High-Powered Law Firms

  • Law

  • Prosecutors say Zaon Collins tested positive for meth, but Judge Ann Zimmerman declined to remand him back into custody. [RJ]
  • Family of inmate stabbed 96 times sues Department of Corrections. [RJ]
  • White House reminds providers that state bans on abortion don’t apply to emergency health care. [Nevada Current]
  • Judge Suzan Baucum set bail at 154,000 for two teachers with community ties and no criminal history. When Charles Goodwin, counsel for one of the parties, argued that they didn’t have the financial mean to post bond, Judge Baucum pointed out that he had hired a high-powered law firm. It’s unclear if this compliment(?) extended as well to the firm of the other teacher’s counsel, Matthew Sibert. [8NewsNow]

That's pretty genius of the judge. Make Goodwin argue, "Actually your honor, I'm extremely average"

Good for Zim calling out the DA for treating a high profile case differently than any other case.

Whatever. It’s her court order he’s violating. She doesn’t have to wait for the DA to point it out.

She called them out for being harsh because its high profile. Others call them out for not being harsh enough because its high profile. It is one or the other. Also strange to rely on evidence in other cases. I don't agree with that approach. Judges should look at the evidence presented in that case, not another case. They are not setting policy for the DA.

"Zimmerman also denied a request for Collins to be allowed to attend college out of state, after his defense attorneys said he was offered a full athletic scholarship to Salt Lake Community College. The college did not immediately respond to a request for comment on Monday." They are recruiting him for how fast he moves down the lane.

Judicial Review.
Make sure, in your complaint, that you allege denial of due process in the admin hearing. Sure way to get another hearing and once Judicial Review is granted, the admin boards nearly always reverse course.

And make sure you serve everyone and do it timely. You’ll blow the judicial review deadline, with prejudice, if you don’t.

811 here.
Point of practice.
In an actual admin hearing, if it doesn't seem to be going your way, or the hearing master / board is clearly against your client. Keep talking until they shut you up, cancel you or wont allow your questions.

If they shut you down, BINGO, denial of due process.

Lastly, don't hesitate to drop "Well, we are probably going to have to have this hearing Judicially Reviewed, anyway." That makes them pay attention as well.
