Is there a more misused and less understood claim than civil RICO claims?! I have read more nonsensical RICO claims in complaints than almost any other type of claim.
No surprise for four of these – Stoffel, Hughes, Leavitt, & Kurth. At this point they seem to pretty much be running for the name recognition with potential clients.
Same with McFarling who is coming off of a failed judicial election in 2022. Stoffel did not run in 2022.
Add Brewer, Ganz, and Moors to that list. And McFarling did not run for election before, she put in for the Supreme Court appointment and did not make the finalists.
Isn't Rhodes-Ford the attorney who Johnnie Rawlinson publicly "anointed" as her successor in the Ninth Circuit last year, when Rawlinson said (1) she didn't want to retire, (2) if Rhodes-Ford were to be her successor she would step aside, and (3) basically claimed that the recommendations of Nevada's two U.S. Senators wouldn't be all that important to the judicial nominations process?
This was not the first time this relatively recent, and extremely troubling, trend of federal judges dipping into the political arena by trying to publicly appoint their own successor has occurred, nor was there any indication at the time that Rhodes-Ford had anything to do with Rawlinson's shocking announcement. But I hope the Nevada selection panel at least asks Rhodes-Ford some very direct questions about that issue during her interview, and that she will answer those questions with equal directness. Judicial seats ultimately belong to the people, not the judges who happen to occupy them temporarily.
Preempt jason stoffel
Do you blame anyone other than the perennials for not running? Our own legal community anonymously skewers each other regularly like rabid high school girls.
You think Lombardo is likely to appoint Ford? Yikes, if yes. I think highly, highly unlikely. If she gets an interview, she should be asked about the tax lien, in addition to the questions posed above.
2:38 I don't think anyone much cares what the people on this board think or say about them, but I don't blame good candidates for not applying. I can't imagine how demoralizing it is for good candidates who step away from lucrative law practices to spend a year or two on the bench, then spend countless hours campaigning and raising money and kissing ass only to lose to an inferior candidate whose name happens to be alphabetically before theirs, among other ridiculous reasons. There is no answer to this fiasco other than the Missouri plan and we will never get there. We are in a judicial death spiral at all levels (see 1:34 above).
Anyone defended a personal injury case assigned to Judge Lilly-Spells? Any thoughts on whether she understands the law and is fair? Would you preempt her and why or why not?
Honest answer: she is terrible. But peremptorily challenge her for who? Ballou? Escobar? Trujllo? Israel? Out of the frying pan and into the fire.
@2:49 – I laughed until I cried at the truth of this comment.
We preempted a business court judge a while back, and we got the Kish of Death.
Bob Cerceo would be an excellent choice for a Family Court seat. No on Kurth. No on Gaudet. No on Hughes or Brewer.
I want to second Bob Cerceo. Great choice.
McFarling, Cerceo, and McDonald…all good choices
IMHO not McFarling. All hat as some say.
Cerceo would be fantastic. Great demeanor and good man. Started and learned under Marshal as I recall.
However, both Hughes and Kurth (who is finished with Cerceo joining the run) would be solid calls for judge. Kurth MIGHT suffer from some eventual robeitis, but he is a good guy and I think it will resolve itself.
McFarling would be a disaster.
The only potential drawback to McFarling might be that she’s smart and knows it. She runs the risk of turning into a DicTator like certain other smart family lawyers turned judge. If she can rein that in, I think she’d do a stellar job. She’s got the brains and the experience for it.
9:10 you think McFarling is smart. You poor, poor little man/woman. Damn life must be hard for someone who thinks McFarling is smart. I have seen her in Court looking puzzled and thinking some simple concept through for 30 seconds at a hearing before uttering nonsense that shows she could not comprehend the nuances.
9:10 here…She built a very successful, multi-attorney firm w a great reputation, she has a healthy and successful appellate practice, and her QDRO prep business is better than that other guy who thinks he’s the master of QDROs, but you allegedly saw her have an off moment in court so clearly that means she’s an idiot. Ok, dude, whatever you say.
I am a family law practitioner. McFarling's firm and McFarling herself do(es) not have a "great reputation." She is a fine middle of the road attorney. She is not terrible. She does have family law experience (unlike a couple of the other applicants). However the fawning compliments would make me suspect that the call is coming from inside the house.
Oh dear god…I’m one of the ones complimenting her. I don’t work for her and I am certainly not her. I think she has a better reputation than some of the family law attorneys who routinely get effusive compliments on here. (Anytime I say anything honest about a certain family court attorney who got spanked by McLetchie and he who shall not be named at the Supreme Court, my comments get deleted.) She’s certainly better than the other options running against her.
Has the Honorable Michele Fiore had a calendar yet? Would love to hear more about the performance of the Learned Hand of Nye County.
I believe she got appointed for Jasperson's dept after he passed away correct? That would put her in Department B. Just click on 'Calendar for Department B'. If she's doing that calendar, it looks fun.
How is 2023 already 4.6% over? I feel like I have gotten nothing accomplished.
Sam of "Sam & Ash" hosts a conservative talkshow? Cannot believe that would be a good idea for a plaintiff's lawyer. https://open.spotify.com/show/2LcfRpEjtJmdPsYizJhuF4?si=79c95d5d92924b30&fbclid=IwAR3SfaelynO4dBRIzg39xVdnVj6BBc9lzuO54axYSZmS4Nql9UsPff6s-5w&nd=1
Sam and Ash show is a paid for infomercial and gets exposure presumably. Sometimes catch in the car and sometimes good content on legal issues. I think some of these shows are paid for by the sponsor/advertiser.
I dont have a problem with the infomercial as much as its so stridently right wing that I would think it would turn people off and be contrary to many personal injury clients.
Hooge as a judge? God save us all! He has all the experience I had two years out of law school. He was a DA in some po-dunk county and then moved here to prosecute those of us who actually practice law. Now he wants to be a judge? That combination of lack of experience and callous personality is a recipe for black robe-itis.
If Hoogie becomes a judge, won't all the attorneys he prosecuted while serving as state bar counsel file a preemptory challenge, thus leaving him with no court cases on his docket?
Kudos to the 30 or so people who have the guts to put themselves out there as candidates for the 5 (can you believe it, 5?!!) open seats in the EJDC.
Amen. I wish I had the nuts to do it. Kudos to each and every single last one of them.
