Not me. I would consider dying while representing a client the perfect end to my life as a lawyer. The only better death would be after a heart-attack level of lovemaking. Wait, why limit myself? Make love bigly. Go to court. Win bigly. Drop dead. Meet my maker who greets me with a high-five.

Anyone else see the notice about Harold Gowerter in the Nevada Lawyer? he was suspended, but Silver and Herndon dissented saying he should have been disbarred. Having dealt with him in the past, I am inclined to agree. Not that it really matters as suspension is basically disbarment in this type of situation.

Yeah…. taking $750k in trust, drawing from it without accounting, and billing the client separately from that? Not great.

Taking $10,000 (and still hasn't returned it). Also not great.

Substantively, the 4 year suspension is effectively disbarment, and he indiciated he's retiring. But still.

I admit that I am biased and like Harold personally as one of the old Vegas characters. If you read the pleadings before the Nevada Supreme Court, Tom Pitaro was his counsel and said that Gewerter threw in the towel and told the Nevada Supreme Court that he has dementia and is never coming back. At that point, it did not matter to the Nevada Supreme Court what they hit him with because he is never going to seek reinstatement. The dissent that found that Gewerter "knowingly converted client property" apparently did not read the District Court decision that found that it was earned fees.

Secondarily the Supreme Court's decision stated that Gewerter took $750,000 out of his Trust Account without an accounting while the District Court ruled that Gewerter was owed more than $750,000 by the client. I looked up the District Court case which found Gewerter was owed more than that amount and that the client had testified under penalty of perjury that the monies in question were not the clients' monies. Judge Gonzalez appears to have found that she made no findings regarding whether the lack of accountings and billings was appropriate under the NRPC. But he didnt steal the money. Gewerter appears to have worked for the client for years and years and had a client who acknowledged that the monies were not the clients.

In the end, this looks like another 4 year suspension for sloppy record keeping and not cooperating with the State Bar.

Thanks for the explanation. I hadn't been aware of the underlying findings by the District Court. Seems very unfair to him now.

12:59 You can't trust anything Harold says. Claims to have dementia, told me he had MS. On another occasion in another case, told me he had Parkinsons. He will say anything he needs to to get what he wants.

I was an opposing counsel to him on same cases he was handling before his suspension. He presented treatment records from the Cleveland Clinic. You can wish him ill if you wish. You can say he played creatively with the rules or surrounded himself with shady characters over the years. You can say he has cried wolf in the past and is not entitled to the benefit of any doubts. I understand the trust but verify notion. But he is actually sick. No one would roll over and just accept a 4 year suspension on a case where you already have a District Court order vindicating that the money was owed to you if you planned on coming back.

Sometimes, when I'm feeling bored, I'll do a search on the NSC's website for cases including the word "discipline." Sometimes I'm surprised by the names that pop up, including folks I went to law school with and others whom I respect. Sometimes, I'm less surprised.

They are confidential at the allegation stage until the discipline is levied and then they become public.

Officer involved shooting on the 15 today. Woman carjacked somebody, drove into a trooper, dragged him until he fell off. He was airlifted to UMC in critical, but he is stable. Woman was eventually pitted and the car was disabled. Then she got shot. A lot. She's dead, the video is all over social media. Prayers out to the Trooper and his family. We might be on opposite sides of the law but nobody deserves that. 15 is probably going to be a parking lot for the rest of the day.
