the attorney is receiving a tour of the health club, and the manager introduces him to the judge and her boyfriend. The judge, quite unwisely, tells her boyfriend that this is her husband's attorney, and he is the one who called to have the judge arrested for striking her teenage son.The boyfriend apparently said little or nothing at that time, but supposedly later told the health club manager that he wants to kick the attorney's ass, and that the attorney better leave or he will kick his ass. But everyone apparently remained on the premises for some time, and no one approached anyone to kick anyone's ass, even though that was the golden opportunity for any ass kicking to occur. Again, when introduced to the attorney, the boyfriend did not make any threat, but made the comment to the manager later on.

Also, why seek a restraining order against the judge? She didn't threaten to kick anyone's ass. The boyfriend is the one. So why not instead file it against him? Reason is that filing it against the judge attracts media and inflames matters. If the attorney was actually in any legitimate fear of his safety, why not file it against the person who made the threat, rather than someone who is romantically involved with the person who made the threat?

No one in this whole sordid mess seems to have much credibility or ability to act appropriately, and no one deserves much sympathy, except the children.

Attorneys and others in the legal system, as well as those in the political system, would be wise not to take sides in this wretched quagmire. No matter which side one takes, they will be on thee losing side.

But sthe judge will proably cruise to re-election, so WTF.

10:58–the report is that he sought a TPO against both the judge and the boyfriend, which diminishes one of your arguments. But don't feel too bad, I often skim news articles myself and miss important part.

That said, much of what you say is valid. But when you spread blame between both sides, remember that she is a judge and in a very high positon of (supposed) public trust and status. So, the hard truth is that the ethical and public relations ramifications are much greater for a judge who creates these types of problems, than for attorneys who behave in a similar fashion.

Predictably, Darcy Spears frames the obviously inevitable denial in terms of what Judge Miley (or her bf) did wrong, rather than the fact that this was a stunt by Bruce Gale that had absolutely no legal merit.

Great work, Darcy. Don't let the truth get in the way of the story arc you've created and committed to.

Stefany Miley: "The Teflon District Court Judge"

I pity the poor judicial officer who had to hear the TPO. Attorney Chesnoff and client Miley? No choice but to deny the application.

Vegas, Baby! Life is easy if you're a six-foot tall bleach blonde.

Agree with 10:58, she will cruise to re-election.

That's all true, that due to her position and who she has as an attorney, that the TPO will not be granted.

But even if she were an average citizen, and were representing herself, my view is that the TPO should still not be granted. No real or viable threat. That said, I understand that in many cases these ex parte TPOs are issued even under circumstances more flimsy than this case.

Uhh … everyone's missed the basic question. How would the hearing judge shape the restraining order? Stay 100' away from Gale's residence or avoid Gale at the gym, it would be an impractical order. Moreover, this is a single event, no violence, only words that are not a direct threat. I agree, the attempt at obtaining a restraining order is pure theater.
BTW – Gale has a website up "Bruce Gale for District Court Judge". Look for more soap opera drama later.

I have known all of the parties involved (except for the boyfriend) for over 20 years. You are right, Stefany should have divorced Randy aka Ed 10 years ago when he slammed her into a wall and killed the dog. Instead, she had another baby by him. I would not trust Bruce Gale to watch my hamster, but Stefany needs to use better judgment. The TPO application did not allege sufficient facts to support the granting of a TPO. And Randy's behavior has been consistently disgusting. Poor kids.

Will the hearing court invoke RPC 3.1, frivolous – no basis in fact sanctions on Gale? Or is the matter too political for sanctions that may have been imposed on lawyers who are mere mortals?
