He left a lifetime appointment (where he'd already been investigated and vetted) to become the governor of Nevada, and is currently the highest profile sane Republican governor. I think his aspirations lie in the Executive branch, not Judicial.

I agree with 11:41 that he was already exhaustively vetted prior to his earlier appointment as a Federal Judge, so it is highly unlikely there is anything of significance that he is concerned will be revealed. I likewise agree that he does not want to be used as a pawn whereby the Democrats try to make the Republicans look bad and obstructionist for stonewalling the nomination even when the Democrats advance a nominee who is Republican, and therefore should be acceptable to the Republicans. However, I wonder if his advisers have informed him that once you reject an offer to be appointed, or even if you simply ask that your name be eliminated as a potential nominee after you learn you are being considered, this usually results in not being considered or offered the position in the future. As time passes, the reasons you rejected being considered will no longer be well-remembered or considered. It will only be noted that you rejected the earlier opportunity. And presidents and their advisers even feel and act this way when the earlier rejection occurred during the administration of a prior president of a different political party. It appears to be one of those un-written rules. One should never reject presidential consideration no matter how seemingly justified, in the hope they will receive a similar offer from a subsequent president. It simply doesn't occur. If he's made up his mind he never wants to be on the Supremes, that's fine. But he should not bank that someone like Cruz wins the presidency and then appoints him. Cruz and his advisers will be aware that Sandoval previously rejected the opportunity, and that he was someone acceptable to a liberal, lame duck Democrat president. Plus,the ultra-conservative Cruz would almost certainly still have the benefit of a Republican controlled Senate. On what planet would he be interested in nominating someone moderate who was acceptable to Obama? Instead, he is guaranteed to nominate very conservative judges. And if Hillary wins, she won't have Obama's last minute, election year desperation to find someone palatable to both sides. With four years at her disposal she would make an initial couple attempts to nominate a more liberal justice. If those attempts don't garner a majority vote from the Senate, I suppose she could turn to Sandoval, providing she's not put off by the earlier rejection. Now if Trump wins, who the hell knows.

I hope that historical pattern(of not getting offered after you rejected an earlier offer or earlier consideration) does not hold in this case, and that Governor Sandoval receives, and accepts, a future offer to serve. He is someone largely respected by both sides of the aisle, and you don't find that too often.

Kim Wexler is one of go-to litigators at Hamlin, Hamlin & McGill. She went to law school at the University of New Mexico with one of my good friends, Howard. I had her as opposing counsel once.
