As to Denton, I always liked and respected him, but the past couple of years, it seems to me that he has kind of been mailing it in. I still like him, but at his age, I have a hard time seeing him being interested in it.

Bare and Tao are exactly the same intellect as Saitta. Silver is a climber. Tao is a climber. Cadish is intellectually sharp enough to be able to do it. Herndon would not be the end of the world. Gonzalez used to want it but probably could not stand to be around the other Justices and the politics of Carson City. Denton is nice but is past wanting to engage in heavy legal writing for a Justice position.

Herndon isn't going anywhere. I appreciate that everybody wants him to move on to bigger and better things but its not going to happen. He rolls in when he wants, knows how to move his calendar, and is well respected. Why leave that for more work and a schedule that requires him to show up at a certain time?

I did an oral argument in front of the Nevada Supreme Court almost 6 months ago. Justice Saitta was on the panel. I wonder when I can expect my decision – good or bad – since she is now retired.

I understand that all 3 appellate judges have a "handshake" agreement that they would not seek a SC seat until 2018

A handshake agreement isn't worth the paper it's written on, particularly when personal ambition is involved.

If history is any indicator, one of the three appellate judges will fill the seat and there will be another appointment there. Herndon, Cadish, and Togliatti would all be good choices. Betsy wouldn't be caught dead in the appellate court, Denton might be interested though.

Betsy made no secret that she wanted Shearing's seat when she was retiring and wanted to skip the District Court level. After all of the issues in Carson City and personality dynamics, I agree with you that Betsy wants no part of it. Get her DC Pension and then head over to JAMS.
