Statewide Judicial Races- 2020 General Election

 With less than 2 weeks before ballots are mailed out and only 40 days until the general election, it’s time to start talking about contested statewide judicial races that will be on the ballot. (Here are links to the endorsements from the RJ and Las Vegas Sun.) We welcome your comments on the qualifications of the candidates as well as any information you can offer to help voters make an educated decision. Just remember to keep your comments appropriate and defamation-free.

I second the support of Susan Bush for Nevada Court of Appeals. I know her, I have had cases with her. She has civil law and criminal law experience. Also, she is not taking donations during the pandemic. She has my vote.

I stepped away from the blog for a few months as blog became political (reading the last few days messages, I see that hasn't changed) and as practice got busier. Quick question:

Is anyone still working from home?

If yes, any idea how much longer?

Yes, still working from home. going in once a week or as necessary, but don't expect this to change until vaccine is widespread. Next summer, maybe?

Mid-size firm, been back in the office full-time since mid-June. Most think we should still be able to work from home, but leadership feels different.

12:56 here–regional firm with over 100 attorneys firm wide. There is a mix. Staff take turns coming in so there is at least someone in the office, a few attorneys are in the office every day. A few are doing what I do. Overall, the firm is still fully in the remote working phase and expects it to continue into late next year. I know this is the case and some other larger firms too where they are not expecting a return to normalcy anytime soon

Solo. About 50/50 between home and office. I've really adjusted to working from home and will probably continue to maintain that schedule as much as possible. I've been told that Farmers house counsel is not renewing their lease and they'll be at home permanently. I probably would not want to be in the business of leasing office space right now.

While Doug is an excellent Judge and a nice guy, being involved with sending an innocent man to prison for 22 years has to give my vote to Fumo.

True; Herndon sent an innocent man (that time) to prison. But Fumo has been putting guilty people back into the community, and arguing for reduced sentences for same for years.

Which one is responsible for the greater harm?

Bonus points: See if you can answer without citing "muh constitution."

I was thinking the same thing 12:50. Criminal defense lawyers serve as one of the most important checks against government tyranny in our system. So no, I won't knock Fumo down for being a criminal defense attorney. It's important work. That said, I'm voting for Herndon because he's a damn good judge.

12:07–make sure you read what 12:50 and 12:53 wrote. You kind of act like an angry lay person of limited analytical skills, not an attorney.

Are you serious? The one candidate willfully withheld exculpatory evidence, and an innocent man served 22 years in prison.

But you are saying that Fumo is far worse because he is a criminal defense lawyer who is committed to put the scum back on the street so they can re-victimize?!

The people who say things like that are often super extreme right-wing knuckleheads of real limited education and intellect. Are you truly an attorney? What did they teach you in Criminal law, Constitutional Law, etc.? What is the name of this law school that helped shape a mind like yours?

Is that REALLY your view of the constitutional purpose of criminal defense lawyers–to gleefully put violent scum back on the street for fun and profit?

And it gets even worse because you indicate you understand the constitutional arguments but don't want to hear them in response to your "all defense attorneys are dangerous scum" argument. It seems that people don't like Bonnie Bulla because of their experience with her in discovery disputes. Resolving discovery disputes is far different than appellate work. I haven't been before her as Discovery Commissioner. I knew her as a lawyer and have reviewed some of her work as an appellate court judge. She has my vote.

I think the Nevada Supreme Court needs Ozzie Fumo. He has been a private practitioner (although mostly criminal). Ozzie cares. He is smart and he has a sense of the impact that decisions have on real human beings.

I was in front of Bulla years ago and opposite me was the former first lady of Henderson (as they called her back then). Bulla said, on the record, that she had known for many years and therefore believed opposing counsel in a discovery dispute. I will never ever vote for her. It was humiliating to have her proclaim me a liar in a crowded courtroom and entirely unnecessary.

Agree re Bulla. Of course, I can't prove it, but I believe that she once had her bailiff purposefully position himself in anticipation that the counsel she was about to sanction would take some inappropriate action toward her. My recollection is that the scenario did not support the severity of the sanction. I recall being struck by two things: 1) Why is the bailiff positioning himself; and then 2) Did she have the bailiff purposefully position himself? It was weird.

Bonnie Bulla was not a judge before she was appointed to the appellate court. She has no business being in the Nevada Court of Appeals. She was a hearing master. She is ruling on cases she decided in the lower court. That is unethical, and the Nevada Supreme Court is allowing her to do it. Bulla must be voted out.

I am voting for Susan Bush for Court of Appeals, because she Is a UNLV grad. I also support her, because she is smart and had her own firm. She is not taking donations, so not an endorsement wonk.

NSC Seat D is depressing. The state's candidate pool couldn't put anyone forward good enough to beat a man who sent (and kept) an innocent man in jail. Embarrassing. I don't blame Doug for his hubris in running for the highest court in the state. I blame the rest of us for not finding anyone better.

Usually the person who notices the deposition pays unless counsel reached a prior agreement.

I try to convince the other side to notice the depo so that they have to pay for it. I take good notes and then hold off on ordering the transcript until it becomes absolutely necessary to do so. If they attach the full transcript as an exhibit to a motion, then all the better for me.

Just call the 3rd party. Maybe you don’t need the testimony. Get a declaration for impeachment purposes if you believe they could change their testimony. If you need the testimony then pay the $500 to take the depo. If you can’t afford that, then get Co-counsel who can afford costs.

I work for one of the Nevada appellate courts, and I am supporting Susan Bush for Nevada Court of Appeals. I see the opinions more than the average attorney, and we need new blood on the Nevada Court of Appeals. I am also a proud Democrat.

Your comment made me check the voter registration info for Susan Bush and Bonnie Bulla. Looks like they are both Democrats. If anyone can let me know which judicial candidates are Republicans, I'd appreciate it because that will allow me to eliminate them from any consideration whatsoever. Thanks in advance.

One time when she was DC, Bonnie sanctioned me over something that was complete BS and the fault of her unpleasant and borderline incompetent staff. It was $100 or something so I just paid it. Other than that instance I always thought I was treated fairly and reasonably, and that is generally what I observed sitting in the gallery watching the cases ahead of me. I don't get all the Bonnie hate. She isn't perfect but I'm not going to trade her for someone who is completely unknown to me.

I believe I am one of the swing voters who (as a group) decide elections. I was raised in a conservative home, changed to liberal during college, voted for Reagan, then Bill Clinton, kind of back and forth. I was set to vote for Biden until his no response to the rioters. I am quite sure no one cares, but my vote goes to the person who at least pays lip service to law and order – Trump.

When we talk about "law and order" are we talking about just the spectacle of riots on cable news or are we talking about ALL THE LAW. Because Donald J. Trump isn't exactly known for having a scrupulous approach to abiding the law.

Former Henderson Police Chief (who is a black woman) sues Henderson and its City Attorney Nicholas Vaskov for discrimination (2:20-cv-01761). I wonder if Vaskov’s novel defense of "we hired a black guy after her, so what we did to her doesn’t count" will end up being successful. Henderson government is a cesspool, and their attorneys seem dumber than rocks. Henderson has always been easy money for my clients. I see a 7 figure payout in this case.

I love how the city hires a black woman with no qualifications on the basis of her race and genitalia and then gets sued when they fire her for sheer incompetence and unprofessionalism. You can't win.
