The commutation of all death sentences just occurred in Oregon. I cannot see Sisolak doing something that progressive or out of political touch with the state.

From a pure economic stance it is cheaper to keep someone in prison forever than execute them because of the costs of appeal and extent of appeals someone on death row gets.

You really think he’d put it on the agenda if he didn’t have the votes?

During law school I worked at a district attorney's office (out of state) in their death row appeals unit. The amount of time and energy spent on four death row appeals was astounding. Based on my experience, life without parole seems much better.

He has the power and is a lame duck. Why not just do it? Does he really need the Board of Pardons?

Yes. The Governor does not have the power to pardon or commute-only the Pardons Board

If you do away with the death penalty by administrative order, no defendant will plead guilty to life with no parole. They will force cases to trial or get plead down to life with parole or lesser number of years.

Unlike Oregon, the Governor does not have the unilateral power to do it. Hard to take the position that you want to see it used less (when it has not been used in 15 years) and then say I am going to eliminate it being used at all.

When I was attending the intro to law school where they walk us around campus, they walked us into the capital punishment clinic, I opened my mouth to say "which side are you on?" and then when I saw the blue-haired wokey wokes I shut the hell up. Once I later saw how liberal the school was, I was really glad I didn't say anything.

Applicants are up for Departments C (only 1) and N (4 applicants) https://nvcourts.gov/aoc/committees_and_commissions/judicial_selection/applicants

They need to repost. There can't be only one person that applied in Dept C. Why have a selection committee? Emily is a good choice but there should be some competition. Why not put all the applicants in the pool and then decide that way?

Isn't McFarling a well-respect name in the FAM law field? I haven't practiced in that area in a while, but I thought she was well-respected. Maybe others didn't apply because they knew they'd be up against her?

Omg MCFarling is one of those names that non-practitioners think is well respected but at most average within the regulars. As a 20+ year DR second tier (at least in my mind haha) I feel qualified to opine. Feel free to tell me to F off. She does the things that appear right and makes a good image but does not have the depth.

Emily is a good lawyer and she's always willing to take a phone call from a lesser experienced attorney. I don't always like some of her employees, but she would be a good choice. For Department N Stephanie McDonald would be a great choice. She's a good person and she's got lots of experience dealing with pro se litigants at the self help clinic. Invaluable experience for a family court judge.

Wow, I am stunned by the remarks of others about McFarling. I know her to have an excellent appellate record, she is a Family Law Specialist, and she likely earns more than double what she would be paid as a judge. I think we are fortunate that she is willing to throw her name in the ring. In my discussions over the years with Emily, I know she will not be a judge that rubber-stamps joint custody on case after case. She will listen to the evidence and will award primary custody when it is in a child’s best interest. I have no concerns that she will suffer from black robe syndrome, she is well grounded and knows who she is. I think her judicial temperament will closely resemble Duckworth. In my opinion she will be a top-tier Family Law Judge. I have been practicing exclusively Family Law for over 20 years.

As a long-time domestic practitioner, the manner in which 8:51 is so correct and 7:28 is so incorrect is nothing more than a reflection of the clubby nature of Family Court. McFarling would be much more similar in temperament to a Dianne Steel than a Bryce Duckworth.

I always think of the time I heard EM had her staff come out to celebrate her upcoming marriage and made them pay, including for her. Has influenced my opinion of her ever since.

5:59 back. If u look closely at comments it supports what I said. She LOOKS good w image but to those who really know her she is average, I don’t dislike her at all personally and she is functional I’m just saying her image is A+ but comparative excellence is C – imho – firvgive typos on iPhone

@12:45p, December 6, Gianna Orlandi was running her own firm with the non-attorney involved: Legalify Law Office. See: legalify.com (The paralegal, Edward Clint Allen, scrubbed the website after the State Bar filed against him for Unauthorized Practice of Law). The Wayback Machine, https://archive.org, has plenty of old screenshots of the website as it used to be.

The paralegal is now operating a new website, paralawist.com. The disclaimer toward the bottom of the page is something else, and reads like Allen's daring the State Bar of Nevada to take action against him. If that was the objective, it worked.

For approximately one week in July 2020, Orlandi partnered with now deceased attorney Stephen A. Bowers, who also operated his own solo private practice, the Law Office of Stephen A. Bowers (no website). Bowers was also facing permanent disbarment prior to passing away in Washington County, Utah this past February. In proceedings before the State Bar of Nevada, Bowers directly averred that Orlandi received illegal bribe money from UNLV/NSHE for the purpose of engaging in felonious subterfuge of civil matters which Bowers had been retained on (Orlandi was unlawfully inserted into the matter without client consent, as directly confirmed in the Supreme Court of Nevada's disbarment ruling).

Directly precipitating her disappearance and abandonment of the practice of law in July 2020, Orlandi had successfully uncovered direct evidence of LVMPD engaging in theft of private property, which LVMPD inadvertently admitted to in writing.

@6:20 p.m., Simply stating facts. Draw your own conclusions. I have no idea what happened, and don't pretend to. I have theories, but they're mine alone.

This seems somewhere between contradictory or oxymoronic " Simply stating facts. . . . I have no idea what happened".

@9:42 p.m., both things are true, and are true simultaneously. Everything I've stated on here is provable, verifiable fact. That said, I do not know what happened to Gianna Orlandi. If you do, enlighten all of us.

This sounds similar to the incoherent ramblings of a couple of Bowers' former clients who've engaged in a ongoing and losing battle with UNLV/NSHE. They've been tilting at windmills for years, and getting nowhere.

@9:42, what's with the semantics? I've done my best to provide as much information as I'm privy to. I responded to direct questions posed, as best I could. Are you upset that LVMPD may be implicated in a disappearance (and potential homicide)? It's not like that would be the first time in the recorded history of Clark County.

Seriously you have made me chuckle because asserting that one is "just stating facts" about which they "have no idea" is funny. "I am an expert in things about which I know not." I am not upset by any of this thread because I do not know any of the people or allegations or underlying issues. With that said the vociferousness with which you have responded to this thread does indicate you might have a bigger axe to grind than Paul Bunyan. I hope you find justice or peace or whatever you seek. As for me, this is just a law blog.

You are convoluting two separate issues. See post at 3:57 p.m., December 16, 2022. Cite one verifiable fact that you are disputing. As far as I can tell, nobody perusing this law blog has any idea about the current whereabouts of Gianna Orlandi. Except for Edward Clint Allen.
