Seems like judges like to announce that bail was set and posted before they even saw the case because they don’t want flak for it. Criminal law is not my area, who gets to set these bail amounts and release terms at that point? Is that statutory? I wonder if the sting case will inspire a legislator to change the framework.
It has been a while for me, but about 4 yrs ago Justice Court began using non lawyer administrative releases. This was based on a scoring sheet largely developed by the NSC.
If OR release was not administratively granted, the detainee appeared before a Judge or Pro Tem. I may be mistaken, but I think the court was rolling the probable cause hearing and initial appearance into the same appearance.
All part of the bail reform efforts.
The lithium case is fascinating. You have a senior justice (not elected) sitting on a 3 justice panel to review a decision by a Senior Judge (not elected) who sat in the Second District sitting in Fifth District.
