I have to keep praising Judge Peterson and her staff. She and they are running a great operation in Department 8. I had a fairly long, fairly complex hearing in front of her. The minute order, very detailed, was posted within an hour of the end of the hearing. Great stuff.

That is fascinating. I have had 2 mind bogglingly ridiculous hearings in front of her where I was directed to prepare the Order and actually had to order the transcripts because the minutes took so long to post. Only Department 25 is slower. Department 8's rulings are oftentimes ridiculous as if given by someone who has no education in law but is 1000% certain that they are right.

Those are two entirely different things: 1) who will replace J. Gonzalez; and who will be the replacement Business Court judge.

The Chief Judge (Bell right now) moves judges onto and off of the Business Court. She will determine who takes over the open seat on B Court.

That should happen promptly and in any event much faster that the time it takes for interviewing/recommendation and appointment by the governor of the person to fill the empty seat in Dept XI.

Why is that though? Conflict of interest? Bias? He's a discovery commissioner; not exactly a Judge yet.

But yeah, I have been tapping into it using the wayback machine. Actually doing copypasta on parts of it too before it gets too old and maybe harder to access.

David Barron told Claggett at the start of the trial he was going to tear his heart out and defense the case. He has video showing the girl jumped in front o of the truck.

Claggett may sometimes be a d-b, but it doesn't mean he can't squeeze a jury for absurd amounts of money.

If the video shows the girl jumped in front of the truck, Claggett comes back and gets the jury to say that RS knew pedestrians walked in front of trucks, that they had training that would mitigate that risk, and they kept this particular unsafe driver on anyway in violation of their own policies. $50 million verdict.

The video shows the trash truck didn’t stop and the girl didn’t jump in front of it. Barron is an idiot and if I recall correctly both Bob Vannah and Dennis Prince have their largest verdicts ever against Barron. I predict $25 million and over $100 million in punitives. The driver was fired for being a bad driver, then rehired, then this happened immediately.

Why was the driver rehired if he was a bad driver? That'd be my reptile question. If it's because the NLRB or EEOC required it, then no damages lie against Republic Trash. Apparently the guy requested union arbitration and the company caved and rehired him without going through with the hearing. Then they put him back behind the wheel as opposed to some other position.

Yea, not sure what David Barron is thinking on this one. But the word is he thinks this is the case where he cuts Claggett down to size and ends Claggett's reputation as a trial lawyer. Maybe Barron has something up his sleeve.

Covid – Not to harass anyone, but just got back from visiting a relative at the Emergency Room at Desert Springs Hospital (I received special person due to the serious health issue and potential of passing). The Emergency Room is packed. Folks are getting treatment on chairs outside of the emergency room; beds are against the wall, individuals that have covid appear to be somewhat sealed in a part of the emergency room or in specialized rooms. It was a sad sight to see. I have heard accounts of such issues, but seeing it first hand has given me pause. To the extent that you have not gotten vaccinated, then I urge you to reconsider your position. If you know someone that has not gotten vaccinated, then I hope you can convince them to reconsider. Although being vaccinated may not prevent you from getting covid, it may prevent you from being seriously ill. Stay safe LVBL folks.

Meanwhile, we don't live in Denmark, perhaps you do. We live in a community of Las Vegas and things are not normal as to Covid. I get it that some people don't want to get vaccinated. That's fine with me, but I don't want to be around such people at this time. I am concerned about the medical costs that are being passed upon me, my employer and our community because folks are (1) not getting vaccinated; (2) won't wear a mask (perhaps not even washing their hand?). I now know more than a dozen people who got the vaccine, got covid and had no serious issues and not hospitalized. I know just as many that got covid, were seriously ill and were hospitalized. A number of them passed. If 11:36 is correct, which I believe is likely true, I wouldn't want to go anywhere near a hospital at this time.

That is a case of severely bad reporting. The report clearly states that the officer opened a kit to do the blood draws and observed two tubes with white powdery substance IN THE BLOOD KIT. This is a preserving agent for the blood, not narcotics!

The landlord had a valid question. Why was he there? Since the 'gummint decided to get out of the business of offering peaceful resolution to contract disputes, he took matters in his own hands. Actually yes. The masses are poorly educated (thanks to CCSD and similar), have not the faintest clue about how to resolve civil disputes, and easily resort to violence. There seems to be a national trend for imagined insult and violence. You can observe this everyday on the local and national news sources. Bitch slapping to shooting.

I think the point — if there was one — is that if the government deprives certain citizens of clearly cognizable rights in favor of another group of citizens, and further denies due process to the former group, it is foreseeable that some of the members of the affected group who are otherwise under much stress (that was not the mug shot of a happy man who meditates and embraces life) will snap.

Also, I suspect there's a bit of an untold backstory here. Drugs. Prostitution. Intimidation.

Well, slightly biased but more or less true, but not offered as a justification for murder. Landlords, particularly small property landlords are severely stressed. For many it seems that landlords don't have any rights. Landlords are required to provide rent free housing with no realistic chance of recovering lost rents but are expected to pay their own bills.
