  • Senator Harry Reid announced this morning that he will not seek reelection.  The immediate front runners to replace him are both attorneys:  former Attorney General Catherine Cortez Masto and State Senator Michael Roberson. [NY Times]
  • Back in November of last year, an inmate died at the High Desert State Prison. This week, autopsy findings were released indicating that he was shot by a correctional officer.  Additionally, the inmate was handcuffed with his arms behind his back when he was shot. The AG’s office is investigating. [RJ]
  • Here’s a look at an instance in 1990 where a district court judge did not recuse himself which may result in a new trial this year. [RJ]
  • Change is afoot at the DA’s office as prosecutors who worked exclusively on the Repeat Offender Unit will now start handling other cases. [KTNV]
  • Although the legislature is focused on the Governor’s new tax business license fee plan right now, there are a lot of other bills waiting for hearing that could impact you.  For example, SB 296, introduced by Senator Roberson, would prohibit the assertion of claims for punitive damages in certain pleadings in civil actions. What do you think about this proposal? [SB 296]

Roberson has certainly proven himself to be an enemy of the profession and our clients during this legislative session. He wants to revise the laws to protect the financial interest of the big guys, presumably donors, at the expense of every day Nevadans. And I say this as a Republican myself.

Roberson and Sandoval have damaged themselves greatly with shoving the margin tax down the legislative session's throat. Throw in their attack on the Metro Chamber and the Tax Foundations assessment that his margin tax plan was irresponsible, they've both lost some significant political capital.

SB296 would certainly put a halt to Eglet's multiple millions in highway robbery over distorted facts and accompanying slippery judicial assistance. Recent ridiculous medical puni awards have turned Nevada's courts into an embarrassment. This bill makes sense.

If you think you need to limit our constitutional right to a jury trial to stop Eglet then I feel sorry for you. We are willing to trust a jury with life and death decisions as they pertain to criminals but God forbid that the money of a big corporation or a murdering doctor be put at risk.

Why is it that med mal statutes of limitations are the shortest of all torts?

Spoken like a true insurance defense troll. Why would the limitation of punitive damages be good in our industry? We want more claims, not less. Without punitive damages, you can't file your standard motion to dispel them and grab the easy billing opportunity.

I cannot tell you how elated I am that Harry Reid is not running for election. He and his family are as corrupt as they come, except for the dog and the brother. I think that there will be more sordid details coming out why he is not seeking reelection, because I think the Reid family are a bunch of power mongers. I am going to sit back and enjoy the fall out of this, and I am a Democrat.

Definitely something wrong when two men in handcuffs are shot in the face and chest. They were leaving a shower area. The prison guard needs to be charged with murder of Carlos.
