How is this not violating privilege?

Also, have Telles and Draskovich never seen Godfather II?

No matter how batshit crazy my client is, I wouldn’t ever tell a third party, much less the whole world, that the client isn’t following my advice. Good Lord.

If this is what’s playing out in public, one can only imagine how strained the attorney-client relationship is in private. Yikes.

Kinda seems like it’s preempting an ineffective assistance of counsel appeal? Draskovich just making a record that if Telles proceeds to trial right now, it’s against the advice of counsel.

(Obviously I don’t do crim law, please correct me if I’m wrong)

Its to preempt the ineffective assistance claim. Telles will likely end up waiving a lot of arguments that would normally be brought in a habeas petition by insisting trial happen as quickly as possible. But he could try and get around the waiver issue by claiming counsel did not explain the consequences of his decision. So by stating on the record that Telles is acting against the advice of counsel, it avoids that issue in the future.

Often in evidentiary hearings on habeas petitions, the lawyers are trying to remember what they told a client 5 years ago. So at least in Telles’ case, there is some sort of record of what happened and the attorney can just refer back to that.

There is a case in Department 13 that anyone who does Business Court can tell you is Exhibit “A” for this principle.

There was a Dateline episode about Christopher Tapp. He spent two decades in an Idaho prison, wrongfully convicted of murder. Then, just a few years after his release he’s allegedly murdered by “Big Dan” Rodimer. This is the kind of improbable crazy story that happens all the time in this town. You wouldn’t think a person could be the victim of a murder twice, but Christopher Tapp was. His life was shortened twice by murder.

Dan is a good man. In a different era, the city would throw him their best women and wine. If some punk offered my children drugs, I would be tempted to beat them to death, too. Pick me for the jury!

I know Dan. I do not share your perspective on him and believe that the story that has emerged is consistent with the Dan I know. Took is stepdaughter to a poser party with drugs. Has her out at 1:50 in the morning. Loses his temper and beats someone to death.

Nevada does not have Debtor’s Prisons. No one goes to jail for failing to pay a consumer debt.
