For those of you not celebrating the birthdays of our many presidents today, here are items:
- On Friday we told you about a defense verdict in a products liability case involving a paralyzed plaintiff. The author of that post wrote to mention that the plaintiff made some significant recovery–the extent of which was a point of debate during trial.
- In Reno, Everest Indemnity Insurance Co. got a $4.5 million judgment against it in a bad faith action for refusing to provide coverage for a construction company’s defense costs. Tomorrow, they’ll start the punitive damages phase of the trial which could help determine how impactful this case will be in the future. [Courtroom View Network]
- In Nevada, just because you’re granted parole doesn’t mean you’ll be leaving prison any time soon. [RJ]
- Can employers, like Emeril’s New Orleans Fish House in the MGM Grand, require employees to be vaccinated against things like measles? [RJ]
- A federal judge in South Texas made a ruling on President Obama’s immigration executive action which seems to validate Attorney General Adam Laxalt’s decision to join the suit on behalf of Nevada. [AP]
Regardless of where you are on a final immigration solution, this was absolutely the right legal call. Separation of powers and all that. I bet it's killing Ralston that he was Article III owned and might have to say something positive about Laxalt.
I concur with 10:51. Either this is a nation of laws or it is not. If the People want to grant the President Putin-like powers, then let's call a Constitutional Convention and get the party started.
I concur in part and dissent in part. Ralston will never say anything positive about Laxalt. He has a crush on him that will never be requited. It's only exacerbated by the clash in politics. He's like Beezle in Movie 43, hairbrush and all.
Where was your crazy wild eyed tea party senseless rhetoric when Reagan and Bush 41 issued executive orders regarding immigration?

Jon Ralston is usually a fairly self-aware individual, so it's hard to understand his obsession with and hatred for Adam Laxalt. I sometimes wonder if there are some factors behind the scenes driving Ralston's campaign. Regardless, the whole thing is entertaining to watch.
Ralston's anti-Laxalt screeds are a bit hard to stomach especially since, given his ties to Miller, he should not be covering Laxalt at all. Kind of like him writing about Krolicki when Krolicki was running against Ralston's girlfriend, now wife.
I think Ralston's losing it. All this "my politico" piece "my rgj" piece, and the overused names like citizen outhouse.
I subscribed to ralston flash for a long time but next time it renews I won't.

I think part of the problem Ralston faces is that he answers to no-one. When conflicts of interest arise, as a 'journalist" solo practitioner, who picks up the story? So when his love interest is in the story, as a solo, he can either not cover it or cover it in spite of the conflict of interest. There's also no one to tell him when he's crossed a line, which he seems to do more and more. Normally, a superior like an editor, would step in in these situations. Ralston's situation is made worse by the fear other Nevada journalists have of him. Those journalists who even make mild criticisms of his work can count on a spiteful, very public retort. So, out of self-preservation almost all journalists steer clear and let him go unchecked. As a result, Ralston's immense talent is diluted and squandered and the public is left with less than optimal "journalism".
2:02 here – agree. He's talented but so undisciplined he's marginalizing himself. He's had some fabulous editors over the years who kept him in check but not any more.

I've never subscribed to Flash. I've seen a few when forwarded to me, and they are just too scant to justify spending a few hundred bucks a year. Recently, I even dropped Ralston's free blog from my RSS feed. The piss and vinegar now outpace the substance. I give Ralston credit that he often breaks stories first, but once he does, the stories end up getting more substantive treatment by real journalists like the RJ's Laura Myers. I am happy to wait a few hours or even a day to get the story from a real news outlet as opposed to electronic yellow journalism.

Seems to validate the point of law, but hardly a reason to join the lawsuit. It was already filed and the decision would have impact nation-wide.
Laxalt is making a political statement. Welcome to the next 4 years. Lots of big donors to pay back.
