Friday Open Thread: Friday the 13th Edition!

  • Law

I realize it’s lunch already, but it wouldn’t be Friday without the Open Thread, you guys! Plus, as an added bonus, it’s Friday the 13th!

What’s happening in your neck of the woods? Does your paralegal listen to Top 40 music all day every day until you can’t stand hearing Adele or Kelly Clarkson one more time? Mine does. Anybody else want to gripe about their office, boss, or staff? Let it all out. We’re all friends here.

I have an admin that wears nasty and revealing clothing. I am scarred each time she leans over. I want to tell her that her clothes aren't attractive, but she thinks she looks good and I just don't know how to do it.

Yes! I can't stand that whiny Adele. But what is worse is the secretaries working themselves up into a collective snitfit about a perceived violation of some unwritten office code or policy. The drama sometimes lasts for days, and only gets worse if I try to wade in.

I can't believe he used the phrase "Epic Fail" in his Order. If that doesn't tell you that it's time to move on from using that term, I don't know what will.

So is it bad if the State Bar is trying to get you temporarily suspended already to have a United States Bankruptcy Judge send a disciplinary referral over to the State Bar?

In all seriousness, while many of us are amused by Judge Markell's colorful prose and it certainly meets his objective of getting the word out to counsel to be prepared, is there a point where his gratuitous gouging of the gregarious and gulliable of the BK practice crosses the line?

That may be so, but at least there is a judge who does something when an attorney crosses the line.

I give the judge a lot of credit. We all talk about the issues with attorneys and no one does anything about it. This appears to be a prime example of someone who apparently is not capable of running a law firm

It's not really poor mondejar's fault. He went to cooley for cripes sake. Plus how is mondejar supposed to know what the hell he is doing without training. Markell might have had more sympathy for mondejar since he knew that mondejar likely had no clue where he was, what he was supposed to be doing or who he was dealing with, and that mondejar's boss set him up for this.

This made me wince. But seriously how do you work for a firm and not know the cases??! I have been swamped before but I still know what's going on with my cases. Hell I've checked the court calendars myself before just to make sure I'm not missing any hearings

10:11,

It's easy. You get hired on by a volume practice. There are so many cases, you aren't assigned files, you are assigned monthly or weekly tasks. So someone, probably Levinson, looked at a calendar, and told this poor schlub "looks like you're be in front of Markell on such and such date." Or maybe told him the night before and didn't give him any kind of pleadings or even a heads up. It can happen. There's no excuse for sending an associate to clean up someone else's screwups. That's partner territory.

I'm not saying that excuses Mondejar's woeful lack of preparation. He's an attorney, which means he needs to wear big-boy pants and get prepared for any hearing he's going to, no matter when he finds out he's going (and Markell indicates this isn't the first time Mondejar's been unprepared). Just saying that it's likely that Levinson set him up by being a screwup himself.

I expect nothing more from Levinson than to send a sacrificial lamb to the wolf, when the Order to Show Cause clearly ordered Levinson (personally) to appear before the Court.

I have no sympathy for this associate. "My boss told me to do it" is no freakin' excuse for an attorney not to do his or her job. We all took the same oath folks.

rumor has it that PD team Chief and State Assemblyman Jason Frierson jumped ship and went to the DA's office. Knew he was an AG after school but this seems like a real weird move for a rising star at the PD. Anyone have the scoop?

Was there ever any doubt that Judge
Markell's Order would make it to Above the Law?

Mondejar has not one to blame but himself, but this kind of schadenfreude (ATL) makes me wince.
