There Ain’t No Such Thing As Free Parking

  • In what might be our first fun class action possibility of the year, Las Vegas Motor Speedway parking attendants, backed up by Metro and State Police (unclear if they were all on- or off-duty), kept thousands of people who parked in the free parking for Sunday’s Nascar Kobalt 400 race confined in the parking lot until an hour after the race ended. This included people who tried to leave an hour before the race was over and an elderly couple who needed to attend a medical appointment. LVMS President Chris Powell blamed it on a communication breakdown. Plaintiffs’ lawyers across the valley responded by revving their engines. [RJ; MyNews3]
  • The State Bar of Nevada:  working hard to make sure you don’t lose your license for advising clients on medical marijuana issues (with a proposed change to the Rules of Professional Conduct). [RJ]
  • Metro is being sued by a woman who suffered third-degree burns on her legs when she was forced on to hot pavement after a car accident. [8NewsNow I-Team]
  • Fines are being levied pursuant to a stipulation signed by Mandalay Bay COO after Gaming Control Board undercover officers were able to get drugs and sex at the House of Blues Foundation Room. [RJ; Las Vegas Sun]

NRS 200.460 "False imprisonment is an unlawful violation of the personal liberty of another, and consists in confinement or detention without sufficient legal authority."

Not sure onduty officers would be guilty of this.

Without sufficient legal authority would also seem to go to why they did it. If there was no compelling reason, other than "the speedway told us so," especially since the officers in the parking lot are actually there at the request of the speedway for crowd control and there only duties in the parking lot are to enforce the will of the property owner, then they miight be on the hook too.

While law enforcement isn't likely to be guilty of the crime of false imprisonment, which is what NRS 200.460 defines, they can still be liable for the tort of false imprisonment and/or civil rights violations related thereto.

We all do know that there is a difference between criminal and tort law, right?
