Are you kidding? She is not a disaster. She is an example of the worst of lawyers– no intregrity, makes misrepresentations to the Court and when you read the Supreme Court briefs stole an old man's money. Sorry I have litigated with Geraldine also and there is not a redeeming bone in her body.

I have been in some contentious depositions but I have never heard of an attorney pulling a gun on the witness….until now. See the Motion for Protective Order in A655037 on 9/29/16.

I've been practicing for almost 40 years, mostly criminal defense. The only time I have been threatened or felt afraid was in a divorce case.

Honestly having read the transcript, kudos to Dale Hayes Jr. for keeping his head and trying to get his witness out of there (although Stuhmer clearly was not helping things). Pengilley will be done in by the transcript which pretty much speaks objectively of an attorney gone mad.

A worse example of a gun owner I can't imagine, except for maybe the lady who left the .45 loose and her 2 year old shot her through the back with it. Someone should call child protective services. 4 little kids and a gun sitting on a counter with no lock, just so she can brag on Twitter? If that was a black woman or man…

I'm a gun lover and so is my wife, both attorneys (No I'm not Pengilly). We have an office with 7 people; 2 attorneys and 5 staff members. All have a handgun of their choosing (which we paid for) with an 'under the desk' holster for them at their office. The only condition we gave for us to pay for their gun was that they always have it at the office under the desk if they're in the office.

To be clear though – liking guns and having them in the office in case a family law opposing party or civil lit opposing party shows up is different than an attorney, or even his/her staff, pulling the gun on someone in a deposition hoping to instigate them into attacking so the person can shoot them.
Responsible gun ownership, handling, and use is a reality; contrary to some public opinions.

How quick everyone is to judge without reviewing the opposition. Obviously, this is a disputed matter. Even assuming the facts are true, there have been depositions and conduct far worse. Wonder if the deposition was videotaped/recorded? Having a gun is permissible as long as it is not brandishing, recklessly displaying it, or threatening such as waiving it and pointing it at someone. No I am not Pengilly just a lawyer. Obviously, if true, this attorney did himself no favors.

The transcript on the record, and attached to the Motion, has both the witness and his attorney stating that the guy was pulling out his gun and showing it to them and the attorney told the reporter to make sure that was on the record.

And its the Court Reporter hired by Pengilly who took down a record reflecting him pulling a gun and Pengilly never stating "Why are you saying that? There is no gun." In fact (according to the Court Reporter hired by Pengilly) he seems to confirm everything that they are saying.

And there has been far worse conduct in a deposition than pulling a gun on a witness and chasing the deponent into the parking lot?

I'm a gun owner and a CCW licensee. What Pengilly did was indefensible. I've known him almost 20 years and he's always been close to the edge. But this is over the line. What will it take to prevent him from hurting himself or others?

Just because a court reporter reports "why are you shouting at time" does not mean the person is raising their voice or shouting. The court reporter usually reports what people are saying on the record not their own observations. Have not read the transcript yet. It is "let the record reflect."

I was surprised the police didn't take the reporter's statement. She was (allegedly?) a witness to a madman threatening people with a gun, after all.

Just because the Stuhmers did not have the Reporter's Statement does not mean that she did not make a statement or was not interviewed. They would have had copies of their own statements but would have had to order a copy of any statement made by the Court Reporter to LVMPD.
