That KTNV article basically reported nothing other than three claims were dismissed. I get that reporters don’t have JD’s, but yowsa, that’s some empty journalism.

And given that it was Kishner, who knows why the claims were dismissed. Maybe the dismissals are substantive, maybe they are Kishner shibboleths. She is famous for exalting form over substance, for preening as the most intelligent person in the room and delighting in embarrassing the counsel before her. Maybe the dismissals were justified, maybe not. There’s no way to know.

I am not a Stage Door or Battista’s fan. But even the dumbest juror will be able to see that these business were effectively cut off from any traffic during the F1 run-up. Businesses like Ferraro’s I think have a tougher case. But Ellis Island and Battista’s have great cases so long as they can get past motions to dismiss.

Why is a proper defendant not the County (or perhaps the State, if any state-maintained or state-owned ROWs are concerned), as it was the government that approved ROW encroachment permits that functionally terminated access to certain properties? Regulatory taking or some other taking? As I understand it, takings cases can be difficult when it’s not a permanent and total deprivation of property rights.

Kiddo’s, I am looking for information on the annual Family Law Conference. Since leaving Biship (a third-tier location at best) it appears attendance is on a downward spiral. Does anyone know the numbers in Tahoe? Inquiring minds want to know. And is Tahoe the go-to destination for this conference? At one time the Family Law conference was the largest in the country. And why isn’t there a virtual component?

Last year conference in march, much better skiing at the end. Problem – 100 year storm is scaring them from returning during an appropriate time. Who wants to go to tahoe when it’s too cold to swim and too warm to ski??

Had an Appellate Brief rejected for not complying with the NRAP. Went to look for the rule cited in the rejection notice and they are not in any version of the NRAP that I could find. Turns out that the NRAP were amended 8/15/24. Where can one find the amended NRAP? Not the Legislature Website. Not Lexis. Even the Nevada Supreme Court website does not have a final version; it only has the ADKT which is 359 pages long with redlines.

The Nevada Supreme Court generally views publication of the notice of entry of an order regarding court rules in the State Bar magazine and publishing them in the same manner as court opinions to be sufficient promulgation. Westlaw has the updated rules, but as far as official state publications are concerned only the ADKT order and the paper advance sheets for subscribers are available at this time.

It would be nice if the legislature’s legislative counsel was more prompt at updating their publication of court rules, since that is the principal publication courts point users to, but LCB Legal is not known for speed in incorporating rules amendments or even codifying each legislative session’s enactments into Nevada Revised Statutes.

Curiously, I found it a week ago when efiling an appellate brief, it was in big red letters and you can get the redlined and clean versions.

As the OP noted above, this link is 359 pages long in that redlined format. There is no clean version even through the NSC currently.
