  • A $1 million suit says Elko County detectives exposed their confidential informant by including his name on a search warrant that was left on the table at the site of a drug raid. [San Diego Union-Tribune]
  • The US Supreme Court gave some borrowers relief yesterday by unanimously ruling that they have a 3-year right to rescind if the lender doesn’t deliver certain disclosures. [WSJ]

I should probably just post it in PasteBin…

The LGBT student group sent an email looking for board members. A student (who was sued for defamation earlier in her law school career) twice hit the reply all button asking whether the LGTB group supported marriage equality. Someone asked her to take it to a private forum, and she accused them of bullying her. Others chimed in, and she argued First Amendment and that people asking her to move to a private forum was gender/sex discrimination.

It was very entertaining.

I read some stories about Caesars Entertainment and many (if not all) of its subsidiaries filing for Chapter 11 bankruptcy in Chicago tomorrow and how certain unsecured creditors in Delaware are opposing such efforts. I am assuming that Caesars Entertainment may be incorporated in Delaware given that the unsecured creditors are most likely relying upon that factor for attempting to keep venue in Delaware. Given the principal base of operations and founding in Nevada, why are not the creditors fighting to have venue in Nevada?

Per the business reports they are filing along with 180 of its related entities in Illinois. Delaware only has the operating company. A venue fight shall be forthcoming.

Seems like the blog has in a small way been a reasonably positive and therapeutic vehicle for the legal community to mourn LSC and for those affected by the situation to vent.

It is somewhat troubling that the media have portrayed LSC's demise as some grand end-of-an-era celebration rather than as the mismanaged greed and chaos it really was. Serious question: Why is it that the media have refused to treat this as a scandal?

If they do indeed file bankruptcy, they'll have to do it within the next few days, since their receivership hearing is next week. Although bankruptcy supersedes most civil litigation, there's an abundance of case law that if a receivership is established prior to a bankruptcy being filed (usually a Chapter 11), then the receivership will stay and have precedence.

10:54 – Mismanaged? Yes. Greed and chaos? Most likely yes. What part is scandalous? What do you expect the media to report, exactly? If there is something to tell, we're all ears. I certainly wouldn't be shocked to learn there were misdeeds, but so far all we have heard is innuendo and vague, mysterious remarks.

First, how could you "miss" judge pollock (and no, that's not a fat joke, but that would also be appropriate); he was the worst judge in the entire family court (like from-another-planet bad). Aside from that, he hasn't even been on the bench in six months due to some medical issue (which, for some reason, allowed him to campaign, but not actually work as judge) with his brain (which disproves theories that he lacked one of those).
