Lets be real, Metro hardly does anything to begin with. It’s not like they were going to convert into a crack immigration round up squad anyway. Headline should say, “Local police force who does nothing, will continue to do nothing.”

I don’t think its the day to day cops.
Its the “Not my job!” culture of Metro in general.

Is this a union issue or a brass issue? is it concerns about civil liability?
Honestly I do not get it. Metro was great to deal with in the 80s and 90s. Of course, I was a mildly rambunctious teen in the 80s and am to this day deeply grateful for those common sense cops.

It all started with refusing to respond to non-injury accidents, IMHO.

Judge Israel STILL hasn’t ruled on the LDS Church’s Motion to Intervene in the Mormon Temple lawsuit. There’s also a pending (slam dunk) standing MTD from the City. It seems like he could make a potential procedural mess for appeal if he grants the MTD before the motion to intervene. There is no stay in place, or even motion for stay, so the LDS Church can obviously proceed with pulling permits and then work on the property, but I suspect they are voluntarily waiting for the lawsuit to be dismissed in order to avoid looking like the bully. So I guess construction will be delayed for an unknown number of months while we wait for simple and obvious rulings on intervention and standing.

Well, the hearing on the petition is set for 6 weeks out. Hopefully he’ll make a decision by then. The briefing on the motions to intervene and to dismiss have already been completed for four months, what’s another 6 weeks between friends?

Except that the Mormon Church hasn’t been able to substantively brief the issue. That’s where this becomes a mess if the motion to intervene isn’t resolved soon.

Case in front of Judge Israel is a mess? Quelle surprise! I was in front of him about a month ago where counsel on a case seemed utterly baffled because he started giving his tentative ruling and then asked for argument on motions that were not on his calendar on that particular date and then when the parties asked to address the motions that were on his calendar stated that he had no idea what they were talking about. I presume Plaintiff and Defendant knew what matters they were supposed to be arguing because they seemed in agreement as to what was supposed to be argued.

I predict that Judge Israel’s mismanagement of the temple lawsuit will further aggravate tensions in the northwest part of the valley. I further predict that his chaos will prolong the lawsuit and complicate the appeal, giving false hope to the temple opponents.

Judge Israel could take care of this with very little work. Immediately grant the motion to intervene. Let the Mormon church file a substantive brief. Then, dismiss the case for lack of standing, but offer dicta that the Court would defer to the City Council and the democratic process.

Will Judge Israel do that? No. He will make more work for himself and everyone else. The good news is that Todd Bice is a nice guy and will get paid in full for all of this, which should make all of us happy. I am guessing that Todd’s opposing counsel will not be paid in full.

How many times have you showed up in his Courtroom and he pulls an Escobar and is not in the courtroom himself. His rulings routinely reflect that he has not read any of the pleadings.

I filed a motion. The other side opposed. My reply deadline came and went. It was not calendared by my staff.

Is it better to file an untimely reply, or no reply at all? Per the rules the reply isn’t technically required, but I’ve never not filed one or see anyone else not file one.

It’s in federal if that matters.

In Federal Court, no way is late okay.

In Family Court, you could file your Reply a minute before the hearing and it would not be a problem.

This is why I stay out of federal court. The judges and practitioners are levitical when it comes to stuff like this. I’m more of a Romans 3 practitioner myself, saved entirely by grace, not by works lest any attorney should boast.

File a motion to file a late reply. The judge will likely grant it. Don’t just file the reply, or you will get your ass handed to you. Get the court’s leave first. All will be well.
