  • Nearly 80 candidates filed for the Eighth Judicial District Court yesterday. Only Department 29 hasn’t had anyone file yet–one of just a few departments where the siting judge did not file on the first day. The empty departments are the ones drawing the most candidates. The whole LCB / legislature suing thing is ridiculous. The legislative branch should not even be a party (whether as individuals, LCB, the legislature itself, etc.) to lawsuits challenging the constitutionality of statutes. The Nevada Supreme Court should hold that it had no standing, nor do any of the senators, to sue or be sued. It should be a private party suing whatever executive branch agency enforces the law.

Taxpayer funds shouldn't be paying for partisan litigation between our own lawmakers. I'm half tempted to find a way to file an amicus brief in this appeal. This nonsense has to stop.

Judge Scotti's error was not as to the content of the point he was making(which was essentially correct–courts should have little patience for manipulated attempts to be excused from jury duty) but the error was the manner and degree to which he was expressing it.

He really over-reacted by throwing the pocket constitution and hollering about prospective jurors going home at night and "fabricating shit" so they can appear the next morning and attempt to avoid jury duty while being examined by the attorneys.

But the reporting on this by the media, as well as the NSC opinion, just focused on Scotti's gross over-reaction, while totally ignoring the huge issue just below the surface–the dynamic he warned of was in fact occurring, and continues to occur in many cases.

For example, that nurse claiming she would not be able to be fair and objective in cases where children are victimized, and could simply not emotionally handle it . She said nothing about that the previous day, and in fact indicated she could serve. But she went home, and by the time examination continued of her the next morning, she indicated she could not be fair and would not be able to emotionally deal with the issues.

I call foul on that. Scotti was right. If only he hadn't gone bonkers with how he expressed his views and frustrations.

As the news recently reported, even the pope sometimes doesn't show the patience of a saint. I watched the video and while there was no call for the vulgarity I agree with your point.

The incident with Scotti was not isolated. It's not like he's a great judge who had one bad day. He's a mess, lacks a judicial temperament, and makes bizarre rulings regularly. This goes far beyond a potential juror trying to get out of a trial.

Attorneys are infamous for saying someone better should run for his or that, but then when some decent candidates do emerge based on attorneys encouraging such candidate to do so, the attorneys wind up doing little or nothing to support or contribute to such candidate.

It is not enough that you would be willing to vote for someone who you would consider to be a more solid candidate. Campaigns are absurdly expensive. Are you willing to make financial contribution if someone files who you would consider a more viable candidate?

Sweetin, in DC 23, seems like a well experienced candidate.

Newberry and Reynolds, in DC 21, both seem well experienced civil litigators.

Experience does not always equate to quality. Some people have spent many years being unreasonable, difficult, and unprepared. I'm also hoping for better candidates in 21 and 23 (and also 4, 14, 18, 19, 20, 22, and 32).

In some of these races, there are Departments where I do not recognize one single name among the candidates. Not one. Department 2, for example. And I've been around for awhile. Maybe they are all DAs or PDs.

One DA, one PD and one private criminal defense lawyer, most just a few years beyond the minimum experience requirement. That would explain it.

Las Vegas is a cesspool of practicing attorneys in a broken criminal and civil justice system most appropriately described as parasitic at best.
Bob Eglet and his personal Eighth District Court lobbyist Dave Thomas have more influence over who sits on the bench in every department than the electorate.
The rewards for being a lawyer are alcoholism,drug addiction,insecurity complex disorders, narcissism,broken marriages, a whole range of physical health problems relating to anxiety and stress, a general self destructive life path.
Anything for the money… the most hated profession.

3:18 like any profession there is good and bad – I recently had a Realtor try to sell me a house full of f***ing termites that he knew about – inspection cost me $500 – now I've got to decide if I eat it or take legal action for $500 that I'd probably never collect anyway – so everything you said at 3:18AM I feel today towards Realtors

She remains the best judge on the Bench. I understand people who have issues with her demeanor that can be mercurial. I certainly can understand people who say she does not always make it easy in her courtroom. But to say she is a horrible judge who gets it wrong is simply not correct. She tackles complex cases better than any other judge on the bench.
