We now live in a world where paying rent is optional. As someone who saved money, bought residential real estate, maintains that real estate in exceptionally good condition, and is respectful to the "renters' who occupy that real estate, am I an asshole for thinking eviction moratoriums are a bad thing? I'm a compassionate person and I'm lucky since my renters have actually continued to pay rent, but I do feel exposed. And I know that many of my fellow landlords are being destroyed by these ongoing eviction moratoriums. Many landlords will never receive their rent money and will have no recourse. It all seems very unfair to those of us who risk our own financial wellbeing.

I'd like to focus on that word, risk. It may not have been on anyone's radar, but that investment was never guaranteed. While I sypathize, I tend to think that, in the long run, life has favored you in ways that will see you survive these trying times in ways someone facing eviction may not. You may lose an income stream. Someone may lose their home. It isn't always fair, but then again, life never was.

When the investor undertakes the risk, he or she does so under the fundamental assumption that the law will allow him or her to evict a non-paying tenant. Those are the rules. A government-imposed eviction moratorium which changes the most fundamental assumption of landlord-tenant law wasn't part of the risk undertaken.

Imagine putting $100 on a blackjack table and being dealt ace/king and then the casino, at that moment, changes the rules to make that a losing hand. That's the eviction moratorium.

This conversation reminds me of the meme where the 1%er takes 24 of the 25 cookies and then tells the middle class that the poor guy is going to take his cookie. Why do we tolerate a govt that can cut taxes on the richest 1%, that doesn't tax corporations, and that spends trillions on an inflated military, but can't pass a relief bill to bail out working Americans. If McConnell would do his damn job they'd pass a relief bill and then the renters could pay their rent and the landlords could pay their mortgage. But it's definitely better to fight over that one cookie.

Yes, there is always a risk that renters will not pay or that you can't find renters. That risk is mitigated by the law, which permits evictions. The fact that the Governor has suspended the law is not a risk in the market. Effectively, the state of the market is now that certain landlords must subsidize tenants somewhat indefinitely–a taking. So in the grand scheme of things, the Governor has picked winners and losers. Banks-Winners. Renters-Winners. Landlords, many of which are retirees and middle class folks–losers.

Sympathy has nothing to do with it. You're a lawyer, not a law student with a mind full of mush. A contract is a agreement between parties enforceable by law. It creates mutual obligations and provides remedies for the breach of those obligations. Here, the law provides a remedy for breach of contract, but the executive has removed the landlords' access to the courts to enforce the remedy for essentially a year. It's not about the income stream that Sisolak has prevented, it's about the ability to seek redress. Very uncool.

Whoever you are, you do not understand fundamental taxation nor how business works. US Corp income was the near the highest in the developed world. The tax cut put it more on par with other countries. This incentives major corporations to keep their business (and taxable income) US based and not somewhere else, like Ireland.
Anyone who has a 401k, PERS or other retirement account benefits from corporate profits. Profits are paid out to you in the form of dividends. Without the 1% risking capital you, O'Stupid One, would not have a job and would be walking 3 miles to carry water from a well and spending the rest of your time pounding rice into flour for your one meal a day. You don't realize how truly privileged you are thanks to capitalism.

Sisolak's eviction moratorium constitutes a taking by the Government of the Landlords' property without due process of law and without just compensation. It is an unfair shifting of one of the burdens of this "pandemic" to the Landlord class instead of to the public in general.

I understand the policy concern that evictions will result in further crowding in homes of the evictees' relatives and in further homelessness, but the burden should not be the landlords'.

Hello Everyone — Is it not clear to you all that this is a huge problem for EVERYONE, and there is no good solution? The property owners are feeling the pain now because for them it's like having your adult children living in your house for free; the tenants will feel it later, because they are going to get evicted eventually because they don't have the money to cure the arrears.

It is not a taking of any property right. You still own your property; the Directive says tenants are still legally liable for rents. It is the revocation of a remedy which is provided exclusively by the state and can be suspended by the state.

"fit" (gym and outdoor exercise daily), and is still suffering 4 weeks out with no idea what longer-term implications are for my health, F()ck-You to hell and back. I don't want to just "survive," ok? I want to be able to work out daily, breathe deeply without coughing, and not have to monitor my heart for the rest of my hopefully long life. I've had the flu, and this is not it. Don't use the stats to downplay the severity of the pandemic. In restrospect, "only" 3,000 died on 9/11. Should we as a nation not grieve? Should we not have changed the way we live?

11:43– I am right there with you. Gym fit and got it. Came down with it right before Thanksgiving. Still not back to normal. The 99.9% survival rate is not accurate; the rate is between 1.8-2%. I got into the Regeneron study luckily but am being monitored for 6 weeks.

You are right. We are suffering a 9/11 everyday of every week of every month right now. Battle of the Bulge the US lost around 500 soldiers a day. Gettysburg we lost around 1000 Americans a day. D-Day we lost 2500 soldiers on that one day. We are experiencing a D-Day every day of every month of every year. At this rate if not slowed we will lose 1,000,000 Americans in a one year period.

I read these posts from people terrified of COVID and wow, how out of touch with reality can you get? Sure COVID isn't great, but the negative effects of these lockdowns are far greater in scope and magnitude. Like sorry you had a cough, but at the end of the day you probably took maybe one sick day, then worked remotely and your livelihood was left unaffected. What about people who did not go to law school? I know so many service industry workers who are devastated by the lockdowns. They are not making any money right now, those who still actually have jobs anyways. I know people who made decent money and were doing fine, now they are moving in with parents, leaving the country, and so on. What about blue collar folks? A positive COVID test means two weeks without pay, no remote option for those folks.

So here is an idea? Are you terrified of this global pandemic? Stay home. Don't go out. Good for you. But let the rest of us decide for ourselves. Deep down you guys know what would happen without the lockdowns right? The vast majority of people would just go back to normal, the economy would recover, and the world wouldn't end.

Utilizing that same tortured logic (and misunderstanding of statistics), one could also claim: “The virus is 100% fatal for some people.” Both statements, while possibly true, convey nothing as the qualifiers render the percentages meaningless (and this, my mathematically-challenged friend, would be true 100% of the time).

@9:36 needs a lesson in statistics. Making a statement using a percentage (such as 99.9%) of anything less than the whole (such as "most people") conveys nothing as the undefined qualifier ("most") renders the percentage provided meaningless. For the statement to have meaning, the qualifier ("most") must be provided in either a percentage or a decimal. This would allow someone reading the statement to convert both percentages to fractions of 100 (or to decimals), and multiply them to determine the weight to be given to the statement. This was a point lost on the attorneys representing the Trump campaign, but not on the law clerks and judges forced to read their barely-coherent filings.

I used to care about these "polls" and the atty awards – Super Lawyers – that sort of thing until I realized my large firm could game the system by hand selecting which "associates" they decided to prop up that year and all voting. A bunch of bullshit. There are some good lawyers that appear on these "lists" and good firms, but most are the chosen ones by their large firm.

10:57 – correct. I saw a stat this morning that nearly 80 percent of repub. voters believe the election was stolen. I have to believe those polled are getting their info straight from the sources- the affidavits, the testimony, the Dominion forensics, etc. I also have to believe if the MSM would be reporting the facts, there would be no question among all of US voters. The election was – in fact – stolen.

I find it telling that most republicans swear by all the "the election was stolen and we have to overturn the votes" shenanigans but when push comes to shove the high-level GOP members like AZ, NV, and GA governors or secretaries of state who CAN do something about it but have actually taken an oath to uphold the law and the constitution and have a job to do are the ones who push back. Anybody can yell unsupported conclusions, but to do what 45 and the Newsmaxes of the world want them to do would require them to break the law.

Easy to criticize when you don't have real skin in the game, and much tougher to overturn an election when it's you who would be on trial after it fails.

Most Republicans understand that this was an election and we lost the presidential election. We averted a possible landslide in the Senate but the presidential election was never in doubt in Nevada. Most of the "republicans who are still talking about it" say the election was stolen. The rest/majority of us are simply not still talking about it because there is nothing to talk about.

As a former GOP member who now sees zero resemblance to the once great party I used to belong to, I disagree with 12:51's belief that most republicans aren't still hoping to overturn the election. I would say over half of my republican friends are still clinging to this BS. The new hardline GOP news outlets and "youtube constitutional law experts reporting in their cars who somehow have thousands of followers" are absolutely poisoning the minds of the GOP. 2:14 – I find it hard to believe that you are actually infighting with any republicans about election fraud. The national GOP isn't "bullshitting" anyone. While I understand it takes a little more time to find the evidence due to all the censorship – the evidence of massive is there- for the taking. The Dominion system alone was rejected by multiple states due to its susceptibility to fraud. This occurred in many states after much debate. Now, if you cared to review actual facts- you'd see some democrats debating against Dominion as well. Fast forward to the states who used the machines along with mass mail-in voting and you have the perfect storm for election fraud. Someone made the comment about some GOP leaders not supporting the efforts to "overturn" the election. Well no shit- those GOP officials – such as the Gov of Georgia and the Secretary of State of Georgia have been exposed in their support of the Dominion voting machines. Thousands of dead people voted in Nevada. That's a fact. You are not "100 percent for election integrity" or you would support forensic audits of the voting that took place in this election. Instead you're eating the popular position up – you're taking the easy path. I do not believe you're suffering any heroic trauma by saying "Biden won the election, get over it"…simply because that appears sane to you. Dare to look at the facts, or don't. But don't pretend you care about election integrity in the face of reports such as the one released by a judge today in Michigan. Read that yet? It's a doozy.

2:14 – if you "100 percent care about election integrity" then you would pay attention to the evidence that this election was a massive cluster fuck. Certify Biden as the winner, so be it. But don't pretend that massive mail-in voting along with voter machines designed to be manipulated (something pointed out by the democrats by the way) resulted in a reliable election result. I hope the repubs keep the senate because if that happens I believe there will be a complete investigation into what occurred. As a citizen, I want assurances that elections are secure. I have seen enough evidence to know that this election was not secure. Argue about it all you want, view the evidence how you want, but if you pretend there is no evidence you're just sucking the main stream media wind. You won't find the evidence anywhere but on the state websites – such as the Michigan courts. Or – the few conservative outlets that get panned as conspiracy cites. Fox doesn't even report half the evidence. Why? Because the easy path to take is the path the mainstream media is taking.

I listened to Sisolak yesterday and what I heard was that the State can't afford a shutdown because there is no federal help. He spent extra time explaining this is why casinos are still open. It also appears the state doesn't even have enough money for another week of unemployment, so is he relying on those businesses to just keep paying everyone? Is that what is going on? Am I missing something?

Yes, where do you think the State gets revenue? DMV fees alone are not enough.

12:07, you are missing that Sisolak is going to steal another three months of rent from landlords to keep landlords from evicting non-paying tenants because it would create a further Covid crisis if the non-paying tenants were evicted. This does not cost the State anything because the landlords are being deprived of their contract and property rights without any compensation whatsoever.

Do you buy Christmas gifts for your boss? I can see buying one for the assistant and paralegal but is it necessary to buy one for my boss who makes a lot more than me?

I bought a gift for my boss once because I thought it was funny. Ended up being awkward and I'll never do that again. Send them a Christmas/holiday card if you're feeling its necessary. Or if there are several of you, go in together and get him/her a bottle of wine (or something non-alcoholic and no caffeine if he/she is Mormon).

Anyone have any guidelines for the new moratorium? Will no cause evictions be allowed to go forward? They could not under the governor's first moratorium, then they were allowed under the extended moratorium. Any ideas about this one?

Sisolak's latest Emergency Edict has not yet been posted on his website, so I have no idea what the actual provisions will be. Sisolak's office is very slow to post his fiats. I sort of remember something about the need to promulgate laws, but these are not laws (not enacted by the Legislature).

He said he would issue his Emergency Directive before Midnight tomorrow night. There are evictions being heard on Wednesday so I hope so wastes no time letting us know what is barred and what is not.

No. 30 day and 7 day "no cause" are included in the moratorium. Not allowed to evict. The landlord can challenge under sections 5 and 6.
