In Just One Easy Step…

Thanks to a column by Judge Togliatti in the most recent Communique, we recently (re)discovered that the Eighth Judicial District Court has its own blog! Though sporadically updated, it’s a nice thought. It’s a simple, cost-effective method for the Court to communicate with the public. (Whether it’s working or being used to its full potential is up for debate.)

It got us thinking, what is one easy and inexpensive thing/policy/rule/sign/etc. that our local courts could do to improve the system. You know–the kind of thing that you think why don’t they just ________ and all our lives would be easier?

I loved how previous Discovery Commissioners would report their Opinions. Does Bulla do that? I think it provides a lot of guidance as to how the Discovery Commissioner will rule when discovery disputes arise. I don't think Bulla does it, but I wish she would.

One easy step? Require every litigant to do e-filing, no exceptions.

Tell the clerks to file EVERYTHING. If something is improper, let the other party or the court kick it.

I see my "This." comment was removed. It wasn't a typo – I was my shorthand way of saying: I completely agree! There is no excuse for documents sitting on queue for days when in the old days of counter filings, items were automatically stamped "filed".

Agreed. Clerks are document-stamping and document-storing monkeys. Their job is entirely ministerial. Take the document, monkey. Now record it as being filed. Good little monkey.

Oh, Bulla has opinions all right … but I have never seen one posted. It wouldn't matter anyway. I have followed her CLE materials to a "T" before and even cited the material in my briefs to her and she still doesn't follow her own "rules," because she thinks "equity" means letting lazy attorneys get away with anything they want because of the policy to "hear cases on their merits" blah, blah, blah.

I have no idea how the Discovery Commissioners got appointed and retain their positions. I think it is a needless position. Discovery should be handled by the individual judges so that they are familiar with the parties and the issues, and the judges can then put those things into context when a motion for sanctions or disposition motion is brought.
